Recently, the Supreme People's Court (SPC) and the Ministry of Public Security jointly released the Opinions on Work to Resolve Social Conflicts through Judicial Detention.
According to the Opinions, if it is necessary for a people's court to implement judicial detention based on the nature and specific circumstances of the illegal acts of obstructing legal proceedings or enforcement of an actor, the court should promptly make detention decisions and commit the detainees to the designated detention centers. As for resolution of social conflicts through judicial detention, the courts and police should establish an effective coordination and interaction mechanism, point persons should be designated respectively, and a consultation mechanism should be created to hold joint meetings on a regular or unscheduled basis to report work progress on the detention, management, and education of detainees and resolution of social conflicts.
