| Article 1 This Law is enacted for the purposes of strengthening the safety management of hazardous chemicals, preventing and reducing hazardous chemical incidents, safeguarding the health, life, and property safety of the people, and protecting the ecology and environment. | | 第一条 为了加强危险化学品的安全管理,预防和减少危险化学品事故,保障人民群众身体健康、生命安全和财产安全,保护生态环境,制定本法。 |
| Article 2 This Law shall apply to the safety management of the production, storage, use, distribution, and transport of hazardous chemicals. | | 第二条 危险化学品生产、储存、使用、经营和运输的安全管理,适用本法。 |
| Waste hazardous chemicals shall be disposed of in accordance with the laws, administrative regulations, and the rules of the state on ecological and environmental protection. | | 废弃危险化学品的处置,依照有关生态环境保护的法律、行政法规和国家有关规定执行。 |
| Article 3 For the purposes of this Law, “hazardous chemicals” means highly toxic chemicals and other chemicals that are harmful to humans, facilities, and the ecology and environment due to their toxic, corrosive, explosive, flammable, combustion-supporting, or other properties. | | 第三条 本法所称危险化学品,是指具有毒害、腐蚀、爆炸、燃烧、助燃等性质,对人体、设施、生态环境具有危害的剧毒化学品和其他化学品。 |
| The state establishes and improves the catalog management system for hazardous chemicals. The catalog of hazardous chemicals shall be determined and published by the emergency management department of the State Council in conjunction with the department of industry and information technology, the public security authority, the department of ecology and environment, the transport department, the department of agriculture and rural affairs, the health department, the Customs, the market regulatory department, the railway department, the civil aviation administration, and other departments based on the standards for the identification and classification of hazardous properties of chemicals, and shall be adjusted at appropriate time. | | 国家建立健全危险化学品目录管理制度。危险化学品目录,由国务院应急管理部门会同工业和信息化、公安、生态环境、交通运输、农业农村、卫生健康、海关、市场监督管理、铁路、民用航空等部门,根据化学品危险特性的鉴定和分类标准确定、公布,并适时调整。 |
| Article 4 The safety management of hazardous chemicals shall adhere to the leadership of the Communist Party of China. | | 第四条 危险化学品安全管理工作坚持中国共产党的领导。 |
| The safety management of hazardous chemicals shall adhere to the principle of putting people and life first, the holistic national security concept shall be carried out, development and safety shall be coordinated, the guidelines of safety first, prevention as the main approach, and comprehensive control shall be adhered to, and material safety risks shall be prevented and resolved from the source. | | 危险化学品安全管理工作应当坚持人民至上、生命至上,贯彻总体国家安全观,统筹发展和安全,坚持安全第一、预防为主、综合治理的方针,从源头上防范化解重大安全风险。 |
| The safety management of hazardous chemicals shall adhere to the principle that those in charge of the industry shall be responsible for safety, those in charge of the business shall be responsible for safety, and those in charge of production and distribution shall be responsible for safety, the primary responsibility of entities and the regulatory responsibility of the government shall be reinforced and fulfilled, and a mechanism featuring entities' assumption of responsibilities, employees' participation, government regulation, industrial self-regulation, and social supervision shall be established. | | 危险化学品安全管理工作实行管行业必须管安全、管业务必须管安全、管生产经营必须管安全,强化和落实单位主体责任与政府监管责任,建立单位负责、职工参与、政府监管、行业自律、社会监督的机制。 |
| Article 5 Enterprises, schools, scientific research institutions, medical institutions, testing institutions, inspection institutions, and other entities producing, storing, using, distributing, or transporting hazardous chemicals (collectively, “hazardous chemical entities”) shall implement a work safety responsibility system for all employees, establish a dual prevention mechanism for the graded management and control of safety risks and the investigation and management of potential hazards, strengthen work safety standardization and information system construction, and the primary person in charge shall be fully responsible for the work safety of hazardous chemicals in the entity. | | 第五条 生产、储存、使用、经营、运输危险化学品的企业、学校、科研机构、医疗机构、检测机构、检验机构等单位(以下统称危险化学品单位)应当实行全员安全生产责任制,构建安全风险分级管控和隐患排查治理双重预防机制,加强安全生产标准化、信息化建设,其主要负责人对本单位的危险化学品安全生产工作全面负责。 |
| A hazardous chemical entity shall meet the safety conditions prescribed by laws and administrative regulations and the requirements of national standards and industry standards, establish and improve safety management rules and regulations and post safety responsibility rules, provide work safety education and training to employees, provide employees with labor protection supplies that comply with national standards or industry standards, and purchase work-related injury insurance in accordance with the law. Employees shall receive education and training, and may only hold office after passing the assessment; and for the positions with qualification requirements, personnel with the corresponding qualifications shall be employed in accordance with the law. | | 危险化学品单位应当具备法律、行政法规规定和国家标准、行业标准要求的安全条件,建立健全安全管理规章制度和岗位安全责任制度,对从业人员进行安全生产教育和培训,为从业人员提供符合国家标准或者行业标准的劳动防护用品,依法参加工伤保险。从业人员应当接受教育和培训,考核合格后上岗作业;对有资格要求的岗位,应当配备依法取得相应资格的人员。 |
| Article 6 No entity or individual may produce, use, or distribute hazardous chemicals prohibited from production, use, or distribution by the state. | | 第六条 任何单位和个人不得生产、使用、经营国家禁止生产、使用、经营的危险化学品。 |
| If the state has restrictive provisions on the use of hazardous chemicals, no entity or individual may use them in violation of such restrictive provisions. | | 国家对危险化学品的使用有限制性规定的,任何单位和个人不得违反限制性规定使用危险化学品。 |
| Article 7 Relevant departments that conduct safety supervision and administration of the production, storage, use, distribution, and transport of hazardous chemicals (collectively, “departments charged with hazardous chemical safety supervision and administration duties”) shall perform duties in accordance with the following provisions: | | 第七条 对危险化学品的生产、储存、使用、经营、运输实施安全监督管理的有关部门(以下统称负有危险化学品安全监督管理职责的部门),依照下列规定履行职责: |
| (1) The emergency management department shall be responsible for hazardous chemical work safety supervision and administration and the comprehensive work relating to hazardous chemical safety supervision and administration, shall organize the determination, announcement, and adjustment of the catalog of hazardous chemicals, and in accordance with the law, examine the safety conditions and design of safety facilities of the construction, reconstruction, and expansion of the construction projects of the production and storage of hazardous chemicals (including the transport of hazardous chemicals through long pipelines, here and below) (collectively, “construction projects of hazardous chemicals”), issue hazardous chemical work safety permits, permits for the safe use of hazardous chemicals, and hazardous chemical business permits, be responsible for the registration of hazardous chemicals, and organize emergency response to hazardous chemical incidents. | | (一)应急管理部门负责危险化学品安全生产监督管理工作和危险化学品安全监督管理综合工作,组织确定、公布、调整危险化学品目录,依法对新建、改建、扩建生产、储存危险化学品(包括使用长输管道输送危险化学品,下同)的建设项目(以下统称危险化学品建设项目)进行安全条件审查和安全设施设计审查,核发危险化学品安全生产许可证、危险化学品安全使用许可证和危险化学品经营许可证,并负责危险化学品登记工作,组织危险化学品事故应急处置。 |
| (2) The public security authority shall be responsible for the public safety management of hazardous chemicals and issuing permits for the purchase of highly toxic chemicals and permits for the road transport of highly toxic chemicals, be responsible for granting permits for vehicles transporting hazardous chemicals to enter the areas where the passage of vehicles transporting hazardous chemicals is restricted, and managing the road traffic safety of vehicles transporting hazardous chemicals. | | (二)公安机关负责危险化学品的公共安全管理,核发剧毒化学品购买许可证、剧毒化学品道路运输通行证,负责运输危险化学品的车辆进入危险化学品运输车辆限制通行区域的许可,并负责危险化学品运输车辆的道路交通安全管理。 |
| (3) The market regulatory department shall be responsible for managing the industrial product production permits and supervising the product quality of hazardous chemicals included in the management catalog of industrial product production permits and their packaging materials and containers (including tanks, but excluding fixed large storage tanks for hazardous chemicals, here and below), and issuing business licenses for enterprises engaged in the production, storage, distribution, and transport of hazardous chemicals. | | (三)市场监督管理部门负责对纳入工业产品生产许可证管理目录的危险化学品及其包装物、容器(包括罐体,不包括储存危险化学品的固定式大型储罐,下同)实施工业产品生产许可证管理和产品质量监督,签发危险化学品生产、储存、经营、运输企业营业执照。 |
| (4) The department of ecology and environment shall be responsible for the supervision and administration of the disposal of waste hazardous chemicals, organizing ecological and environmental hazard assessments and ecological and environmental risk assessments for hazardous chemicals, be responsible for the environmental management registration of new chemical substances, investigating relevant hazardous chemical environmental pollution incidents and ecological damage incidents according to the division of duties, and be responsible for emergency ecological and environmental monitoring at the scene of hazardous chemical incidents. | | (四)生态环境主管部门负责废弃危险化学品处置的监督管理,组织危险化学品的生态环境危害性鉴定和生态环境风险程度评估,负责新化学物质环境管理登记,依照职责分工调查相关危险化学品环境污染事故和生态破坏事件,负责危险化学品事故现场的生态环境应急监测。 |
| (5) The transport department shall be responsible for the safety supervision and administration of road and waterway transport activities of hazardous chemicals, the licensing or recordation of road or waterway transport of hazardous chemicals, and the safety supervision and administration of transport vehicles, and be responsible for the qualification determination of drivers, crew members, loading and unloading management personnel, escorts, declarers, and on-site container loading inspectors of enterprises engaged in the road or waterway transport of hazardous chemicals. The railway regulatory department shall be responsible for the safety supervision and administration of the railway transport of hazardous chemicals and their transport vehicles. The civil aviation administration shall be responsible for the safety supervision and administration of the air transport of hazardous chemicals, air transport enterprises, and their transport vehicles. The postal administrative department shall be responsible for investigating and punishing the mailing and delivery of hazardous chemicals in accordance with the law. | | (五)交通运输主管部门负责危险化学品道路、水路运输活动安全监督管理,负责危险化学品道路运输、水路运输的许可或者备案,以及运输工具的安全监督管理,负责危险化学品道路运输企业、水路运输企业驾驶人员、船员、装卸管理人员、押运人员、申报人员、集装箱装箱现场检查员的资格认定。铁路监管部门负责危险化学品铁路运输及其运输工具的安全监督管理。民用航空主管部门负责危险化学品航空运输以及航空运输企业及其运输工具的安全监督管理。邮政管理部门负责依法查处寄递危险化学品的行为。 |
| (6) The health department shall be responsible for managing the toxicity identification of hazardous chemicals, supervising and administering the occupational health of hazardous chemical entities, and organizing and coordinating medical and health rescue work for injured persons in hazardous chemical incidents. | | (六)卫生健康主管部门负责危险化学品毒性鉴定的管理,负责危险化学品单位职业健康的监督管理,负责组织、协调危险化学品事故受伤人员的医疗卫生救援工作。 |
| (7) When making territorial spatial plans, the department of natural resources shall be responsible for incorporating relevant information such as hazardous chemical construction projects and chemical industry parks, special areas for storing hazardous chemicals, and the surrounding safety control distances into local territorial spatial plans according to the procedures, and shall ensure the effective supervision and implementation of such plans. | | (七)自然资源主管部门负责在编制国土空间规划时,将危险化学品建设项目及化工园区、储存危险化学品的专门区域和周边安全控制距离等有关内容按照程序纳入当地国土空间规划,并做好规划监督实施。 |
| (8) The department of industry and information technology shall, according to its duties, be responsible for the planning and layout of related industries for the production and storage of hazardous chemicals, organize the development of construction standards and management measures for determining chemical industry parks, and promote the exit of backward processes and production capacity. | | (八)工业和信息化主管部门依照职责负责危险化学品生产、储存的相关行业规划和布局,组织制定化工园区的建设标准和认定管理办法,并推动落后工艺、产能退出。 |
| (9) The Customs shall be responsible for inspecting imported and exported hazardous chemicals and their packaging in accordance with the law. | | (九)海关负责依法对进出口危险化学品及其包装实施检验。 |
| (10) Other departments shall perform their hazardous chemical safety supervision and administration duties according to their respective duties. | | (十)其他部门依照各自职责履行危险化学品安全监督管理职责。 |
| If hazardous chemical safety supervision and administration duties are unspecific due to involvement in emerging industries or fields, the people's government at or above the county level shall determine the regulatory department in a timely manner under the principle of similar business. | | 对因涉及新兴行业、领域,危险化学品安全监督管理职责不明确的,由县级以上人民政府按照业务相近的原则及时确定监督管理部门。 |
| Article 8 The department charged with hazardous chemical safety supervision and administration duties shall conduct supervision and inspection in accordance with the law and may take the following measures: | | 第八条 负有危险化学品安全监督管理职责的部门依法进行监督检查,可以采取下列措施: |
| (1) It may enter the workplaces of hazardous chemicals to conduct on-site inspections, inquire of relevant entities and persons about relevant information, consult and copy relevant documents and materials, and if necessary, conduct sampling inspections of hazardous chemicals. | | (一)进入危险化学品作业场所实施现场检查,向有关单位和人员了解情况,查阅、复制有关文件、资料,必要时可以对危险化学品实施抽样检测; |
| (2) It may use information technology to conduct online inspections and spot checks on major hazardous installations of hazardous chemical entities. | | (二)运用信息化手段对危险化学品单位的重大危险源开展在线巡查抽查; |
| (3) If it finds any potential hazards of hazardous chemical incidents, it may order the immediate elimination thereof or the elimination thereof within a prescribed time limit. | | (三)发现危险化学品事故隐患,责令立即消除或者限期消除; |
| (4) It may order the liable party to immediately stop using the facilities, equipment, devices, apparatus, and transport vehicles, among others, that fail to comply with the provisions of any law, administrative regulation, rule, or the requirements of national standards and industry standards. | | (四)对不符合法律、行政法规、规章规定或者国家标准、行业标准要求的设施、设备、装置、器材、运输工具等,责令立即停止使用; |
| (5) With the approval of the primary person in charge of the department, it may close down the places used for the illegal production, storage, use, or distribution of hazardous chemicals, and seize the hazardous chemicals illegally produced, stored, used, distributed, or transported, as well as the raw materials, equipment, and transport vehicles used for the illegal production, use, or transport of hazardous chemicals. | | (五)经本部门主要负责人批准,查封违法生产、储存、使用、经营危险化学品的场所,扣押违法生产、储存、使用、经营、运输的危险化学品以及用于违法生产、使用、运输危险化学品的原材料、设备、运输工具; |
| (6) If it discovers any illegal act that affects the safety of hazardous chemicals, it may order corrective action on the spot or order the violator to take corrective action within a prescribed time limit. | | (六)发现影响危险化学品安全的违法行为,当场予以纠正或者责令限期改正。 |
| The department charged with hazardous chemical safety supervision and administration duties shall conduct supervision and inspection in accordance with the law. Not less than two supervisors or inspectors shall be assigned, and they shall produce their law enforcement credentials. Relevant entities and individuals shall cooperate with the supervision and inspection carried out in accordance with the law and shall not refuse or obstruct the supervision and inspection. | | 负有危险化学品安全监督管理职责的部门依法进行监督检查,监督检查人员不得少于二人,并应当出示执法证件;有关单位和个人对依法进行的监督检查应当予以配合,不得拒绝、阻挠。 |
| Article 9 People's governments at and above the county level shall establish a coordination mechanism for hazardous chemical safety supervision and administration, support and supervise the departments charged with hazardous chemical safety supervision and administration duties in performing their duties in accordance with the law, and coordinate and resolve major issues in hazardous chemical safety supervision and administration. | | 第九条 县级以上人民政府应当建立危险化学品安全监督管理工作协调机制,支持、督促负有危险化学品安全监督管理职责的部门依法履行职责,协调、解决危险化学品安全监督管理工作中的重大问题。 |
| Departments charged with hazardous chemical safety supervision and administration duties shall strengthen regulatory cooperation and joint law enforcement, closely coordinate and cooperate, achieve prompt, sufficient, and effective information sharing, and strengthen hazardous chemical safety supervision and administration in accordance with the law. If it discovers any illegal act that shall be handled by other departments in accordance with the law, it shall, in a timely manner, transfer it to other departments for handling. | | 负有危险化学品安全监督管理职责的部门应当加强监管协作和联合执法,密切协调配合,实现信息及时、充分、有效共享,依法加强对危险化学品的安全监督管理。发现依法应当由其他部门处理的违法行为,及时移交其他部门处理。 |
| Article 10 All entities and individuals have the right to report to the department charged with hazardous chemical safety supervision and administration duties any violation of this Law or any potential hazard of incidents. The people's government at or above the county level and its relevant departments shall, in accordance with the law, give rewards to those who have made meritorious contributions in reporting illegal acts or major hazards of incidents, and strictly keep the information of the informants and reporters confidential. | | 第十条 任何单位和个人对违反本法规定的行为或者事故隐患,有权向负有危险化学品安全监督管理职责的部门举报或者报告。县级以上人民政府及其有关部门对举报违法行为或者报告重大事故隐患的有功人员依法给予奖励,并对举报人、报告人的信息进行严格保密。 |
| Article 11 The department charged with hazardous chemical safety supervision and administration duties of the people's government at or above the county level shall strengthen the information-based supervision of hazardous chemicals, and conduct electronic labeling and information-based management and monitoring of the entire life cycle of hazardous chemicals. | | 第十一条 县级以上人民政府负有危险化学品安全监督管理职责的部门应当加强危险化学品信息化监管,对危险化学品实行电子标识和全生命周期信息化管理和监控。 |
| Chemical industry parks shall specify the relevant work bodies responsible for work safety supervision and management and their duties, strengthen the information technology construction of hazardous chemicals, achieve information safety surveillance, monitoring, and early warning, and realize interconnection with relevant government departments. | | 化工园区应当明确负责安全生产监督管理的有关工作机构及其职责,加强危险化学品信息化建设,实现信息化安全监测、监控和预警,并与政府有关部门实现互联互通。 |
| Article 12 The state encourages hazardous chemical entities to adopt advanced technologies, processes, equipment, and automatic control systems that are conducive to enhancing safety assurance levels, and encourages the specialized storage, unified distribution, and centralized sale of hazardous chemicals. | | 第十二条 国家鼓励危险化学品单位采用有利于提高安全保障水平的先进技术、工艺、设备以及自动控制系统,鼓励对危险化学品实行专门储存、统一配送、集中销售。 |
| Article 13 Entities producing, storing, using, or distributing hazardous chemicals shall, in accordance with relevant rules issued by the state, register and file major hazard installations of hazardous chemicals, conduct regular inspections, assessment, and monitoring, make emergency response plans, establish a safety responsibility system for major hazard installations, report the quantity of major hazard installations stored, storage places, the information on management personnel, as well as relevant safety measures and emergency response measures to the emergency management department of the local people's government at the county level, the fire rescue institution, and relevant departments for recordation; and if hazardous chemicals are stored within the port area, report to the port administrative department, the fire rescue institution, and relevant departments for recordation. | | 第十三条 生产、储存、使用、经营危险化学品的单位应当按照国家有关规定对危险化学品重大危险源登记建档,进行定期检测、评估、监控,制定应急预案,建立重大危险源安全责任制,并将重大危险源的储存数量、储存地点、管理人员的情况及有关安全措施、应急措施报所在地县级人民政府应急管理部门、消防救援机构和有关部门备案;在港区内储存的,报港口行政管理部门、消防救援机构和有关部门备案。 |
| Departments charged with hazardous chemical safety supervision and administration duties shall conduct special supervision and inspection on the major hazard installations of hazardous chemicals in a classified and graded manner on a regular basis, supervise hazardous chemical entities in eliminating potential hazards in a timely manner, and prevent major and especially serious incidents. | | 负有危险化学品安全监督管理职责的部门应当分级分类定期对危险化学品重大危险源开展专项监督检查,督促危险化学品单位及时消除事故隐患,防范重特大事故发生。 |
| For the purposes of this Law, “major hazard installations” means units (including places and facilities) that produce, store, use, or distribute, either permanently or temporarily, hazardous chemicals whose quantities equal or exceed the threshold quantity. | | 本法所称重大危险源,是指长期或者临时生产、储存、使用和经营危险化学品,且危险化学品的数量等于或者超过临界量的单元(包括场所和设施)。 |
| Article 14 The people's governments at all levels and their relevant departments shall adopt various forms to strengthen the publicity and popularization of laws and regulations and knowledge on the safety of hazardous chemicals, and promote the enhancement of the entire society's safety awareness of hazardous chemicals. | | 第十四条 各级人民政府及其有关部门应当采取多种形式,加强危险化学品安全法律法规和危险化学品安全知识宣传普及工作,促进全社会危险化学品安全意识的提升。 |
| Chemical industry parks and hazardous chemical entities shall publicize the laws and regulations and knowledge on the safety of hazardous chemicals to the surrounding people and other production and distribution entities. | | 化工园区、危险化学品单位应当对周边群众和其他生产经营单位进行危险化学品安全法律法规和危险化学品安全知识宣传。 |
| News media shall publicize the laws and regulations and knowledge on the safety of hazardous chemicals and publicize violations of law in the safety of hazardous chemicals, and conduct public opinion supervision of violations of law in the safety of hazardous chemicals. | | 新闻媒体应当开展危险化学品安全法律法规和危险化学品安全知识公益宣传,对危险化学品安全违法行为进行舆论监督。 |
| Article 15 Entities and individuals that have made outstanding contributions to the safety of hazardous chemicals shall be commended and rewarded in accordance with relevant rules issued by the state. | | 第十五条 对在危险化学品安全工作中做出突出贡献的单位和个人,按照国家有关规定给予表彰、奖励。 |

| Article 16 The state makes overall plans and rational layouts for the production and storage of hazardous chemicals. | | 第十六条 国家对危险化学品的生产、储存实行统筹规划、合理布局。 |
| The department of industry and information technology of the State Council and other relevant departments of the State Council shall, according to their respective duties, be responsible for the industry planning and layout of the production and storage of hazardous chemicals. | | 国务院工业和信息化主管部门以及国务院其他有关部门依照各自职责,负责危险化学品生产、储存的行业规划和布局。 |
| When the local people's government organizes the formulation of territorial spatial plans, it shall plan appropriate areas (including chemical industry parks) specifically for the production and storage of hazardous chemicals according to the actual circumstances of its region and under the principle of ensuring safety. | | 地方人民政府组织编制国土空间规划时,应当根据本地区的实际情况,按照确保安全的原则,规划适当区域(包括化工园区)专门用于危险化学品的生产、储存。 |

| Article 40 An entity producing or storing highly toxic chemicals or hazardous chemicals that can be used to produce explosives as prescribed by the public security authority of the State Council (“hazardous chemicals used to produce explosives”) shall truthfully record the types, quantities, and flow of highly toxic chemicals or hazardous chemicals used to produce explosives, take necessary safety precautions to prevent the loss or theft thereof, and, if it discovers the loss or theft, shall immediately report to the local public security authority. | Article 45 Where an entity producing or storing hazardous chemicals undergoes a complete or partial change of production, ceases production, ceases business operation, or is dissolved, it shall take effective measures to dispose of its hazardous chemical production facilities and storage facilities, and the inventory of hazardous chemicals in a timely and proper manner, and may not discard hazardous chemicals. The disposal plan shall be submitted to the emergency management department, the department of industry and information technology, and the department of ecology and environment of the local people's government at the county level, and the public security authority and the fire rescue institution for recordation.
