| The appellant, Beijing Zhenglejia Technology Co., Ltd. (hereinafter referred to as “Zhenglejia Company”), appealed to this Court against the civil judgment (No. 21822 [2007], First, Civil Division, Haidian) as rendered on October 29, 2007 by the People's Court of Haidian District of Beijing Municipality (hereinafter referred to as the “first-instance court”) for dispute over copyright infringement. After accepting this case on January 22, 2008, this Court formed a collegial panel according to the law and openly heard it on March 11, 2008. Chen Yong, the legal representative of the appellant Zhenglejia Company, Zhang Zhifeng, the agent thereof, and Rong Chao, the agent of the appellee Beijing Ciwen Video Production Co., Ltd. (hereinafter referred to as “Ciwen Company”), appeared in court and participated in court proceedings. | The first-instance court determined that: The film Seven Swords was completed in May 2005 and was first shown on July 29 of the same year. As indicated in the DVD sleeve of the film Seven Swords as distributed by Peninsula Audio & Video Publishing Corporation and Guangdong Face Audio & Video Production Co., Ltd., the International Standard Recording Code (ISRC) of this film was CN-D01-05-0123-0/V.J9, it was co-presented by Ciwen Company, Boram Entertainment Inc. (hereinafter referred to as “Boram Entertainment”), and Meridian Pictures Co., Ltd. (hereinafter referred to as “Meridian Pictures”) and was co-produced by Merlin Chinta Investment Group, and Purple Light Media Co., Ltd. assisted in shooting this film; when the DVD was played, it was indicated in the tail leader that this film was shot under joint assistance of Mandarin Films Distribution Co., Ltd. and Fortissimo Films and it was co-produced by Ciwen Company, Boram Entertainment, Meridian Pictures, and Merlin Chinta Investment Group. | | 正乐佳公司系PP点点通软件之开发者及pp365网站之经营者。PP点点通软件系一款使用点对点（Peer-to-Peer，缩写为P2P）技术的软件，网络用户使用该软件可以对该软件其他在线网络用户的硬盘共享文件进行搜索，该软件根据网络用户的搜索指令由程序自动完成搜索并建立相应链接，网络用户点击相应链接可以直接下载上述硬盘共享文件。pp365网站向网络用户提供PP点点通软件的免费下载服务。在网络环境下运行PP点点通软件并输入用户名和密码之后，在未输入任何关键字情况下点击PP点点通软件所设置的搜索选项，网络用户将自动登录网址为http：//61.162.230.22/pp365/top/的网站（简称top网站），该网站页面上方载有PP点点通和www.pp365.com字样，且网站栏目设置、页面风格等与pp365网站基本相同。该网站设置“下载人气榜30强”栏目，电影《七剑》位居其首，并注明导演为徐克，主演为黎明、甄子丹、孙红雷等，类型为武侠、动作，片长90分钟，加入时间为2005年7月26日，人气指数为★★★★★，并载有相关内容简介。网络用户点击“下载人气榜30强”栏目中电影《七剑》的“下载：上 下”选项，即可免费下载电影《七剑》全部内容。原审法院庭审过程中，正乐佳公司称其不能确定top网站是否系其所经营。 |
| | pp365网站网页上方载有“共享电影疯狂下载 快感爆出来”等字样；其客服中心栏目内的关于下载和传输进度的介绍中称PP点点通软件具有自动换人续传、多点续传等功能；其站点导航栏目内的广告联系中称PP点点通软件是中国目前用户最多、影响力最大的中文P2P软件，现有注册用户3500多万，且以平均每天新增注册用户30余万的速度增长，网站页面访问量日过百万，并称在正乐佳公司的软件与网站投放广告便意味着获得千万潜在用户等；其影视频道栏目内，设置专题影片、连续剧、动作片、喜剧片、爱情片、科幻片、恐怖片、文艺片、战争片、纪录片、动画片、综艺片、大陆电影、港台电影、欧美电影、日韩电影等诸多电影分类检索选项，且载有新片速递、推荐专题影片、最新电影推荐、连续剧推荐、最新更新电影等诸多分栏目，其中推荐专题影片分栏目包括香港赌片、韩国情爱电影、超级女声、大长今等下级栏目，最新电影推荐分栏目包括大陆电影、港台电影、欧美电影、日韩电影等下级栏目，最新更新电影分栏目包括动作片、喜剧片、爱情片、科幻片、恐怖片、战争片、文艺片、动画片等下级栏目等。 |
| | 慈文公司于2005年12月6日、7日在上海市静安区公证处公证人员监督下对pp365网站、PP点点通软件以及top网站上述相关情况进行证据保全。 |
| | 慈文公司在向原审法院起诉正乐佳公司之前，曾向正乐佳公司就此事发送律师函。正乐佳公司于2006年5月19日向慈文公司之委托代理人回函称：正乐佳公司确认在其网站上确实有电影《七剑》的介绍，亦确认确实有PP点点通软件网络用户的硬盘共享文件中包括电影《七剑》；正乐佳公司搜集的影视介绍与PP点点通软件并无密切关系，其网站载有影视介绍的影片中的很大部分并不能被PP点点通软件搜索和下载；正乐佳公司在收到慈文公司发送的律师函之后，已暂时删除电影《七剑》的介绍，并将“七剑”作为关键字加入过滤词库以致PP点点通软件用户不能搜索到电影《七剑》等。 |
| | 正乐佳公司向原审法院提交pp365网站所载该公司简介、免责声明以及PP点点通软件简介、用户服务条款、用户许可协议等，以证明PP点点通软件向网络用户提供信息搜索、资源共享等服务，而未向网络用户提供任何内容服务；PP点点通软件根据网络用户的搜索指令由程序自动在PP点点通软件其他在线网络用户的硬盘共享文件中进行搜索并建立相应链接，网络用户点击相应链接可以直接下载上述硬盘共享文件，此时该公司网络服务器内并未复制相应共享文件，其亦未对网络用户的硬盘共享文件进行信息网络传播；该公司已明确要求用户不得利用PP点点通软件侵犯他人著作权以及其他合法权利，且该公司对此不承担责任等。 |
| | 慈文公司向原审法院提交其与上海天闻律师事务所所签聘请律师合同，并向原审法院提交了三万元的律师费发票和一千元的公证费发票，称上述费用均系为本案所支出。 |
