 (二)诉辩主张
 1.原告李永吉诉称
 位于厦门市海沧区东孚镇山边村下土楼社系原告祖母李谅(缅甸名:DAW TINYAN,已故)生前所有。2010年11月19日,厦门市海沧区人民法院作出了海民初字第1263号民事判决书(已生效),判决确认原告继承取得上述房产所有权。该房产现因厦深铁路建设需要被征用,原告须办理相关拆迁补偿手续,上交原房屋产权证,但该产权证由于历史原因由被告李石鼓收藏至今。原告因此多次请求被告予以归还,但被告均予拒绝。现为维护法律尊严及自身合法权益,原告特提起诉讼,请求判令:(1)被告立即归还原告产权证;(2)本案诉讼费由被告承担。
 2.被告李石鼓辩称
 (1)该房屋产权证收藏在被告手里是有原因的,原告要求被告返还产权证需要进行经济补偿。(2)李谅当年受到被告父亲的照顾,包括生活、生病以及其后事的处理。处理完后事后,被告父亲代为管理该房产,进行修缮、维护。被告父亲去世后,交由被告进行管理。1997年换新证的时候,由被告提供其父亲的产权证作为担保才办出本案诉争的产权证。(3)被告及其父亲为该房产能保存下来花费了人力、物力,原告应当对其进行经济补偿。
 (三)事实和证据
 厦门市海沧区人民法院经公开审理查明:
 2010年,李永吉作为原告起诉李永福要求确认其祖母李谅名下的房产归其所有,本院于2010年11月19日作出(2010)海民初字第1263号民事判决书,判决确认李谅名下的房产归原告李永吉所有,该判决已于2010年12月30日生效。上述房产的权属证件因历史原因由被告李石鼓收藏至今。该房产现因厦深铁路建设需要被征用,原告李永吉须上交房屋产权证办理相关拆迁补偿手续,因此,原告李永吉多次请求被告李石鼓归还该房屋产权证,但被告李石鼓均予以拒绝。双方因此发生纠纷,原告李永吉遂向本院提起诉讼,请求判令被告李石鼓立即归还原告李永吉房屋产权证。
