[Summary] [裁判摘要]
1. In the consumption pattern of prepayment where a consumer prepays all charges and the business operator provides commodities or service afterwards in separate times, if the standard clause provided by the business operator specifies “if a consumer unilaterally terminates consumption, the business operator will not refund the prices of commodities or services for which the prices therefor have been charged but the commodities or services which have not been provided by the business operator,” such standard clause violates the relevant provisions of the Contract Law of the People's Republic of China and the Law of the People's Republic of China on the Protection of Consumer Rights and Interests and it should be invalid. 一、在消费者预先支付全部费用、经营者分期分次提供商品或服务的预付式消费模式中,如果经营者提供的格式条款载明“若消费者单方终止消费,则经营者对已经收费但尚未提供商品或服务部分的价款不予退还”的,该类格式条款违反我国合同法、消费者权益保护法的相关规定,应属无效。
2. In prepayment consumption, if a consumer unilaterally terminates consumption and the business operator commits no breach of contract or has no fault, the liability for breach of contract of the consumer shall be determined by taking into full account of such factors as the fault degree of the consumer, the percentage of commodities or services the business operator has provided in the total volumes as agreed on, and the pricing methods as agreed on. 二、在预付式消费中,如果消费者单方终止消费,经营者并无违约或过错行为的,应结合消费者过错程度、经营者已经提供的商品或服务量占约定总量的比例、约定的计价方式等因素综合确定消费者的违约责任。

BASIC FACTS
 
Plaintiff: Sun Baojing, female, 35 years old, Chinese Han, with the registered permanent residence in Keshan County, Heilongjiang Province. 原告:孙宝静。
Defendant: Shanghai Must Beauty Co., Ltd., domiciled at Huaihai Middle Road, Shanghai Municipality. 被告:上海一定得美容有限公司。
Legal Representative: Lin Baoyi, General Manager of the Company. 法定代表人:林宝仪,该公司总经理。
The plaintiff, Sun Baojing, instituted a lawsuit in the People's Court of Huangpu District, Shanghai Municipality against the defendant, Shanghai Must Beauty Co., Ltd. (hereinafter referred to as “Must Company”) for service contract dispute. 原告孙宝静因与被告上海一定得美容有限公司(以下简称一定得公司)发生服务合同纠纷,向上海市黄浦区人民法院提起诉讼。
The plaintiff, Sun Baojing, alleged that: In July 2010, the plaintiff and the defendant, Must Company, entered into an agreement on Sau San Tong healthy slimming services, effective from July 18, 2010 to January 18, 2011. Afterwards, the plaintiff prepaid the service charges of 100,000 yuan to the defendant. After having taken slimming services at the defendant's for several times, the plaintiff did not lose weight but felt unwell repeatedly. Due to this, the plaintiff negotiated with the defendant for multiple times, but the negotiation failed. The plaintiff no longer consumed at the defendant's after the dispute arose. At present, the plaintiff has lost confidence in the services of the defendant, and the service term as agreed on in the service agreement between both parties has expired. The defendant did not provide effective services after it collected service charges from the plaintiff. Therefore, the defendant should refund the service charges. So the plaintiff instituted a lawsuit and requested the court to order that (1) the service agreement concluded on July 18, 2010 between the plaintiff and the defendant should be cancelled; and (2) the defendant should refund 90,000 yuan to the plaintiff. 原告孙宝静诉称:2010年7月,原告与被告一定得公司签订了修身堂健康纤体服务协议一份,服务期限自2010年7月18日起至2011年1月18日。嗣后原告向被告预付了服务费人民币100 000元。原告在被告处进行了几次纤体服务后,非但体重未减轻,且多次感到身体不适,为此原告与被告进行多次交涉未果,原告在纠纷发生后亦未再去被告处进行消费,现因原告已对被告服务失去信心,且双方服务协议约定的服务期限业已过期,被告收取原告服务费后未提供有效服务,理应退还服务费用。原告故起诉,要求判令:1.解除原、被告之间于2010年7月18日签订的服务协议;2.被告返还原告人民币 90000元。
...... 原告孙宝静为证明其主张,向法院提供了:1.服务协议;2.发票及银联签购单;3.健康饮食体态分析表、身体护理记录。
 被告一定得公司辩称:原、被告双方所签订服务协议已经到期,不可能再解除。原告在服务期限内自动放弃接受服务,故按双方合同约定及相关法律规定不存在解除合同并退款的理由,故不同意原告的诉讼请求。
 被告一定得公司为证明其主张,向法院提供了:1.申明书;2.服务疗程记录;3.修身堂客用价目表。
 
 上海市黄浦区人民法院一审查明:
 2010年7月18日,原告孙宝静与被告一定得公司签订了服务协议,协议约定:本协议的期限自2010年7月18日起至 2011年1月18日止。原告选择被告提供的价值人民币100 000元的尊贵疗程,所有项目疗程单价按85折从卡内扣。如原告未按计划及进程表接受被告提供的服务的,经被告善意提醒,仍未能有改善的,且超过本协议约定的服务期限的,则视为原告放弃提供的服务。原告保证遵照被告制定的方案,适时参加各类项目及正确使用相关产品,如因原告自身原因不能按被告制定的方案切实履行,则原告不能要求退还任何已支付予被告的费用;原告保证在一定得公司的合理安排下,参加协议约定的各类项目,如因自身原因连续三个月不能参加相关项目,则被告有权终止服务,原告保证不得向被告要求退赔任何费用;根据各人情况的不同,被告提供的服务期限一般为3-12个月,原告保证努力遵守被告制定的方案及进程,以配合被告服务的实施。原告任何懈怠的态度或违反方案及进程的行为,经被告善意提醒而未有改善的,被告有权终止对原告的服务,原告并不得要求被告退赔任何费用。被告为确保双方协议完整履行,特向原告发布声明书,上写郑重声明:为促使阁下达到理想的疗体效果,阁下必须:(1)遵从我司的顾问指示; (2)配合营养师的指导及配合进食时间; (3)配合纤体部之安排并参与所有纤体疗程。如因阁下的个人原因,不能配合我司上述之安排而导致纤体疗程失败或进度缓慢,我司一概不负任何责任,也不会因此而退还余款或保留按照协议追究违约责任的权利。原告在该声明书上签字予以确认。
