| | （一）基本案情 |
| | 本案系因已故著名学者钱钟书书信手稿拍卖引发的纠纷。申请人杨季康称：钱钟书（已故）与杨季康系夫妻，二人育有一女钱瑗（已故）。钱钟书、杨季康及钱瑗与李国强系朋友关系，三人曾先后致李国强私人书信百余封，该信件本由李国强收存，但是2013年5月间，中贸圣佳公司发布公告表示其将于2013年6月21日举行“也是集--钱钟书书信手稿”公开拍卖活动，公开拍卖上述私人信件。为进行该拍卖活动，中贸圣佳公司还将于2013年6月8日举行相关研讨会，2013年6月18日至20日举行预展活动。杨季康认为，钱钟书、杨季康、钱瑗分别对各自创作的书信作品享有著作权。钱瑗、钱钟书先后于1997年3月4日、1998年12月19日病故。钱钟书去世后，其著作权中的财产权由杨季康继承，其著作权中的署名权、修改权和保护作品完整权由杨季康保护，发表权由杨季康行使。钱瑗去世后，其著作权中的财产权由杨季康与其配偶杨伟成共同继承，其著作权中的署名权、修改权和保护作品完整权由杨季康与杨伟成保护，发表权由杨季康与杨伟成共同行使；鉴于杨伟成明确表示在本案中不主张权利，故杨季康依法有权主张相关权利。杨季康主张，中贸圣佳公司及李国强即将实施的私人信件公开拍卖活动，以及其正在实施的公开展览、宣传等活动，将侵害杨季康所享有和继承的著作权，如不及时制止上述行为，将会使杨季康的合法权益受到难以弥补的损害，故向法院提出申请，请求法院责令中贸圣佳公司及李国强立即停止公开拍卖、公开展览、公开宣传杨季康享有著作权的私人信件。 |
