| In accordance with the relevant provisions of the Law on the Protection of Consumer Rights and Interests, market trading activities should follow the principle of fair dealing and forcible buying or selling should be opposed. Consumers have the right to know the truth of commodities they buy and services they accept. For the purpose of popularizing value-added telecommunication services, mobile phone service providers determine a free experience period in advance and subscribers may experience value-added services free of charge during this period. After the free experience period expires, when charging fees for such value-added services, telecommunication providers should obtain the specific acceptance from the subscriber. Otherwise, the forcible fee deduction of telecommunication providers will infringe upon the consumer's right to know services he or she accepts, which violates the principle of fair dealing in the market. | | 根据《消费者权益保护法》的有关规定，市场交易行为应当遵循公平交易原则，反对强买强卖行为。消费者有权知悉所购买商品和接受服务的真实情况。手机电信服务提供者为达到电信增值业务推广目的，事先确定免费体验期，用户可在该期间内免费体验增值服务。免费期过后，电信服务提供者对该增值业务进行收费时，应当得到用户明确的使用承诺，否则，电信服务提供者的强行扣费行为侵犯了消费者对所接受服务的知情权，违背市场公平交易原则。 |

| | 原告郑传新因与被告中国电信股份有限公司连云港分公司(以下简称连云港电信公司)发生电信服务合同纠纷，向江苏省连云港市海州区人民法院提起诉讼。 |
| | 原告郑传新诉称：2014年12月4日，原告去被告连云港电信公司的营业厅交话费，发现电话号码133XXXX6469被无故扣除增值与新业务费4．83元，拨打10000号查询为手机报扣费。询问开通原因，被告说是通过电话营销开通的，接听手机的人同意开通。被告于12月5日向原告播放了相关通话录音，接听电话的是一位女士，不是机主本人，被告在外呼过程中未有效核实机主身份，连最起码的身份证验证或密码验证都没有。被告本应该在免费体验结束后，询问原告是否继续使用，如果原告未确认或明确表示不需要此业务，被告应停止该业务，不得收费。被告事后未征得原告同意，擅自开通该业务，在原告不知情的情况下对原告账户中的私有财产肆意侵占，侵犯了原告的知情权和财产权。违背了被告对用户的承诺。原告多次要求被告赔偿损失，赔礼道歉，被告一直拖延和拒绝。被告的行为违反了《消费者权益保护法》第八条、第九条、第四十八条、第五十五条以及《中华人民共和国电信条例》第四十一条、第七十五条的规定，现原告诉至法院，请求判令被告赔偿损失500元，要求被告向原告赔礼道歉，保证杜绝此类事件再次发生，诉讼费用由被告承担。 |
