| | 重庆联飞机车有限公司(以下简称联飞公司)因与老挝力宏摩托车组装有限公司(以下简称力宏公司)买卖合同纠纷向重庆市第五中级人民法院(以下简称市五中院)申请诉前保全。市五中院裁定扣押力宏公司价值140000美元的摩托车散件1000套，查封联飞公司提供的打包线、检测线、组装流水线等担保财产，并将上述扣押物和担保物委托联飞公司一并保管。联飞公司未尽妥善保管义务，私自处理了部分被查封物和担保物，现已下落不明。市五中院知情后随即变更了保管人，将尚存的扣押物和担保物委托第三人保管。嗣后，市五中院经审理作出民事判决，力宏公司应支付联飞公司违约金5万美元。判决生效后市五中院解除对摩托车散件价值超过5万美元的部分约640套的扣押，将封存于第三人处尚存的扣押物移交给了力宏公司。 |
