The Regulations of the People's Republic of China on Use of Police Implements and Arms by the People's Police adopted at the 41st Executive Meeting of the State Council on January 8, 1996 are hereby promulgated and shall take effect as of the date of promulgation.

Chapter I General Provisions
 

第一章 总则


Article 1 These Regulations are formulated in accordance with the provisions of the People's Police Law of the People's Republic of China and other relevant laws for the purpose of ensuring the people's policemen's lawful performance of their duties, their correct use of police implements and arms, and their timely and effective suppression of illegal and criminal acts so as to maintain public security and social order, safeguard personal safety and the lawful property of citizens and protect public property.
   第一条 为了保障人民警察依法履行职责,正常使用警械和武器,及时有效地制止违法犯罪行为,维护公共安全和社会秩序,保护公民的人身安全和合法财产,保护公共财产,根据《中华人民共和国人民警察法》和其他有关法律的规定,制定本条例。
Article 2 In suppressing illegal and criminal acts, the people's policemen may use coercive measures; if need be, they may use police implements in accordance with the provisions of these Regulations; in case the use of police implements fails to achieve the purpose of suppression or serious harmful consequences are likely to occur without using arms, they may use arms in accordance with the provisions of these Regulations.
   第二条 人民警察制止违法犯罪行为,可以采取强制手段;根据需要,可以依照本条例的规定使用警械;使用警械不能制止,或者不使用武器制止,可能发生严重危害后果的,可以依照本条例的规定使用武器。
Article 3 "Police implements" mentioned in these Regulations refer to the implements the people's policemen are equipped with according to provisions, such as truncheons, tear bombs, high-pressure water guns, special riot guns, handcufs, fetters and police ropes; "arms" mentioned in these Regulations refer to the lethal arms the people's policemen are equipped with according to provisions, such as guns and ammunition.
   第三条 本条例所称警械,是指人民警察按照规定装备的警棍、催泪弹、高压水枪、特种防暴枪、手铐、脚镣、警绳等警用器械;所称武器,是指人民警察按照规定装备的枪支、弹药等致命性警用武器。
Article 4 When using police implements and arms, the people's policemen shall take it as a principle to suppress illegal and criminal acts and minimize casualties and property loss.
   第四条 人民警察使用警械和武器,应当以制止违法犯罪行为,尽量减少人员伤亡、财产损失为原则。
Article 5 The lawful use of police implements and arms by the people's policemen shall be protected by law.
The people's policemen shall not use police implements and arms in violation of the provisions of these Regulations.
   第五条 人民警察依法使用警械和武器的行为,受法律保护。
人民警察不得违反本条例的规定使用警械和武器。
Article 6 Before using police implements and arms, the people's policemen shall order persons at the scene having no connection to dodge; the persons at the scene having no connection shall obey the orders of the people's policemen to avoid injury or other losses.
   第六条 人民警察使用警械和武器前,应当命令在场无关人员躲避;在场无关人员应当服从人民警察的命令,避免受到伤害或者其他损失。
Chapter II: Use of Police Implements
 

第二章 警械的使用


Article 7 The people's policemen may, after warning without success, use police implements with dispersing or controlling features such as truncheons, tear bombs, high-pressure water guns and special riot guns when they meet with one of the following situations:
   第七条 人民警察遇有下列情形之一,经警告无效的,可以使用警棍、催泪弹、高压水枪、特种防暴枪等驱逐性、制服性警械:
(1) ganging together in affrays, beating other persons, creating disturbances, insulting women or conducting other indecent activities;
 (一)结伙斗殴、殴打他人、寻衅滋事、侮辱妇女或者进行其他流氓活动的;
(2) gathering people to disturb the order of public places such as stations, wharves, civil airports and sports grounds;
 (二)聚众扰乱车站、码头、民用航空站、运动场等公共场所秩序的;
(3) illegally holding an assembly, procession or demonstration;
 (三)非法举行集会、游行、示威的;
(4) forcing through a cordon which is set up by the people's policemen for performing their duties;
 (四)强行冲越人民警察为履行职责设置的警戒线的;
(5) resisting or obstructing by means of violence the people' s policemen from performing their lawful duties;

 (五)以暴力方法抗拒或者阻碍人民警察依法履行职责的;
