| To strengthen the protection of the national interest and the public interest, it is decided at the15th session of the Standing Committee of the Twelfth National People's Congress to authorize the Supreme People's Procuratorate to launch the pilot programofinitiating public interest actions in such aspects as protection of ecological environment and resources, protection of state-owned assets, transfer of state-owned land use right, and food and drug safety. 13 provinces, autonomous regions, and municipalities directly under the Central Government, namely, Beijing, Inner Mongolia, Jilin, Jiangsu, Anhui, Fujian, Shandong, Hubei, Guangdong, Guizhou, Yunnan, Shaanxi and Gansu are determined as the pilot areas. The people's courts shall try the public interest actions initiated by the people's procuratorates in accordance with the law. The implementation of the pilot program must adhere to the unity of the leadership of the Party, the position of the people as masters of the country and rule by law, maximize the functional roles of legal supervision and judicial adjudication, promote administration by law and strict law enforcement, uphold the authority of the Constitution and laws, maintain social fairness and justice, and safeguard the national interest and the public interest. The pilot program shall be conducted in a steady and orderly manner, and follow the principles of the relevant litigation system. Before initiating public interest actions, the people's procuratorates shall urge in accordance with the law the relevant administrative organs to correct illegal administrative acts and perform their statutory duties, or urge and support the initiation of public interest actions by the organs and relevant organizations as provided by law. The measures for the implementation of this Decision shall be developed by the Supreme People's Court and the Supreme People's Procuratorate, and be submitted to the Standing Committee of the National People's Congress for recordation. The term of the pilot program shall be two years, commencing from the date of issuance of this Decision. | | 为加强对国家利益和社会公共利益的保护，第十二届全国人民代表大会常务委员会第十五次会议决定：授权最高人民检察院在生态环境和资源保护、国有资产保护、国有土地使用权出让、食品药品安全等领域开展提起公益诉讼试点。试点地区确定为北京、内蒙古、吉林、江苏、安徽、福建、山东、湖北、广东、贵州、云南、陕西、甘肃十三个省、自治区、直辖市。人民法院应当依法审理人民检察院提起的公益诉讼案件。试点工作必须坚持党的领导、人民当家作主和依法治国的有机统一，充分发挥法律监督、司法审判职能作用，促进依法行政、严格执法，维护宪法法律权威，维护社会公平正义，维护国家利益和社会公共利益。试点工作应当稳妥有序，遵循相关诉讼制度的原则。提起公益诉讼前，人民检察院应当依法督促行政机关纠正违法行政行为、履行法定职责，或者督促、支持法律规定的机关和有关组织提起公益诉讼。本决定的实施办法由最高人民法院、最高人民检察院制定，报全国人民代表大会常务委员会备案。试点期限为二年，自本决定公布之日起算。 |
