| In order to safeguard China's territorial sovereignty and maritime rights and interests, equally protect the lawful rights and interests of Chinese and foreign parties, and specify judicial jurisdiction and application of law as to sea areas under the jurisdiction of China, these Provisions are developed in accordance with the Law of the People's Republic of China on Territorial Waters and Contiguous Zones, the Law on Exclusive Economic Zones and Continental Shelves of the People's Republic of China, the Criminal Law of the People's Republic of China (hereinafter referred to as the “Criminal Law”), the Exit-Entry Administration Law of the People's Republic of China (hereinafter referred to as the “Exit-Entry Administration Law”), the Public Security Administration Punishments Law of the People's Republic of China (hereinafter referred to as the “Public Security Administration Punishments Law”), the Criminal Procedure Law of the People's Republic of China, the Civil Procedure Law of the People's Republic of China, the Special Maritime Procedure Law of the People's Republic of China, the Administrative Procedure Law of the People's Republic of China as well as the relevant international treaties to which China is a signatory party or has acceded and in light of the trial practice. | | 为维护我国领土主权、海洋权益，平等保护中外当事人合法权利，明确我国管辖海域的司法管辖与法律适用，根据《中华人民共和国领海及毗连区法》《中华人民共和国专属经济区和大陆架法》《中华人民共和国刑法》《中华人民共和国出境入境管理法》《中华人民共和国治安管理处罚法》《中华人民共和国刑事诉讼法》《中华人民共和国民事诉讼法》《中华人民共和国海事诉讼特别程序法》《中华人民共和国行政诉讼法》及中华人民共和国缔结或者参加的有关国际条约，结合审判实际，制定本规定。 |
