| Announcement on Issues concerning the Implementation of the Catalogue of Industries for Guiding Foreign Investment (2017 Revision) | | 关于执行《外商投资产业指导目录（2017年修订）》有关问题的公告 |
| The National Development and Reform Commission and the Ministry of Commerce issued Order No. 4 the Catalogue of Industries for Guiding Foreign Investment (2017 Revision) (see Annex for details), which shall come into force on July 28, 2017. The relevant issues on the implementation of this Catalogue by the Customs are hereby announced as follows: | | 国家发展改革委、商务部第4号令公布了《外商投资产业指导目录（2017年修订）》，并规定自2017年7月28日起施行。现就海关执行中的有关问题公告如下： |
| I. From July 28, 2017, the equipment imported for own use within the total amount of investment as well as the technology, components and spare parts imported along with the aforesaid equipment under contracts for foreign-funded projects (including additional investment projects) in the encouraged category in the Catalogue of Industries for Guiding Foreign Investment (2017 Revision), excluding the goods listed in the Catalogue of Imported Goods Not Exempted from Tax for Foreign-Funded Projects and the Catalogue of Imported Crucial High-Tech Equipment and Products Not Exempted from Tax, shall be exempt from tariff in accordance with the Notice of the State Council on Adjusting Tax Policies for Imported Equipment (No. 37 [1997], State Council), the Announcement No. 103 [2008] of the General Administration of Customs, and other relevant provisions, but shall be subject to the import value-added tax in accordance with the relevant provisions. | | 一、自2017年7月28日起，对属于《外商投资产业指导目录（2017年修订）》鼓励类范围的外商投资项目（包括增资项目），在投资总额内进口的自用设备以及按照合同随上述设备进口的技术和配套件、备件，除《外商投资项目不予免税的进口商品目录》和《进口不予免税的重大技术装备和产品目录》所列商品外，按照《国务院关于调整进口设备税收政策的通知》（国发〔1997〕37号）和海关总署公告2008年第103号及其他相关规定免征关税，照章征收进口环节增值税。 |
| II. After the Catalogue of Industries for Guiding Foreign Investment (2017 Revision) comes into force, the code of the “Project Industrial Policy Items” in the Confirmation Letter on Domestic and Foreign Investment Projects Encouraged by the State, official reply or recordation receipt for the formation (additional investment) of foreign-funded enterprises, and other relevant documents issued by the competent departments of investment in accordance with the Catalogue shall consist of the letter “S” and a four-digit number. For example, item (1) of the Catalogue of Encouraged Industries for Foreign Investment under the Catalogue of Industries for Guiding Foreign Investment (2017 Revision) shall be filled in as: planting, development and production of woody plants that contain edible oils or are used as seasonings or industrial raw materials (S0001); and item (16) thereof shall be filled in as: development and production of pollution-free green feed and additives (including methionine)(S0016). | | 二、《外商投资产业指导目录（2017年修订）》施行后，投资主管部门按照该目录出具的《国家鼓励发展的内外资项目确认书》、外商投资企业设立（增资）批复或备案回执等相关文件中的“项目产业政策条目”编码由“S”和4位数字组成。例如，《外商投资产业指导目录（2017年修订）》中鼓励外商投资产业目录第1项应填写为：木本食用油料、调料和工业原料的种植及开发、生产（S0001）；第16项应填写为：安全高效环保饲料及添加剂（含蛋氨酸）开发及生产（S0016）。 |
