The intellectual property offices (administrative departments of intellectual property) of all provinces, autonomous regions, municipalities directly under the Central Government, and Xinjiang Production and Construction Corp; and Sichuan Intellectual Property Service Promotion Center: 各省、自治区、直辖市及新疆生产建设兵团知识产权局(知识产权管理部门),四川省知识产权服务促进中心:
For the purposes of further fulfilling the spirit of important speeches and instructions made by General Secretary Xi Jinping, implementing the decisions and arrangements of the CPC Central Committee and the State Council on coordinating the epidemic prevention and control as well as the economic and social development, advancing the adoption of the Ten Measures of the State Administration for Market Regulation, the State Food and Drug Administration and the State Intellectual Property Administration for Supporting the Resumption of Work and Production, and supporting the battle of epidemic prevention and control, the tasks of strengthening efforts to promote the application of intellectual property rights shall be notified as follows: 为深入贯彻习近平总书记重要讲话和指示批示精神,落实党中央、国务院关于统筹抓好疫情防控和经济社会发展的决策部署,推动《市场监管总局 国家药监局 国家知识产权局支持复工复产十条》政策落地,支持打赢疫情防控阻击战,现就更大力度做好知识产权运用促进等相关工作通知如下:
I. Maximizing the role of intellectual property financing, and helping enterprises to address difficulties without delay   一、充分发挥知识产权融资作用,及时纾困助企
1. Coping with the impact of the epidemic, and innovatively promoting the intellectual property investment and financing services: All local authorities shall actively issue the targeted emergency policies and measures, and support financial institutions in rapidly developing financial products such as intellectual property pledge and guarantee insurance that meet the needs of epidemic prevention and control as well as the resumption of work and production. Efforts shall be coordinated to thoroughly scrutinize the demands of producers of supplies for epidemic prevention and control and enterprises of industries severely hit by the epidemic for intellectual property financing services, investigate the enterprises' abilities to repay the loans for the existing pledge projects, actively publicize the relevant policies and services, and help enterprises make better use of policy instruments. Banks shall be encouraged to grant loans or renewals to enterprises, particularly small- and medium-sized enterprises that are heavily affected by the epidemic but have a promising future. The intellectual property operation funds formed under the guidance of the central finance shall speed up investment in the existing reserve projects, shorten the periods of due diligence and investment decision-making, and give priority to producers and R&D enterprises of the supplies for epidemic prevention and control, so as to effectively support them in solving their financial difficulties. (一)应对疫情影响创新推进知识产权投融资服务。各地要积极出台相关应急性针对性政策措施,支持金融机构快速开发符合疫情防控和复工复产需要的知识产权质押、保证保险等金融产品。组织对疫情防控物资生产企业和受疫情冲击较大行业企业的知识产权融资需求进行全面摸排,调查掌握存量质押项目的企业还款能力,做到政策上门和服务上门,用好用足政策工具,积极协调银行予以贷款或续贷,优先支持受疫情影响较大但有发展前景的中小企业。中央财政引导设立的知识产权运营基金要加快已有储备项目的投资进度,缩短尽职调查和投资决策周期,优先投向疫情防控物资生产研发企业,有效纾解企业资金困难。
2. Continuing to handle special issues in a special manner and providing convenient services for intellectual property pledge: A green channel shall be created for the registration of patent and trademark pledges, registration materials shall be encouraged to be submitted via Internet or by mail, and services such as phone appointment and specially assigned personnel shall be provided. Registration services shall be handled rapidly according to the requirements of the relevant enterprises and banks, and electronic registration shall be completed within one working day. For producers of supplies for epidemic prevention and control, instant services, on-site registration and other urgent services shall be launched. Local authorities shall be encouraged to provide “one-stop” services based on online platforms, so as to improve the efficiency in paying subsidized interest, risk compensation, subsidies to evaluation, insurance, and guarantee fees for the pledge of intellectual property rights. Given the long period of handling an intellectual property pledge, local authorities shall be encouraged to adopt the method of “risk compensation before disposal and liquidation” so as to allow enterprises to rapidly benefit from the compensation. A database of intellectual property assets evaluation agencies and evaluation toolkits shall be established in an expeditious manner, and the relevant evaluation agencies and service providers shall be supported in providing evaluation tools and online services at a discount price or free of charge. (二)坚持特事特办切实做好知识产权质押便利化服务。设立专利商标质押登记绿色通道,鼓励采取网上和邮寄方式提交,提供电话预约和专人指导等服务,根据有关企业和银行需求,即收即办、快速办理,力争1个工作日完成电子化登记。针对疫情防控物资生产企业等,推出即刻办理、立等可取等加急措施。鼓励地方依托线上平台实行“一站式”快速办理,提高知识产权质押贷款贴息、风险补偿及评估、保险、担保等有关费用补贴的拨付效率。针对知识产权处置周期长的特点,鼓励地方采取先风险补偿后处置清算等方式,使补偿资金更快惠及企业。快速组建知识产权资产评估机构库及工具库,鼓励有关评估和服务机构提供优惠或免费评估工具和在线服务。
3. Focusing on full-year targets and accelerating intellectual property pledge financing: Solid steps shall be taken to conduct researches on and make plans and arrangements for intellectual property pledge financing, implement the requirements of the directors' meeting of the State Intellectual Property Administration, lay a good start for intellectual property pledge, and pursue an annual growth of over 20% in intellectual property pledge financing. The existing policies shall be promptly adjusted and optimized, and the places where the policy interoperability between patent and trademark pledges is not realized shall spare no time to develop and revise the policies. The efficiency in using the risk compensation for intellectual property pledge supported by the central finance shall be enhanced, the design of pledging mechanism and process shall be improved, and the effect of guiding fiscal funds shall be maximized. The measures supporting innovation and reform determined by the State Council as well as valuable experiences and practices of the relevant local authorities shall be actively replicated and promoted. The pledge modes such as “insurance-backed financing” and “valuation in negotiation” shall be put in place. A pledge financing mode suitable to epidemic prevention and control shall be established; the policy publicity and project coordination via Internet and new media shall be innovated; the integration of intellectual property rights with big data in enterprises, credit loans and markets shall be encouraged; and precise project coordination and precise policy implementation shall be supported (三)紧盯全年目标加快推进知识产权质押融资工作。扎实做好全年知识产权质押融资工作的研究谋划和启动部署,落实全国知识产权局局长会议要求,开好局、起好步,力争知识产权质押融资规模全年增长20%以上。及时调整优化现有政策,未实现专利、商标质押政策互通的地方要抓紧完成政策制修订工作。要提高中央财政支持的知识产权质押风险补偿资金使用效率,完善机制和流程设计,放大资金引导效果。积极复制推广国务院确定的支持创新改革举措和有关地方好经验好做法,推动“保险助融”“协商估值”等质押模式落地。建立与疫情防控相适应的质押融资工作模式,创新互联网、新媒体等政策宣传和项目对接方式,鼓励知识产权与企业、信用、市场的大数据综合运用,实现精准对接、精准施策。
