The Decision of the Standing Committee of the National People's Congress about the Amendments to the Organic Law of the People's Republic of China on the Local People's Congresses and Local People's Governments was adopted at the twelfth session of the Standing Committee of the Tenth National People's Congress of the People's Republic of China on October 27, 2004 and is hereby promulgated. Articles 1, 2 and 4 of this Decision shall be implemented as of the date of the promulgation, and Article 3 shall be implemented at the election of members of the standing committee of the next people's congresses.

Decision of the Standing Committee of the National People's Congress about the Amendments to the Organic Law of the People's Republic of China on the Local People's Congresses and Local People's Governments

It was decided to make the following amendments to the Organic Law of the People's Republic of China on the Local People's Congresses and Local People's Governments at the twelfth session of the Standing Committee of the Tenth National People's Congress:

《全国人民代表大会常务委员会关于修改〈中华人民共和国地方各级人民代表大会和地方各级人民政府组织法〉的决定》已由中华人民共和国第十届全国人民代表大会常务委员会第十二次会议于2004年10月27日通过，现予公布。本决定第一条、第二条、第四条自公布之日起施行，第三条在选举新的一届人民代表大会常务委员会时施行。

全国人民代表大会常务委员会关于修改《中华人民共和国地方各级人民代表大会和地方各级人民政府组织法》的决定

第十届全国人民代表大会常务委员会第十二次会议决定对《中华人民共和国地方各级人民代表大会和地方各级人民政府组织法》作如下修改：

1. Article 6 shall be amended as: “The term of office for each local people's congress shall be 5 years.”
| | 一、第六条修改为：“地方各级人民代表大会每届任期五年。”

2. Paragraph 2 of Article 30 shall be amended as: “The candidates for the director, deputy directors and members of each special committee shall be nominated by the presidium from the deputies and be subject to the approval of the people's congress. During the prorogation of the people's congress, the standing committee may appoint or dismiss few deputy directors and some members of a special committee, the nomination concerned shall be made at the director's meeting and shall be approved at the meeting of the standing committee.
| | 二、第三十条第二款修改为：“各专门委员会的主任委员、副主任委员和委员的人选，由主席团在代表中提名，大会通过。在大会闭会期间，常务委员会可以任免专门委员会的个别副主任委员和部分委员，由主任会议提名，常务委员会会议通过。”

3. Item (2) of Paragraph 4 of Article 41 shall be amended as: “(2) A city divided into districts or an autonomous prefecture shall have 19-41 members. A city divided into districts with a population of more than 8 million shall have 51 members at most.” Item (3) shall be amended as: “A county, autonomous county, city not divided into districts or municipal district shall have 15-27 members. A county, autonomous county, city not divided into districts or municipal district with a population of 1 million shall have 35 members at most.”
| | 三、第四十一条第四款第二项修改为：“（二）设区的市、自治州十九人至四十一人，人口超过八百万的设区的市不超过五十一人”。第三项修改为：“（三）县、自治县、不设区的市、市辖区十五人至二十七人，人口超过一百万的县、自治县、不设区的市、市辖区不超过三十五人”。

4. Article 58 shall be amended as: “The term of office for each local people's government shall be 5 years.”
Articles 1, 2 and 4 of this decision shall be implemented as of the date of promulgation, and Article 3 shall be implemented at the election of members of the standing committee of the next people's congresses.
After the Organic Law of the People's Republic of China on the Local People's Congresses and Local People's Governments has been amended according to this Decision, it shall be re-promulgated. | | 四、第五十八条修改为：“地方各级人民政府每届任期五年。”
本决定第一条、第二条、第四条自公布之日起施行，第三条在选举新的一届人民代表大会常务委员会时施行。
《中华人民共和国地方各级人民代表大会和地方各级人民政府组织法》根据本决定作修改后，重新公布。
