The Working Rules on the Marine Law Enforcement by Public Security Organs, which were adopted at the executive meeting of the Ministry of Public Security on May 30, 2007, are hereby issued and shall be effective as of December 1, 2007.

Chapter I General Provisions
| | 第一章 总则
|
Article 1 In order to strengthen and standardize the work on the Marine law enforcement by public security organs, maintain the national security and the peace and order of sea areas, and protect the safety of common property and body and property of a citizen, these Rules have been made in accordance with the People's Police Law of the People's Republic of China, the Public Security Administrative Punishments Lawof the People's Republic of China, the Criminal Procedural Law of the People's Republic of China, the Law on the Territorial Sea and the Contiguous Zone of the People's Republic of China, the Law on the Exclusive Economic Zone and the Continental Shelf and other relevant laws.
| | 第一条 为加强和规范公安机关海上执法工作，维护国家安全和海域治安秩序，保护公共财产和公民人身财产安全，根据《中华人民共和国人民警察法》、《中华人民共和国治安管理处罚法》、《中华人民共和国刑事诉讼法》、《中华人民共和国领海及毗连区法》和《中华人民共和国专属经济区和大陆架法》等有关法律，制定本规定。

Article 2 The missions of marine law enforcement by a public security organ shall be executed by the general armed police force for public security and frontier defense and coastal guards (the “armed police force and costal guards”), and other departments of the public security organ shall assist, except as otherwise provided for by laws and administrative regulations.
| | 第二条 公安机关海上执法任务，由公安边防海警承担，公安机关其他部门配合，但法律、法规另有规定的除外。

Article 3 The “general armed police force for public security and frontier defense and coastal guards” as mentioned in these Rules shall refer to the coastal general armed police force for public security and frontier defense and its branches of costal guards and divisions of costal guards.
In the handling of marine public security cases and criminal cases, the coastal general armed police force for public security and frontier defense, branches of costal guards and divisions of costal guards shall exercise the corresponding powers of the public security organ of the people's government at the regional (municipal) level, the public security organ of the people's government at the county level and the police station respectively.
| | 第三条 本规定所称公安边防海警，是指沿海公安边防总队及其所属的海警支队、海警大队。
沿海公安边防总队、海警支队和海警大队办理海上治安案件和刑事案件，分别行使地（市）级人民政府公安机关、县级人民政府公安机关和公安派出所相应的职权。

Article 4 The armed police force and coastal guards shall exercise the jurisdictions over violations of laws, regulations and rules on the administration of public security or suspected crimes occurring within the inner waters, territorial seas, contiguous zones, exclusive economic zones and continental shelves of this country, in accordance with the relevant laws and administrative regulations and rules of this country.
| | 第四条 对发生在我国内水、领海、毗连区、专属经济区和大陆架违反公安行政管理法律、法规、规章的违法行为或者涉嫌犯罪的行为，由公安边防海警根据我国相关法律、法规、规章，行使管辖权。

Article 5 In carrying out the marine law enforcement work, the armed police force and coastal guards shall strengthen the cooperation and assistance with the relevant authorities such as those for foreign affairs, navy, customs, fisheries, marine affairs and marine surveillance.
| | 第五条 公安边防海警在开展海上执法工作中，应当加强与外交、海军、海关、渔政、海事、海监等相关部门的协作和配合。

Chapter II Responsibilities and Powers
| | 第二章 职责权限
|
Article 6 The armed police force and coastal guards shall legally perform the following responsibilities:
| | 第六条 公安边防海警依法履行下列职责：
|
1. Preventing, stopping and investigating illegal and criminal marine activities and maintaining the national security and the peace and order of sea areas;
| | （一）预防、制止、侦查海上违法犯罪活动，维护国家安全和海域治安秩序；
|
2. Guarding the safety of major marine targets;
| | （二）负责海上重要目标的安全警卫；
|
3. Participating in the marine salvage and protecting the safety of common property and body and property of a citizen;
| | （三）参与海上抢险救难，保护公共财产和公民人身财产安全；
|
4. Carrying out marine law enforcement cooperation as provided for; and
| | （四）依照规定开展海上执法合作；
|
5. Other responsibilities prescribed by laws and administrative regulations and legally granted by the Ministry of Public Security.
| | （五）法律、行政法规及公安部依法赋予的其他职责。
|
Article 7 In performing the responsibilities set forth in the preceding article, the armed police force and coastal guards may legally exercise the following powers:
| | 第七条 公安边防海警履行前条规定的职责时，可以依法行使下列职权：
|
1. Investigating and handling public security cases occurring at sea in violation of laws, regulations and rules on the administration of public security;
| | （一）对海上发生的违反公安行政管理法律、法规、规章的治安案件进行调查处理；
|
2. Investigating criminal cases occurring at sea and falling within the jurisdiction of the public security organ;
| | （二）对海上发生且属于公安机关管辖的刑事案件进行侦查；
|
3. Taking measures such as boarding, inspection, executing an arrest and detention against violators of laws and regulations on the administration of public security or criminal suspects and vehicles or items related to the illegal or criminal activities;
| | （三）对违反公安行政管理法律、法规或者涉嫌犯罪的人员，以及与违法犯罪行为有关的工具或者物品，采取登临、检查、执行逮捕、扣留等措施；
|
4. Implementing control in a contiguous zone to prevent and punish illegal and criminal activities such as compromising security, smuggling and illegally crossing a national border, occurring within the land territories, inner waters and territorial seas of this country;
