Rules of Procedure of the Standing Committee of the National People's Congress of the People's Republic of China

第一章 总则


Article 1 These Rules are formulated in accordance with the provisions of the Constitution and the Organic Law of the National People's Congress and in the light of the practical experience of the Standing Committee of the National People's Congress.
   第一条 根据宪法全国人民代表大会组织法和全国人民代表大会常务委员会工作的实践经验,制定本规则。
Article 2 In deliberating on bills and proposal and making decisions, the Standing Committee of the National People's Congress shall give full play to democracy and apply the principle of democratic centralism.
   第二条 全国人民代表大会常务委员会审议议案、决定问题,应当充分发扬民主,实行民主集中制的原则。
Chapter II Convene of Meeting
 

第二章 会议的召开


Article 3 The Standing Committee of the National People's Congress shall meet in session once every other month; an interim session may be convened when necessary.
Meeting of the Standing Committee shall be convened and conducted by its Chairman. The Chairman may entrust any of the Vice-Chairmen to conduct a meeting on his behalf.
   第三条 全国人民代表大会常务委员会会议一般每两个月举行一次;有特殊需要的时候,可以临时召集会议。
常务委员会会议由委员长召集并主持。委员长可以委托副委员长主持会议。
Article 4 Meeting of the Standing Committee may not be held unless more than half of the members of the Committee are present.
   第四条 常务委员会会议必须有常务委员会全体组成人员的过半数出席,才能举行。
Article 5 The Council of Chairmen shall draft the agenda for a meeting of the Standing Committee and refer it to a plenary meeting of the Standing Committee for decision.
During a meeting of the Standing Committee, if it needs to change the agenda, the proposal shall be made at the Council of Chairmen and subject to the approval of the plenary meeting of the Standing Committee.
   第五条 委员长会议拟订常务委员会会议议程草案,提请常务委员会全体会议决定。
常务委员会举行会议期间,需要调整议程的,由委员长会议提出,经常务委员会全体会议同意。
Article 6 To hold a meeting, the Standing Committee shall, at least seven days before the meeting, notify its members and non-voting delegates of the date of the meeting and the major matters to be deliberated at the meeting. An interim meeting can be notified within a shorter time.
   第六条 常务委员会举行会议,应当在会议举行七日以前,将开会日期、建议会议讨论的主要事项,通知常务委员会组成人员和列席会议的人员;临时召集的会议,可以临时通知。
Article 7 When the Standing Committee meets, leading members of the State Council, the Central Military Commission, the Supreme People's Court and the Supreme People's Procuratorate shall attend the meeting as nonvoting participants.
The chairmen, vice-chairmen and members of the special committees of the National People's Congress who are not members of the Standing Committee, the deputy secretary general of the Standing Committee, the directors and deputy directors of the working committee and the persons in charge of the relevant departments shall attend the meeting as non-voting delegates.
   第七条 常务委员会举行会议的时候,国务院、中央军事委员会、最高人民法院、最高人民检察院的负责人列席会议。
不是常务委员会组成人员的全国人民代表大会专门委员会主任委员、副主任委员、委员,常务委员会副秘书长、工作委员会主任、副主任,有关部门负责人,列席会议。
Article 8 When the Standing Committee holds a meeting, the director or one of the deputy directors of the standing committee of the people's congress of each province, autonomous region and municipality directly under the Central Government shall attend the meeting as a non-voting delegate, and the relevant NPC deputies can be invited to the meeting as non-voting delegates.
   第八条 常务委员会举行会议的时候,各省、自治区、直辖市的人民代表大会常务委员会主任或者副主任一人列席会议,并可以邀请有关的全国人民代表大会代表列席会议。
Article 9 When the Standing Committee is in session, it shall hold plenary meetings, groups meeting and joint group meetings.
For the panel meetings of the Standing Committee, several conveners shall be determined at the chairmen's council to host the meetings in turn. The list of panel meetings shall be drafted by the working body of the Standing Committee, finalized by the secretary general and adjusted on a regular basis.
A joint meetings of the Standing Committee shall be hosted by the chairman or any vice chairman authorized by the chairman.
   第九条 常务委员会举行会议的时候,召开全体会议,并召开分组会议和联组会议。
常务委员会分组会议由委员长会议确定若干名召集人,轮流主持会议。分组名单由常务委员会办事机构拟订,报秘书长审定,并定期调整。
常务委员会举行联组会议,由委员长主持。委员长可以委托副委员长主持会议。
Article 10 When the Standing Committee meets, its members shall attend the meeting, except for those who ask to be excused on account of poor health or for other reasons.

   第十条 常务委员会举行会议的时候,常务委员会组成人员除因病或者其他特殊原因请假的以外,应当出席会议。
