Circular of the Ministry of Human Resources and Social Security on Relevant Issues about Regulating the Enterprise Annuity Fund Management Services
(No.35 [2009] of the Ministry of Human Resources and Social Security)
Departments (bureaus) of human resources and social security, or departments (bureaus) of labor and social security in all provinces, autonomous regions and municipalities directly under the Central Government, Bureau of Labor and Social Security of Xinjiang Production and Construction Corps, and all enterprise annuity fund management institutions:
Along with the progress in the market management and operation of enterprise annuities, the work of enterprise annuities has made new developments. However, few problems arose in our work, for example, failure of some enterprise annuity fund management institutions to provide sufficient services, random collection of management fees, and illegal practices of some enterprises in the process of establishing their enterprise annuities. In order to standardize management practices, achieve orderly competition, enhance service quality and promote a healthy development of the enterprise annuity market, we herby notify relevant issues as follows:

各省、自治区、直辖市人力资源社会保障厅(局)、劳动保障厅(局),新疆生产建设兵团劳动保障局,各企业年金基金管理机构:
随着企业年金市场化管理运营的推进,企业年金工作有了新的发展。但也出现了一些企业年金基金管理机构服务不到位、管理费收取混乱,部分企业建立企业年金过程中存在不规范行为等问题。为规范管理行为,实现有序竞争,提高服务质量,促进企业年金市场健康发展,现就有关问题通知如下。
I. Each enterprise annuity fund management institution shall provide fundamental services and ensure its service quality according to the duties prescribed in the Trial Measures for Management of Enterprise Annuity Funds. Based thereon, each enterprise annuity fund management institution shall actively explore new service items and provide more services for enterprises and employees according to enterprise demands and business requirements. The cycle, frequency, quantity and price, etc. of each service item shall be determined according to relevant laws, regulations and rules; or according to pertinent industrial practices where there is no such law, regulation or rule, or be specified in the enterprise annuity fund management contracts through negotiations among the parties concerned.
   一、各企业年金基金管理机构应按《企业年金基金管理试行办法》规定的职责提供基本服务,确保服务质量。在此基础上,可根据企业需求和业务需要,积极探索新的服务项目,为企业和职工提供更多的服务。各类服务项目的周期、频次、数量、价格等,按有关法律、法规或规章规定执行;有关法律、法规或规章无规定的,按相关行业通行的规则办理,或有关各方通过协商在企业年金基金管理合同中予以明确。
II. Each enterprise annuity fund management institution shall abide by the Law of the People's Republic of China on Anti-unfair Competition, the Anti-Monopoly Law of the People's Republic of China, the Price Law of the People's Republic of China and other relevant laws, regulations and rules, act on the principle of free will, equality and good faith, diligently carry out the work, rationally determine service prices, and get fair remunerations. For any of the following acts made by any enterprise annuity fund management institution, you should, in light of circumstances, adopt the measure of supervisory talk, issuance of written opinions on rectification, circulation of a notice of criticism within the industry, disclosure to the general public, suspension of its new enterprise annuity fund management business or even cancellation of its enterprise annuity fund management qualification, etc.:

   二、各企业年金基金管理机构要遵守《中华人民共和国反不正当竞争法》、《中华人民共和国反垄断法》、《中华人民共和国价格法》等有关法律、法规和规章,遵循自愿、平等、诚信的原则,勤勉尽责地开展工作,合理确定服务价格,获取应得报酬。对企业年金基金管理机构的下列行为,将视情况采取监管谈话或出具书面整改意见书、业内通报或向社会披露、暂停接收新的企业年金基金管理业务直至取消企业年金基金管理资格等措施:
