Provisions on the Exposure of Price-related Violations

Article 1 These Provisions are formulated in accordance with the “Price Law of the People's Republic of China”, the “Provisions on the Administrative Penalties Imposed upon Price-related Violations” and other laws and administrative regulations so as to ensure that citizens, legal persons and other organizations can legally exercise their rights of exposing price-related violations, regulate the price administrative departments to deal with the exposure of price-related violations.
| | 第一条 为保障公民、法人或者其他组织依法行使举报价格违法行为的权利，规范价格主管部门对价格违法行为举报的处理，根据《中华人民共和国价格法》、《价格违法行为行政处罚规定》等法律、行政法规，制定本规定。

Article 2 Where a citizen, legal person or other organization (hereinafter referred to as exposer) considers that a business operator has any of the following acts, he/it may, by letter, visit or telephone, etc., expose the act to the price administrative department, and the price administrative department shall accept the exposure in accordance with these Provisions:
| | 第二条 公民、法人或者其他组织（以下简称举报人）认为经营者有下列行为之一的，可以采用书信、来访、电话等形式，向价格主管部门举报，价格主管部门应当按照本规定予以受理：
|
(1) Colluding with each other to control market prices, which has caused great detriment to the lawful rights and interests of other business operators or consumers;
| | （一）相互串通，操纵市场价格，损害其他经营者或者消费者合法权益的行为；
|
(2) Engaging in dumping sales (except the cases of legally selling perishable and live merchandises, seasonal merchandises, stockpiled merchandises or other similar merchandises at discount) at below-cost prices in order to attain an upper hand over rivals or dominate the market and disrupt the normal production and operation order, which has caused great detriment to the interests of the State or the lawful rights and interests of other business operators;
| | （二）在依法降价处理鲜活商品、季节性商品、积压商品等商品外，为了排挤竞争对手或者独占市场，以低于成本的价格倾销，扰乱正常的生产经营秩序，损害国家利益或者其他经营者的合法权益的行为；
|
(3) Applying discriminatory prices to merchandises or services of a same kind offered by certain business operators under same trading conditions;
| | （三）提供相同商品或者服务，对具有同等交易条件的其他经营者实行价格歧视的行为；
|
(4) Fabricating and spreading price rise information for pushing up the prices to an excessively high level;
| | （四）捏造、散布涨价信息，哄抬价格，推动商品价格过高上涨的行为；
|
(5) Resorting to deceitful or misleading means in terms of prices to entice consumers or other business operators into trading;
| | （五）利用虚假的或者使人误解的价格手段，诱骗消费者或者其他经营者与其进行交易的行为；
|
(6) Disguisedly raising or lowering prices at irrational ranges by artificially raising or lowering the grades of merchandises or services;
| | （六）采取抬高等级或者压低等级等手段收购、销售商品或者提供服务，变相提高或者压低价格的行为；
|
(7) Seeking exorbitant profits in violation of laws and regulations;
| | （七）违反法律、法规的规定牟取暴利的行为；
|
(8) Refusing to follow government-guided prices or government-set prices;
| | （八）不执行政府指导价、政府定价的行为；
|
(9) Refusing to take legal price intervention measures and emergency measures;
| | （九）不执行法定的价格干预措施、紧急措施的行为；
|
(10) Violating the provisions on clearly tapping the related prices;
| | （十）违反明码标价规定的行为；
|
(11) Providing false materials when accepting price supervision or inspection;
| | （十一）在接受价格监督检查时提供虚假资料的行为；
|
(12) Other price-related violations which ought to be accepted by the price administrative department.
| | （十二）应当由价格主管部门受理的其他价格违法行为。
|
Article 3 In case any of the following circumstances arises, the price administrative department shall not accept the exposure, and shall make a reply by taking the circumstance into consideration:
| | 第三条 有下列情形之一的，价格主管部门不予受理，并酌情予以回复：
|
(1) The exposed contents do not fall within the scope of duties of the price administrative department;
| | （一）举报内容不属于价格主管部门职责管辖范围的；
|
(2) There is no specific exposee, or the exposee is unable to be found;
| | （二）没有明确的被举报人或者被举报人无法查找的；
|
(3) The party concerned has exposed the same matter to another relevant organ, or has applied for re-check, administrative reconsideration or arbitration or brought a lawsuit regarding this matter, while the relevant organ has not made a decision or ruling on refusing or accepting it; or another price administrative department has made a decision on punishing the same price-related violation;
| | （三）就同一事项已经向有关机关举报、申请复查、行政复议、仲裁或者提起诉讼，有关机关没有做出不予受理决定或者不予受理裁定的；价格主管部门对同一价格违法行为已经做出处理决定的；
|
(4) Other circumstances falling out of the scope for accepting exposures of price-related violations.
| | （四）不属于价格违法行为举报受理范围的其他情形。
|
Article 4 An exposer shall, if exposing a price-related violation, provide the following contents:
| | 第四条 举报人举报价格违法行为，应当提供以下内容：
|
(1) name and address of the exposee;
| | （一）被举报人的名称、地址；
|
(2) the facts and relevant evidence on the exposee's violation of any price law, regulation, rule or regulatory document;
| | （二）被举报人违反价格法律、法规、规章或者规范性文件的事实及有关证据；
|
(3) the exposer's means of contact if he requests a reply.
| | （三）举报人要求答复的，应当提供联系方式。
|
Article 5 The price administrative department at the county level or above shall be the competent organ in charge of exposures of price-related violations. The specific affairs shall be handled by its price supervision and inspection institution (price exposure center) in accordance with these Provisions.
