最高人民法院关于裁定不予承认和执行社团法人日本商事仲裁协会东京05-03号仲裁裁决的报告的答复

天津市高级人民法院：

　　你院[2006]津高民四他字第0006号《裁定不予承认和执行社团法人日本商事仲裁协会东京05-03号仲裁裁决的报告》收悉。经研究，答复如下：

　　本案系日本信越化学工业株式会社（以下简称信越会社）向我国法院申请承认日本商事仲裁协会作出的仲裁裁决，中日两国均为《承认及执行外国仲裁裁决公约》（以下简称《纽约公约》）的缔约国，因此，应当依据《纽约公约》的有关规定进行审查。

　　从你院请示报告中反映的情况看，本案仲裁裁决在有关通知程序方面与《日本商事仲裁协会商事仲裁规则》（以下简称《仲裁规则》）的规定不符，存在《纽约公约》第五条第一款（乙）、（丁）项规定的情形。

　　首先，根据上述《仲裁规则》·第53条的规定：“1．仲裁庭认为仲裁程序已进行得完全充分，可以进行裁决并决定终结审理程序时，仲裁庭应在作出该决定之日起5周内作出仲裁裁决；如果因为案情复杂或其他原因，仲裁庭认为有必要时，可以适当延长该期限，但不得超过8周。2．仲裁庭根据前段规定决定审理终结后，应当通知当事人作出仲裁裁决的期限。”
