Interim Measures of Beijing Municipality for Encouraging the Establishment of Chinese-foreign Joint Human resources Intermediary Service Agencies

Article 1 In order to adapt to China's entry into the WTO, create an open, just and fair market competition environment, encourage foreign investors to establish Chinese-foreign joint human resources intermediary service agencies in Beijing and to improve the openness and service level of the human resources market of the Capital, the present Measures have been formulated in accordance with the relevant provisions of the Provisions on the Administration of Human resources Market (Order No.1) of the Ministry of Personnel and the State Administration For Industry and Commerce of the PRC, the Measures for the Administration of Brokers of the State Administration for Industry and Commerce (Order No.36) and the Regulations of Beijing Municipality on the Administration of Human resources Market.
| | 第一条 为了适应加入世界贸易组织，创造公开、公正、公平的市场竞争环境，鼓励外国投资者在京设立中外合营人才中介服务机构，提高首都人才市场的开放程度和服务水平，根据中华人民共和国人事部、国家工商行政管理总局《人才市场管理规定》（第1号令）、国家工商行政管理总局《经纪人管理办法》（第36号令）、《北京市人才市场管理条例》的有关规定，制定本办法。

Article 2 Any foreign company, enterprise or other organization that invests to establish agencies engaged in human resources intermediary services or relevant businesses may establish human resources intermediary service agencies in the forms of Chinese-foreign equity joint or cooperative joint venture with the human resources intermediary service agencies within the administration area of this Municipality. No solely foreign-funded human resources intermediary service agency shall be established for the present time.
| | 第二条 凡外国公司、企业和其他经济组织投资设立从事人才中介服务或相关业务的，可与本市行政区域内的人才中介服务机构以合资、合作形式设立人才中介服务机构。暂不设立外商独资人才中介服务机构。

Article 3 The Chinese-foreign joint human resources intermediary service agencies as used in these Measures shall refer to the joint organizations that exclusively or concurrently provide intermediary services and other relevant services to the requesting units and the talented persons within the administrative area of this Municipality.
| | 第三条 本办法所称中外合营人才中介服务机构是指在本市行政区域内为用人单位和人才提供中介服务以及其他相关服务的专营或兼营的合营组织。

Article 4 The Chinese-foreign joint human resources intermediary service agencies shall enjoy the same rights and assume the same obligations as those of the domestic human resources intermediary service agencies in other forms, and their legal human resources intermediary service activities shall be under the protection of the relevant laws and regulations of the State and this Municipality.
| | 第四条 中外合营人才中介服务机构与国内其他形式的人才中介服务机构享有同等的权利、义务，其依法开展的人才中介服务活动受国家和本市有关法律、法规的保护。

Article 5 The Personnel Bureau, the Administration for Industry and Commerce, and the Foreign Economic Relations and Trade Commission of Beijing Municipality shall be responsible for the examination and approval, registration and supervision of Chinese-foreign joint human resources intermediary service agencies within the scope of their respective powers.
