PROVISIONS OF THE BEIJING MUNICIPALITY ON THE INSPECTION AND CONTROL IN IMPORT OF COMPLETE SETS OF EQUIPMENT

北京市进口成套设备检验管理办法

Article 1.With a view to protect the interests of the State by strengthening the inspection in import of complete sets of equipment to en sure the quality of such equipment, the following provisions are formulated in compliance with the "Law of the People's Republic of China on the Inspection of Import and Export Commodities" (hereinafter referred to as "commodity inspection law") and the"Detailed Rules for the Implementation of the Law of the People's Republic of China on the Inspection of Import and Export Commodities" (hereinafter referred to as "implementation rules").
| | 第一条 为了加强本市进口成套设备的检验工作，保证进口成套设备质量，维护国家权益，根据《中华人民共和国进出口商品检验法》（以下简称《商检法》）和《中华人民共和国进出口商品检验法实施条例》（以下简称《实施条例》）的有关规定，结合本市具体情况，制定本办法。

Article 2. The provisions apply to the inspection and control of the import of complete sets of equipment within the jurisdiction of the Beijing administrative areas.
For the inspection and control of complete sets of equipment imported by foreign-funded enterprises, Article 29 of the"Detailed Rules for the Implementation of the Law of the People's Republic of China Concerning Enterprises Using Foreign Investment" shall apply.
| | 第二条 本市行政区域内进口成套设备的检验管理，适用本办法。
外资企业进口成套设备的检验管理，适用《中华人民共和国外资企业法实施细则》第二十九条规定。

Article 3.The Beijing Bureau for the Inspection of Import and Export Commodities of the People's Republic of China(hereinafter referred to as "Beijing Commodity Inspection Bureau") is the organization in charge of the inspection and control of the import of complete sets of equipment.
Whenever a need arises, the Beijing Commodity Inspection Bureau shall entrust a qualified commodity inspection organization to undertake the designed inspection work.
| | 第三条 中华人民共和国北京进出口商品检验局（以下简称北京商检局）是本市进口成套设备检验管理工作的主管机关。
北京商检局可以根据需要委托符合条件的检验机构承担指定的检验工作。

Article 4.Complete sets of equipment mentioned in the provisions are referred to complete sets of production lines and the accompanying devices.
| | 第四条 本办法所称成套设备包括成套的生产装置和使用装置。

Article 5.Complete sets of equipment imported are the commodities subject to the inspection by commodity inspection organization as provided for in the commodity inspection law and the implementation rules. The domain of inspection covers the supervision over the manufacturing processes, the preliminary and packing inspections of the equipment in the exporting countries as well as the inspections over equipment when their arrival,installation and debugging and assessment and acceptance to the equipment starting from the date when the foreign trade contracts come into effect to the end of quality warranty period.
