Opinions of the General Office of the State Council on Some Issues about Implementing the Regulation of the People's Republic of China on the Disclosure of Government Information
(No.36 [2008] of the General Office of the State Council)
The people's governments of all provinces, autonomous regions and municipalities directly under the Central Government; all the ministries and commissions of the State Council and all the institutions directly under the State Council:
For the purpose of implementing the Regulation of the People's Republic of China on the Disclosure of Government Information (hereinafter referred to as the Regulation), actively and stably promoting the work of government information disclosure, and safeguarding the legal access to government information by citizens, legal persons and other organizations, upon approval of the State Council, the opinions on some issues concerning the implementation of the Regulation are hereby put forward as follows:

各省、自治区、直辖市人民政府，国务院各部委、各直属机构：
为有利于贯彻施行《中华人民共和国政府信息公开条例》（以下简称条例），积极稳妥地推进政府信息公开工作，保障公民、法人和其他组织依法获取政府信息，经国务院同意，现就条例施行中的若干问题提出以下意见：

I. Issue concerning the administrative system for government information disclosure
| | 一、关于政府信息公开管理体制问题
|
1. All the departments (institutions) under the people's government at or above the county level shall conduct the work of government information disclosure under the uniform guidance, coordination and supervision of the department in charge of the work of government information disclosure under the people's government at the same level.
| | （一）县级以上人民政府各部门（单位）要在本级人民政府信息公开工作主管部门的统一指导、协调、监督下开展政府信息公开工作。

2. A department (institution) subject to vertical leadership shall conduct the work of government information disclosure under the leadership of the competent administrative department (institution) at its higher level and under the uniform guidance and coordination of the local people's government. A department (institution) subject to dual leadership shall conduct the work of government information disclosure under the leadership of the local people's government and simultaneously accept the guidance of the competent administrative department (institution) at its higher level.
| | （二）实行垂直领导的部门（单位）要在其上级业务主管部门（单位）的领导下，在所在地地方人民政府统一指导、协调下开展政府信息公开工作。实行双重领导的部门（单位）要在所在地地方人民政府的领导下开展政府信息公开工作，同时接受上级业务主管部门（单位）的指导。

II. Issue concerning the establishment of a coordination mechanism for release of government information
| | 二、关于建立政府信息发布协调机制问题
|
3. The department in charge of the work of government information disclosure under the people's government at any level shall organize and coordinate the relevant administrative departments to establish and improve a coordination mechanism for release of government information and form a smooth and efficient information release and communication channel. If the government information to be released by an administrative department involves any other administrative departments, the administrative department that plans to release the government information shall communicate and coordinate with the other administrative departments and shall not release the government information until having gotten confirmation from the other administrative departments; if no unanimity can be reached after communication and coordination, the administrative department that plans to release the government information shall report the situation to the department in charge of the work of government information disclosure under the government at the same level for coordination and solution.
| | （三）各级人民政府信息公开工作主管部门要组织、协调有关行政机关建立健全政府信息发布协调机制，形成畅通高效的信息发布沟通渠道。行政机关拟发布的政府信息涉及其他行政机关的，要与有关行政机关沟通协调，经对方确认后方可发布；沟通协调后不能达成一致意见的，由拟发布该政府信息的行政机关报请本级政府信息公开工作主管部门协调解决。

4. According to the laws, administrative regulations and the relevant provisions of the state, the release of such government information as the quality and safety situations of agricultural products, major epidemic diseases, major animal epidemic diseases, important geo information data and statistical information shall be conducted strictly according to the prescribed limit of power and procedures.
| | （四）根据法律、行政法规和国家有关规定，发布农产品质量安全状况、重大传染病疫情、重大动物疫情、重要地理信息数据、统计信息等政府信息，要严格按照规定权限和程序执行。

III. Issue concerning the confidentiality review for the disclosure of government information
| | 三、关于发布政府信息的保密审查问题
|
5. When an administrative department is creating government information, it shall make sure whether or not the said government information shall be disclosed; or shall give a report to the relevant competent administrative department (institution) or the confidentiality department at the same level for determination if it can not make sure whether or not the said government information can be disclosed.
| | （五）行政机关在制作政府信息时，要明确该政府信息是否应当公开；对于不能确定是否可以公开的，要报有关业务主管部门（单位）或者同级保密工作部门确定。

6. An administrative department shall conduct the confidentiality review of the government information to be disclosed strictly according tothe Law of the People's Republic of China on Keeping State Secrets, the measures for implementation thereof and other relevant provisions. The government information shall not be disclosed if the disclosure thereof is likely to endanger national security, public security, economic security or social stability.
．．．．．． | | （六）行政机关要严格依照《中华人民共和国保守国家秘密法》及其实施办法等相关规定，对拟公开的政府信息进行保密审查。凡属国家秘密或者公开后可能危及国家安全、公共安全、经济安全和社会稳定的政府信息，不得公开。
