Regulation to Encourage Foreign Investment in Advanced Technology Industries in Beijing
(The Commission of Foreign Trade and Economic Co-operation (“COFTEC”) under the Municipal Government of Beijing, May 29, 1997)

Article 1.This Regulation is formulated for the purpose of encouraging foreign investment in advanced technology industries, in order to fully utilize the potential resources of the capitol city as well as to promote the economic development of the city of Beijing.
| | 第一条 为了鼓励外商投资高新技术领域，发挥首都资源优势，扶持高新技术产业，促进符合首都特点的经济发展，制定本规定。

Article 2.This Regulation applies to advanced technology enterprises taking the form of equity joint ventures, contractual joint ventures, or wholly foreign-owned enterprises established by foreign enterprises, economic organisations or individuals (hereinafter referred to as “foreign investors”). It also serves as a reference for advanced technology enterprises established by organisations or individuals from Hong Kong, Macao or Taiwan.
| | 第二条 本规定适用于外国的企业、经济组织或者个人（以下统称外商）在北京开办的中外合资、合作或者独资高新技术企业。香港、澳门、台湾地区的公司企业和其他经济组织或者个人投资开办高新技术企业，参照本规定执行。

Article 3.The status of advanced technology enterprises (hereinafter referred to as “Enterprises”) shall be recognised and reviewed every year by the Science and Technology Commission under the municipal Government of Beijing. Such recognised advanced technology enterprises shall be granted Certificates of Advanced Technology Enterprises by the Science Commission.
| | 第三条 外商投资的高新技术企业（以下简称企业）应当经市科委认定，并每年复审一次。被认定的高新技术企业，由市科委颁发高新技术企业证书。

Article 4.Enterprises shall have special treatment with respect to approval and registration procedures, requests for bank loans, customs procedures, sending personnel abroad, establishing overseas branches and obtaining public utilities services, etc. The procedures regulating the approval of the projects, their plans and feasibility study reports, and the issuance of business licenses and registration shall be accelerated without delay. The banks shall give priority consideration to the granting of loans to Enterprises both in RMB and foreign exchanges. Customs shall streamline its clearance procedure and give special treatment to Enterprises with good credit. The departments concerned shall simplify the procedure for the approval of Chinese personnel of Enterprises to go abroad on business trips and to allow multiple exits within a one- to two-year period. If Enterprises intend to establish domestic or overseas branches to further their development, the municipal COFTEC shall grant priority to their approval process. The municipal Economic Commission, the municipal Bureau of Electricity, the municipal Bureau of Public Utilities and the municipal Bureau of Telecommunications shall give priority consideration to the supply of such public utilities to Enterprises in accordance with their need as established in the approved feasibility study. The supply price shall be the same as that for domestic enterprises of the same type.
| | 第四条 企业在审批、登记、银行贷款、海关手续、人员出境、设置海外企业、所需公用设施等方面享有优先权。有关部门在立项、规划、可行性研究、领照、登记、开工建设等环节的审批过程中，要急事急办，特事特办，不得延误。银行要优先给予企业人民币及外汇贷款支持；海关要简化手续，缩短办理时间，对资信良好的企业给予通关优惠待遇；有关部门要简化企业中方人员因公出境手续，核定适当人数，办理一至两年内多次往返批件；企业根据境内外发展需要，申请设立国内分支机构或者海外企业，符合国家规定条件的，市外经贸委要优先办理审批申报手续；企业所需的水、电、气、热、通讯等公共设施，由市经委、市供电局、市公用局、市电信局等有关部门根据已批准的可行性研究报告给予统筹安排，核定指标，优先供应，其供应的价格和收费享受国内同类企业的同等待遇。

Article 5.In the case that a land use right obtained by an equity joint venture, contractual joint venture or wholly foreign-owned enterprise is in the form of a cession, only 75% of the cession fee shall be charged. Only half of the mandatory contributions to the “Four Sources” of city infrastructure construction and municipal facilities construction shall be charged.
| | 第五条 土地由合资、合作或者独资企业直接以出让方式取得的，其出让金按７５％征收；需要缴纳的城市基础设施“四源”建设费和市政费，减半征收。

Article 6.For production Enterprises whose projected term of operation is 10 years or more, the first and second year they begin to generate profits, the enterprise income tax shall be exempted. From the third to the fifth year, the enterprise income tax shall be 50% of the normal standard. Upon their application and the subsequent approval by the Department of Finance, this 50% may also be rebated. If the Enterprises are still recognised as advanced technology enterprises after the period of exemption and reduction, they shall enjoy another three years of enterprise income tax reduction of 50%. If the reduced tax rate is lower than 10%, it shall be calculated as 10%. In addition, the local income tax for foreign-invested high and new technology enterprises is exempted.
| | 第六条 经营期在１０年以上的生产性企业，从开始获利的年度起，第一年和第二年免征企业所得税；第三年至第五年减半征收企业所得税，减半征收的企业所得税，企业可以提出申请，经同级财政部门核准，予以全部返还。免减期满后，仍为先进技术的，延长三年减半征收企业所得税，减半的税率不足１０％的，按１０％的税率征收。对外商投资的高新技术企业，免征地方所得税。

Article 7.The “one-stop” “over-the-counter” procedure concerning the bank guarantee for processing trade shall be improved. If necessary, upon the approval of Customs, Enterprises may establish bonded warehouses or factories.
| | 第七条 继续完善加工贸易银行保证金台帐一站式办公程序。企业根据实际需要，经海关批准，可以设立保税仓库、保税工厂。

Article 8.In accordance with the policies for specific industries, and upon approval of the municipal Planning Commission, Economic Commission and the COFTEC, the percentage of domestic sale of the products of Enterprises may be increased, and the products may be allowed to be sold exclusively in the domestic market if they are in great demand in the domestic market or are import-substitute products.
| | 第八条 按照国家产业政策，经市计委、市经委、市外经贸委认定，可以适度放宽企业产品内销比例；产品确属国内急需并能替代进口的，允许全部内销。

Article 9.For enterprises registered at the Beijing Economic and Technology Development Zone and the Beijing New Technology Industry Development and Experiment Zone, branches engaging in the sale of self-manufactured products within the administrative area of Beijing may enjoy the same preferential treatment as the Enterprises.
| | 第九条 在北京市经济技术开发区和北京市新技术产业开发试验区注册经营的企业，其分支机构仍在北京行政区域范围内从事销售区内自产产品的，可以享受区内企业的优惠政策。

Article 10.The preferential policies already in force for advanced technology enterprises in Beijing shall be maintained. In case of discrepancies with this Regulation, this Regulation shall apply.
| | 第十条 本市对高新技术产业原有优惠政策，仍按照原规定执行，原规定与本规定不一致的，以本规定为准。

Article 11.This Regulation shall be interpreted by the COFTEC of Beijing.
| | 第十一条 本规定由市外经贸委负责解释。

Article 12.This Regulation is effective the date of its promulgation.
| | 第十二条 本规定自公布之日起施行。
