第一章 总则


Article 1. For the purpose of strengthening the protection of the famous historical and cultural city of Beijing and based on the present situation of Beijing, these measures are formulated according to relevant law and regulations on the national urban and rural planning as well as the protection of historical relics.
   第一条 为了加强对北京历史文化名城的保护,根据国家城乡规划、文物保护等有关法律、法规,结合本市实际情况,制定本条例。
Article 2. The protection of the historical and cultural landmark of Beijing shall be governed by these Measures. If relevant laws and regulations have been issued for the protection of historical and cultural relics, ancient and outstanding trees, those laws and regulations shall be followed.
   第二条 北京历史文化名城的保护,适用本条例。其中文物、古树名木的保护,法律、法规已有规定的,依照有关法律、法规的规定执行。
Article 3. The protection of Beijing as a famous historical and cultural landmark should follow the principles of overall planning, uniform management, emphasis in protection, and reasonable utilization.
   第三条 北京历史文化名城保护工作,应当坚持统筹规划、统一管理、保护为主、合理利用的原则。
Article 4. The municipal People's Government shall take overall charge of the protection of Beijing as a famous historical and cultural landmark.
The people's government at relevant district and county levels shall take charge of the specific measures for the protection of Beijing as a famous historical and cultural landmark.
The municipal planning and administration departments are responsible for the planning and management of the protection of the famous historical and cultural city of Beijing.
The municipal administration for cultural relics shall perform the duties as stipulated in these Measures; it shall take charge of the protection of architectures worthy of protection, participate in such duties as the formulation of plans for the protection of Beijing as a famous historical and cultural landmark, the formulation of protection measures, and the identification of streets and districts of historical and cultural value.
The administrations in charge of the areas of development and reform, finance, construction, national land resources, water resources, the municipal management, parks and forest, tourism, religious affairs, and historical relics protection at the district and county levels shall perform their respective duties in the protection of Beijing as a famous historical and cultural city.
   第四条 市人民政府统一领导北京历史文化名城的保护工作。
区、县人民政府负责本辖区内有关北京历史文化名城保护的具体工作。
市规划行政主管部门负责北京历史文化名城保护的规划管理工作。
市文物行政主管部门应当按照本条例规定的职责,负责具有保护价值的建筑的保护工作,参与北京历史文化名城保护规划的编制、保护措施的制定、历史文化街区的认定等工作。
发展改革、财政、建设、国土资源、水务、市政管理、园林、旅游、宗教事务和区县文物等行政主管部门,应当按照各自职责,负责北京历史文化名城保护的相关工作。
Article 5. Beijing should coordinate the economic and social development and the protection of the city as a famous historical and cultural landmark, and incorporate such protection into the city's economic and social development plan and annual plan.
   第五条 本市应当统筹协调国民经济和社会发展与北京历史文化名城保护工作,将北京历史文化名城保护纳入国民经济和社会发展规划和年度计划。
Article 6. The people's governments at the municipal, district, and county levels should arrange funds for the protection of Beijing as a famous historical and cultural landmark in their respective fiscal budget, and incorporate such fund into the execution of the government's investment management.
   第六条 市和区、县人民政府应当在本级财政预算中安排北京历史文化名城保护资金,并将其纳入政府投资管理程序执行。
Article 7. The city encourages individuals and employers to participate in the protection of Beijing as a famous historical and cultural landmark by contributions, donations, providing technical services, or making suggestions to the government.
The city supports scientific researches, technical innovation, and the training of professionals related to the protection of Beijing as a famous historical and cultural landmark.
   第七条 本市鼓励单位和个人以捐赠、资助、提供技术服务或者提出建议等方式参与北京历史文化名城的保护工作。
本市支持与北京历史文化名城保护相关的科学研究、技术创新和专业人才的培养。
Article 8. All employers and individuals have the duty to protect Beijing as a famous historical and cultural landmark, as well as the right to provide suggestions to the formulation and execution of plans to protect the city, and to dissuade people from destroying the famous historical and cultural landmark of Beijing, and once such destruction has occurred, tip it off and bring charges against it.
   第八条 任何单位和个人都有保护北京历史文化名城的义务,并有权对保护规划的制定和实施提出建议,对破坏北京历史文化名城的行为进行劝阻、检举和控告。
Article 9. The people's governments at the municipal, district, and county levels should commend and reward the employers and individuals who have made outstanding achievements in the protection of Beijing as a famous historical and cultural landmark.
   第九条 对保护北京历史文化名城做出突出贡献的单位和个人,市和区、县人民政府或者有关行政主管部门应当予以表彰和奖励。

第二章 保护内容


Article 10. The protection of Beijing as a famous historical and cultural landmark includes the following: the overall protection of the old city area, the protection of historical and cultural streets and districts, the protection of cultural relics on the protection list, the protection of valuable architectures worthy of such protection.
   第十条 北京历史文化名城的保护内容包括:旧城的整体保护、历史文化街区的保护、文物保护单位的保护、具有保护价值的建筑的保护。
Article 11. The "old city area" refers to the area enclosed by the city moat built in the Ming and Qing dynasties (including the city moat and its ruins).
The protection of the old city includes: historical rivers, lakes, and water systems, the historical central axle of the city, the imperial city, the protruding city walls of the old city, the traditional structure of streets, lanes or hutongs, the height of the buildings, the skyline of the city, the structure of the streets, the colors of the buildings, and ancient trees and trees of precious species.
The protection of the old city should follow the principle of overall protection, and different forms of protection should be used for different areas.
   第十一条 旧城,是指明清时期北京城护城河及其遗址以内(含护城河及其遗址)的区域。
旧城的保护内容包括:历史河湖水系、传统中轴线、皇城、旧城“凸”字形城廓、传统街巷胡同格局、建筑高度、城市景观线、街道对景、建筑色彩、古树名木等。
旧城保护应当坚持整体保护的原则,针对不同区域采取不同的方式进行保护。
Article 12. The imperial city should be preserved wholly and truthfully with the Forbidden City as its centre, the imperial palaces, offices, temple groups, the imperial gardens as its main body, and the traditional courtyards as its enclosure, with all its historical charm, its original planning and structure, and its architectural style unchanged.
   第十二条 皇城保护应当完整、真实地保持以紫禁城为核心,以皇家宫殿、衙署、坛庙建筑群、皇家园林为主体,以四合院为衬托的历史风貌、规划布局和建筑风格。
Article 13. The streets, architecture groups, villages and towns that featuring the tradition and style of a specific historical period or of ethnic flavor should be identified as streets and districts of historical and cultural value.
The area of streets and districts of historical and cultural value should include a core protection area and a construction control area. The determination of the construction control area should be done according to the requirements of style preservation and visual impression of the core protection area.
   第十三条 对具有特定历史时期传统风貌或者民族地方特色的街区、建筑群、村镇等,应当认定为历史文化街区。
历史文化街区的范围应当包括核心保护区和建设控制区。建设控制区的划定应当符合核心保护区的风貌保护和视觉景观的要求。
Article 14. Courtyards and other architecture that have not been identified as unmovable cultural relics, that carry certain features of a time, that are of protection values, and that are carriers of true and comparatively complete historical information should be identified as architecture with protection value. The specific standard and process of identification should be formulated and published by the People's Government of the city.

   第十四条 对尚未列为不可移动文物、反映一定时代特征、具有保护价值、承载真实和相对完整历史信息的四合院和其他建筑,应当认定为具有保护价值的建筑。具体认定标准和程序,由市人民政府制定并公布。
