Order of the State Administration of Work Safety and the State Administration of Coal Mine Safety
(No. 15)
The Interim Measures for the Administration of Fines in respect of Supervision of Work Safety, which were deliberated and adopted by the State Administration of Work Safety (the State Administration of Coal Mine Safety) at the executive meeting of this Administration on October 18, 2004, are hereby promulgated, and shall come into force on the date of promulgation.

Article 1 These Measures are formulated in accordance with the Work Safety Law, the Implementation Measures for Separating Decisions on Fines from Collection of Fines, the Notice of the Ministry of Finance on Doing a Good Job in Administration of Revenues from Relevant Fines in respect of Supervision of Work Safety, and other relevant laws, regulations and provisions so as to strengthen the administration of fines in respect of supervision of work safety, and to carry out comprehensive work safety administration in accordance with law.
| | 第一条 为加强安全生产监督罚款管理工作，依法实施安全生产综合监督管理，根据《安全生产法》、《罚款决定与罚款收缴分离实施办法》和《财政部关于做好安全生产监督有关罚款收入管理工作的通知》等法律、法规和有关规定，制定本办法。

Article 2 The administrative department of work safety of the people's government at the county level or above (hereinafter referred to as the administrative department of work safety) shall comply with these Measures when lawfully imposing fines on the illegal acts committed by production and operation entities and their relevant personnel in violation of the laws, administrative regulations, departmental rules, national standards, or industry standards or rules on work safety in the process of their production and operation (hereinafter referred to as illegal acts in respect of work safety).
．．．．．． | | 第二条 县级以上人民政府安全生产监督管理部门（以下简称安全生产监督管理部门）对生产经营单位及其有关人员在生产经营活动中违反安全生产的法律、行政法规、部门规章、国家标准、行业标准和规程的违法行为（以下简称安全生产违法行为）依法实施罚款，适用本办法。
