Measures for Clearing up the Government Information of Beijing (for Trial Implementation)

Article 1 To do a good job in clearing up the government information of this Municipality, these Measures are formulated in accordance with the Regulation of the People's Republic of China on the Disclosure of Government Information (Order No.492 of the State Council, hereinafter referred to as the Regulation on the Disclosure of Government Information), the Notice of the General Office of the State Council on Doing a Good Job in the Preparatory Work for the Implementation of the Regulation of the People's Republic of China on the Disclosure of Government Information (No.54 [2007] of the General Office of the State Council) andthe Notice of the General Office of the People's Government of Beijing Municipality on Doing the Preparatory Work for the Implementation of the Regulation of the People's Republic of China on the Disclosure of Government Information (No.71 [2007] of the General Office of the People's Government of Beijing Municipality) and in light of the actual situation of this Municipality.
| | 第一条 为做好本市政府信息清理工作，根据《中华人民共和国政府信息公开条例》（国务院令第492号，以下简称《政府信息公开条例》）、《国务院办公厅关于做好施行〈中华人民共和国政府信息公开条例〉准备工作的通知》（国办发〔2007〕54号）及《北京市人民政府办公厅关于贯彻施行〈中华人民共和国政府信息公开条例〉准备工作的通知》（京政办发〔2007〕71号），结合本市实际，制定本办法。

Article 2 These Measures shall apply to the work of clearing up government information by the governments of this Municipality at all levels and their work departments (hereinafter referred to as administrative organs).
The term “government information” as mentioned in these Measures refers to the information produced or acquired and recorded or kept in certain forms by administrative organs in the process of performing their duties.
| | 第二条 本办法适用于本市各级政府及其工作部门（以下统称行政机关）清理本单位政府信息的工作。
本办法所称政府信息，是指行政机关在履行职责过程中制作或获取的，以一定形式记录、保存的信息。

Article 3 The work body of government information disclosure of an administrative organ shall take charge of clearing up the government information of the organ.
For an administrative organ which has been cancelled or consolidated or whose functions have been transferred, the power to clear up the government information formed before the cancellation, consolidation or transfer shall remain with the administrative organ which succeeds the duties and functions of the said administrative organ.
| | 第三条 行政机关的政府信息公开工作机构，负责组织本单位政府信息的清理工作。
被撤销、合并或机构职能发生转移的行政机关，在被撤销、合并、职能转移前形成的政府信息，由继续行使其职权的行政机关负责清理。

Article 4 An administrative organ shall clear up its government information formed since its establishment in an all-round way. All government information not submitted to the archives at the municipal, district or county level, including the information kept at the archives department of the organ, shall be cleared up.
．．．．．． | | 第四条 行政机关应全面清理本单位自成立以来形成的政府信息。凡未移交市、区县档案馆的政府信息，包括保存在本单位档案部门的政府信息，均属于清理范围。
按照由近及远的原则，重点对2003年1月1日至2008年5月1日本单位制作和保存的政府信息，特别是涉及人民群众切身利益的政府信息进行清理；清理完毕的，要进一步清理2003年以前的政府信息。
