Order of the Ministry of Environmental Protection
(No. 14)
The Measures for the Ex-post Supervision of Environmental Administrative Law Enforcement, which were deliberated and adopted at the 2nd executive meeting of the Ministry of Environmental Protection on November 5, 2010, are hereby issued and shall come into force as of March 1, 2011.

《环境行政执法后督察办法》已由环境保护部2010年第二次部务会议于2010年11月5日审议通过。现予公布，自2011年3月1日起施行。

Article 1 These Measures are formulated to regulate the ex-post supervision of environmental administrative law enforcement and improve the efficiency of environmental administrative law enforcement.
| | 第一条 为了规范环境行政执法后督察工作，提高环境行政执法效能，制定本办法。

Article 2 The term “ex-post supervision of environmental administrative law enforcement” as used in these Measures refers to the administrative measures taken by the environmental protection administrative departments for the purpose of supervising and inspecting the execution of such specific administrative acts as environmental administrative punishments and administrative orders.
| | 第二条 本办法所称环境行政执法后督察，是指环境保护主管部门对环境行政处罚、行政命令等具体行政行为执行情况进行监督检查的行政管理措施。

Article 3 The environmental protection administrative departments of the people's governments at and above the county level shall be responsible for organizing the ex-post supervision of environmental administrative law enforcement.
For specific administrative acts, such as environmental administrative punishments and administrative orders made by the environmental protection administrative departments of the people's governments at and above the county level according to law, the environment supervision offices of the environmental protection administrative departments of the people's governments at and above the county level shall be responsible for conducting the specific work of ex-post supervision of environmental administrative law enforcement.
For specific administrative acts, such as environmental administrative punishments and administrative orders made by the Ministry of Environmental Protection according to law, the environmental protection supervision offices dispatched by the Ministry of Environmental Protection may be responsible for the specific work of ex-post supervision of environmental administrative law enforcement.
| | 第三条 县级以上人民政府环境保护主管部门负责组织实施环境行政执法后督察。
对县级以上人民政府或者其环境保护主管部门依法作出的环境行政处罚、行政命令等具体行政行为，由县级以上人民政府环境保护主管部门的环境监察机构负责具体实施环境行政执法后督察。
对环境保护部依法作出的环境行政处罚、行政命令等具体行政行为，可以由环境保护部委托其派出的环境保护督查机构负责具体实施环境行政执法后督察。

Article 4 The environmental protection administrative department of the people's government at or above the county level shall integrate the ex-post supervision of environmental administrative law enforcement into its environmental administrative law enforcement work plan.
For a case of environmental offence which has a significant impact or has caused serious pollution, the environmental protection administrative department of the people's government at or above the county level shall work out an ex-post supervision plan and organize the execution thereof.
| | 第四条 县级以上人民政府环境保护主管部门应当将环境行政执法后督察纳入环境行政执法工作计划。
对有重大影响或者造成严重污染的环境违法案件，县级以上人民政府环境保护主管部门应当制定后督察工作方案，并组织实施。

Article 5 The environmental protection administrative department of the people's government at or above the county level shall conduct an ex-post supervision of environmental law enforcement within 60 days after the expiration of the time limit for execution of such a specific administrative act as environmental administrative punishment or administrative order.
| | 第五条 县级以上人民政府环境保护主管部门应当在环境行政处罚、行政命令等具体行政行为执行期限届满之日起60日内，进行环境行政执法后督察。

Article 6 The environmental protection administrative department of the people's government at or above the county level shall conduct an ex-post supervision of environmental law enforcement in respect of the following matters:
| | 第六条 县级以上人民政府环境保护主管部门应当对下列事项进行环境行政执法后督察：

1. the execution of a decision of administrative punishment, such as penalty, ordering the suspension of production, ordering the suspension or close-down of business, or confiscating the illegal gains or illegal properties;
．．．．．． | | （一）罚款，责令停产整顿，责令停产、停业、关闭，没收违法所得、没收非法财物等环境行政处罚决定的执行情况；
