Announcement of the Supreme People's Court of the People's Republic of China
(No.39 [2002] Fa-Shi)
The Provisions of the Supreme People's Court on Law Agents' Consulting of Civil Case Materials were adopted at the 1254th meeting of the Judicial Committee of the Supreme People's Court on November 4, 2002. They are hereby promulgated and shall come into force on December 7, 2002.

Provisions of the Supreme People's Court on Law Agents' Consulting of Civil Case Materials
(Adopted at the 1254th meeting of the Judicial Committee of the Supreme People's Court on November 4, 2002)
In order to guarantee lawyers and other law agents of civil litigations to exercise their rights to consult the materials relating to the cases they represent, and to ensure the smooth progress of litigations, the following provisions on the range and methods for law agents' consulting of the materials relating to the cases they represent are hereby made in accordance with Article 61 of the Civil Procedure Law of the People's Republic of China:

《最高人民法院关于诉讼代理人查阅民事案件材料的规定》已于２００２年１１月４日由最高人民法院审判委员会第１２５４次会议通过。现予公布，自２００２年１２月７日起施行。

最高人民法院关于诉讼代理人查阅民事案件材料的规定
（2002年11月4日最高人民法院审判委员会第1254次会议通过）
为保障代理民事诉讼的律师和其他诉讼代理人依法行使查阅所代理案件有关材料的权利，保证诉讼活动的顺利进行，根据《中华人民共和国民事诉讼法》第六十一条的规定，现对诉讼代理人查阅代理案件有关材料的范围和办法作如下规定：

Article 1 Lawyers and other law agents of civil litigations have the right to consult the materials relating to the cases they represent. However, law agents' consulting of case materials may not affect the hearing of cases. A law agent may consult the materials relating to the case it represents for the purpose of applying for retrial.
| | 第一条 代理民事诉讼的律师和其他诉讼代理人有权查阅所代理案件的有关材料。但是，诉讼代理人查阅案件材料不得影响案件的审理。诉讼代理人为了申请再审的需要，可以查阅已经审理终结的所代理案件有关材料。

Article 2 The people's court shall provide convenience for the law agents' consulting, and shall have the place for consulting. The clerk of the case or other staffs of the court shall be present if necessary.
