Some Opinions of the Ministry of Culture and the Ministry of Information Industry on the Development and Administration of Net Games
The departments (bureaus) of culture in all provinces, autonomous regions, municipalities directly under the Central Government and all the cities under separate state planning, the administrative departments of information industry, the administrative bureau of telecommunications and the bureau of culture of the Xinjiang Production and Construction Corps:
In order to further carry into effect the guiding thought of the Party and the state on the development of net-culture market, effectively implement Some Opinions of the CPC Central Committee and the State Council on Further Intensifying and Improving the Ideological and Ethical Construction of Minors (No. 8 [2004] of the CPC Central Committee), strengthen the administration of net games, regulate the business operations of net-culture market, enhance the level of originality of net games and promote the sound development of the net-culture industry, we hereby put forward the following opinions on the development and administration of net games of our country:
 

文化部、信息产业部关于网络游戏发展和管理的若干意见


各省、自治区、直辖市及各计划单列市文化厅(局)、信息产业主管部门、通信管理局、新疆生产建设兵团文化局:
为深入贯彻落实党和国家有关网络文化市场发展的指导思想,贯彻落实《中共中央、国务院关于进一步加强和改进未成年人思想道德建设的若干意见》(中发〔2004〕8号),加大网络游戏管理力度、规范网络文化市场经营行为,提高我国网络游戏原创水平,促进网络文化产业的健康发展,现就我国网络游戏发展和管理工作,提出以下意见。
I.The Present Situation and Development Objective of China's Net Game Market
 一、我国网络游戏市场的现状和发展目标
(1) The net game is an interactive entertainment form as realized and spread by means of information network and an industry combining networks and culture. In recent years, the net-culture market has experienced a rapid development. Such business sites of internet access services as network bars are spread throughout the country, which drives along the development of the net game market. With the rapid popularization of the internet and the access of broad band into communities and families, the net game market of our country witnessed fast development and has entered into a period of high-speed growth. It has produced a comparatively big industrial value, motivated the development of the related industries and played a positive role in promoting the development of the net economy and the entertainment industry and in enriching the culture and entertainment life of the people in the internet era.
   (一)网络游戏是通过信息网络传播和实现的互动娱乐形式,是一种网络与文化相结合的产业。近年来,网络文化市场发展很快,网吧等互联网上网服务营业场所遍及全国城乡,带动了网络游戏市场的发展。随着互联网的迅速普及、宽带的接入社区和家庭,我国网络游戏市场发展迅速并进入了一个高速增长期,并已经创造了较大的产值,带动了相关产业的发展,对促进我国网络经济和娱乐业的发展、丰富互联网时代人民群众的文化娱乐生活起到了积极作用。
(2) The net games of our country still remain in the early stage of development with many problems that cannot be ignored, some of which are comparatively serious. They are mainly embodied as follows: there are such illegal or unhealthy contents as obscenity, eroticism, gambling, violence, superstition or illegal transaction or property accumulation by unfair means and injury on the national security. The second is that the net game products of national originality with self-owned intellectual property right cannot take the lead in the market. The third is the duplicated operational modes and monotonous product types. Those net game products featuring fight or upgrades occupy a comparatively big market share. The forth is that such problems as infringement of intellectual property rights and damage to the market order as “private server” and “game upgrade software download” are extruding. The fifth is that it has induced a series of social problems that affect the bodily and mental health of the minors who lack self-control. All these problems have injured the sound development of the net game market of our country.
   (二)我国网络游戏处于发展的初期,存在许多不容忽视的问题,有的还比较严重。主要表现为:一是网络游戏产品中存在淫秽、色情、赌博、暴力、迷信、非法交易敛财以及危害国家安全等违法和不健康内容。二是拥有自主知识产权的民族原创网络游戏产品未能主导市场。三是经营模式雷同,产品类型单调,以打斗和练级为主的游戏产品占据了较大的市场份额。四是“私服”、“外挂”等侵犯知识产权、破坏市场秩序的问题突出。五是诱发一系列社会问题,影响缺乏自制能力的未成年人的身心健康。这些问题严重损害了我国网络游戏市场的健康发展。
(3) We should guide and examine the development and administration of net games with a scientific development concept. We should not only consciously realize the existing problems of net games and adopt proper measures and intensify the supervision and control so as to make efforts to solve the existing problems and build a harmonious net-culture environment for minors and also attach importance to the positive role as played by net games and the industrial value thereof, base ourselves on the future, support the development of the net game industry of national origin so as to guarantee that healthy and inspirable net game products in colorful and varied forms may occupy the main-stream status in the domestic market, that the net game products of national origin take the dominant position in the domestic market as soon as possible and enter into the international market at a proper time, that business operations in the net game market are effectively regulated, that the intellectual property right is widely respected, that the administrative legal system is basically improved and that a group of net game brands of national origin featuring Chinese style and international influence are forged.
   (三)要以科学发展观来指导和检验网络游戏发展和管理工作,既清醒地认识到网络游戏存在的问题,采取措施、加强监管,努力解决现存的问题,为广大未成年人营造和谐的网络文化环境,又充分重视网络游戏的积极作用和产业价值,立足长远,支持民族原创网络游戏产业的发展,使内容健康向上、形式丰富多彩的网络游戏产品居于国内市场的主流,民族原创网络游戏产品尽快占据国内市场主导地位,适时进入国际市场,网络游戏市场经营行为得到有效规范,知识产权得到普遍尊重,法制管理体系基本完备,打造一批具有中国风格和国际影响的民族原创网络游戏品牌。
II.Supporting the Sound Development of the Net Game Industry
 二、支持网络游戏产业健康发展
(4) We should build up an industrial supporting system. As the net game is an important part of the software industry, the development funds of the electronic information industry shall make good efforts to perform as a guiding fund of the game industry and put the focus on developing the core technologies in the research and development of net games. We should further implement and carry into effect such policies concerning the software industry as “Some Policies of Encouraging the Development of the Software Industry and the Integrated Circuit Industry (Order No. 18 [2000] of the State Council) and the “Action Guidelines for Revitalizing the Software Industry (Order No. 47 [2002] of the General Office of the State Council). We should promote the establishment of a system for fostering talents in the game industry. We should actively train the personnel in the respects of scheme, research and development and marketing management. We should advance the professional trainings of the game industry, enhance the strength of talent training by social forces and actively encourage the net game enterprises to establish schools independently or in cooperation with colleges so as to train relevant talents.

   (四)构筑产业支持体系。网络游戏作为软件产业的一个重要组成部分,电子信息产业发展基金应加大支持力度,作为游戏产业的引导资金,重点开发网络游戏研发生产的核心技术。进一步贯彻落实国务院《关于鼓励软件产业和集成电路产业发展的若干政策》(国发〔2000〕18号)和《振兴软件产业行动纲要》(国办发〔2002〕47号)等软件产业政策。推动建立游戏产业人才培养体系。积极培养网络游戏策划人员、研发人员和营销管理人员。推进游戏职业培训,提高社会自身人才培养力度,积极鼓励游戏企业独立办学或与高校联合办学培训人才。
