Interim Measures for the Administration of the Funds for Land Development and Consolidation Projects

土地开发整理项目资金管理暂行办法

Article 1 These Measures are formulated according to the Land Administration Law and the Measures for the Administration of the Collection and Use of Land Use Fees for Newly-added Construction Land for the purpose of strengthening the administration of the funds for land development and consolidation projects (hereinafter referred to as “project funds”) and enhancing the efficacy in the use of project funds.
   第一条 为了加强对土地开发整理项目资金(以下简称项目资金)的管理,提高项目资金的使用效益,根据《土地管理法》和《新增建设用地土地有偿使用费收缴使用管理办法》等有关财经法规的规定,制定本办法。
Article 2 The “project funds” mentioned in these Measures refers to the capital used as subsidies to the key arable land development and consolidation projects as determined by the Central Government, the model arable land development and consolidation projects as approved by the Central Government, as well as the regional arable land development and consolidation projects.
   第二条 本办法所称项目资金是指用于中央确定的耕地开发整理重点项目、经中央批准的耕地开发整理示范项目和对地方耕地开发整理项目进行补助的资金。
Article 3 The project funds shall come from (at 30% of) the land use fees for newly-added construction land obtained by the Central Government, and shall be earmarked and separately assessed, and shall not be withheld, misappropriated or occupied.
   第三条 项目资金来源于中央所得的新增建设用地土地有偿使用费(30%部分)。项目资金实行专款专用,单独核算,不得截留、挪用或挤占。
Article 4 The project funds shall be used for all the expenses paid for the organization, implementation and management of land development and consolidation projects, including the preliminary work fees, project construction fees, fees for completion-based check and acceptance, property management fees and other unforeseeable fees.
   第四条 项目资金的开支范围为组织、实施、管理土地开发整理项目发生的各项支出,包括前期工作费、工程施工费、竣工验收费和业主管理费与不可预见费等。
(1) The “preliminary work fees” refers to all the expenses occurred before the construction of a land development and consolidation project, including the fees for the examination of project initiation, the submission for approval, feasibility study, planning and design, survey and construction design of the project, land inventory charges, tender charges, as well as the project supervision fees, etc.
 (一)前期工作费,是指土地开发整理项目在工程施工前所发生的各项支出,包括:项目立项审查及报批、项目可行性研究及规划设计、项目勘察、施工设计费、土地清查费、项目招标费和工程监理费等。
(2) The “project construction fees” refers to all the expenses incurred from land consolidation, irrigation, field road and other land development and consolidation works, including direct engineering fees, indirect fees, planned profits and various taxes.
The “direct engineering fees” consists of direct fees and other direct fees. The former mainly includes the fees for direct manpower, direct materials and construction machinery; while the latter mainly includes the fees increased for the construction in winter and on rainy days as well as supporting construction fees.
The “indirect fees” consists of enterprise management fees, financial costs and on-the-spot funds, etc.
 (二)工程施工费,是指实施土地平整、农田水利和田间道路等各项土地开发整理工程发生的支出,包括直接工程费、间接费、计划利润和各种税金。
直接工程费由直接费和其他直接费组成。直接费主要包括直接人工、直接材料和施工机械费;其他直接费主要包括冬雨季施工增加费和施工辅助费。
间接费由企业管理费、财务费用和现场经费等组成。
(3) The “fees for completion-based check and acceptance” refers to all the expenses occurred from the completion-based check and acceptance, final accounts and fruits management, etc. for a land development and consolidation project after the project is completed, including the fees for completion-based check and acceptance of the project, the fees for formulation and audit of final accounts of the project, the fees for land revaluation and registration after consolidation, as well as the fees for basic farmland rezoning and marks setting, etc.
 (三)竣工验收费,是指土地开发整理工程完工后,因项目竣工验收、决算、成果的管理等发生的各项支出,包括:项目工程验收费、项目决算的编制及决算的审计费,整理后土地的重估与登记费、基本农田重划及标志设定费等。
(4) The “project management fees” refers to all the management expenses occurred from the project organization and management of the project undertaking entity, mainly including the wages, wage subsidies, other wages and welfare funds for employees, official charges, business entertainment expenses and other fees.
 (四)业主管理费,是指项目承担单位为项目的组织、管理所发生的各项管理性支出,主要包括:项目管理人员的工资、补助工资、其他工资、职工福利费、公务费、业务招待费和其他费用等。
(5) The “unforeseeable fees” refers to the expenses occurred due to the force majeure, design alteration, change of manpower, materials, equipment or engineering tasks, etc. during the course of project construction.

 (五)不可预见费,是指项目施工过程中因自然灾害、设计变更、人工、材料、设备和工程量等发生变化而增加的费用。
项目资金可用于购置与土地开发整理项目配套的设备。用项目资金购置的配套设备按固定资产进行管理。
