| Chapter I General Provisions | | 第一章 总则 |
| Article 1 These Provisions are formulated according to the Regulation of the People's Republic of China on the Administration of Waterways, the Regulation on the Quality Administration of Construction Projects and the Regulation on the Survey and Design Administration of Construction Projects for the purpose of promoting the sustainable and sound development of the waterway cause, reinforcing the supervision over and administration of waterway construction, and maintaining the order of waterway construction market. | | 第一条 为促进航道事业持续、健康发展，加强航道建设监督管理，维护航道建设市场秩序，根据《中华人民共和国航道管理条例》、《建设工程质量管理条例》和《建设工程勘察设计管理条例》，制定本规定。 |
| Article 2 These Provisions are applicable to the construction of waterways (hereinafter referred to as waterway construction) within the territory of the People's Republic of China. | | 第二条 在中华人民共和国境内从事航道建设活动适用本规定。 |
| The term “waterway construction” as mentioned in these Provisions includes new construction, expansion and rebuilding of the waterway facilities for waterway improvements, waterway dredging, shipping hubs and navigation structures as well as other waterway ancillary facilities. | | 本规定所称航道建设活动包括航道整治、航道疏浚和航运枢纽、过船建筑物等航道设施及其他航道附属设施的新建、扩建和改建活动。 |
| Article 3 The system of unified leadership and level-by-level administration shall be implemented for waterway construction. | | 第三条 航道建设实行统一领导，分级管理制度。 |
| The Ministry of Communications shall be responsible for the administration of the waterway construction sector across the country; and be specifically responsible for the examination and approval of project proposals and feasibility study reports on the waterway construction projects which are subject to approval or ratification of the National Development and Reform Commission (NDRC), be specifically responsible for the approval of project proposals and feasibility study reports according to the limit of power, simultaneously be specifically responsible for the supervision and administration during the process of examination and approval of design documents, the archival filing of the start-up, completion-based check and acceptance, bid invitation and tendering, etc. for the waterway construction projects for which the NDRC or the Ministry of Communications approves or verifies their feasibility study reports. | | 交通部负责全国航道建设的行业管理。具体负责由国家发展改革委批准或核准航道建设项目的项目建议书和可行性研究报告的审核工作，按权限批准项目建议书、可行性研究报告；具体负责国家发展改革委批准或核准以及交通部批准可行性研究报告的航道建设项目的设计文件审批、开工备案、竣工验收以及招标投标等项目实施过程中的监督管理工作。 |
| The provincial communications administrative department shall be responsible for the supervision over and administration of waterway constructions within its own administrative area, and be specifically responsible for the supervision and administration during the process of preliminary work, examination and approval of design documents, the archival filing of the start-up, completion-based check and acceptance, bid invitation and tendering, etc. for the waterway construction projects approved by the relevant department under the provincial people's government; and simultaneously be responsible for the examination and approval of design documents, the archival filing of the start-up, completion-based check and acceptance for the waterway construction projects as approved by the provincial people's government. | | 省级交通主管部门负责本行政区域内航道建设的监督管理。具体负责经省级人民政府有关部门批准的航道建设项目的前期工作和设计文件审批、招标投标、开工备案、竣工验收等项目实施过程中的监督管理工作；负责经省级人民政府核准的航道建设项目的设计文件审批、开工备案和竣工验收工作。 |
| The communications administrative department of the districted city or the county shall be responsible for the supervision over and administration of waterway construction projects within its own administrative area according to the relevant provisions as set down by the provincial people's government. | | 设区的市和县级交通主管部门按照省级人民政府的有关规定负责本行政区域内航道建设项目的监督管理。 |
| Article 4 The supervision over and administration of waterway construction includes the following responsibilities: | | 第四条 航道建设监督管理的职责包括： |
| (1) Supervising the implementation of the guidelines, policies, laws, regulations, rules and technical standards of the state on waterway construction; | | （一）监督国家有关航道建设工作方针、政策和法律、法规、规章、技术标准的执行； |
| (2) Supervising the implementation of the construction procedures for waterway construction projects; | | （二）监督航道建设项目建设程序的实施； |
| (3) Supervising the order of the waterway construction market; | | （三）监督航道建设市场秩序； |
| (4) Supervising the quality and work safety of waterway projects; | | （四）监督航道工程质量和工程安全； |
| (5) Supervising the use of waterway construction funds; | | （五）监督航道建设资金的使用； |
| (6) Supervising the building of a honest and clean government; | | （六）监督廉政建设情况； |
| (7) Guiding and inspecting the supervisory and administrative work of the competent administrative departments at lower levels; | | （七）指导、检查下级管理部门的监督管理工作； |
| (8) Investigating and handling waterway construction violations; and | | （八）依法查处航道建设违法行为； |
| (9) Other responsibilities provided by laws and administrative regulations. | | （九）法律、行政法规规定的其他职责。 |
| Article 5 The communications administrative department at or above the county level shall carry out supervision over and administration of the waterway construction according to pertinent laws, regulations and these Provisions. | | 第五条 县级以上交通主管部门应当依照有关法律、法规以及本规定对航道建设实施监督管理。 |
| Related entities and individuals shall accept the supervision over and administration of waterway construction as carried out by the communications administrative department at or above the county level, offer support and cooperation, and shall not refuse or impede such supervisory and administrative work. | | 有关单位和个人应当接受县级以上交通主管部门依法进行的航道建设监督检查，并给与支持及配合，不得拒绝或者阻碍。 |
| Article 6 A bid invitation and tendering system, project supervision system, contract management system, and monitoring system for the honest and clean government shall be implemented for waterway construction projects according to the pertinent provisions of the state. | | 第六条 航道建设项目应当按照国家有关规定实行招标投标制度、工程监理制度、合同管理制度和廉政监察制度。 |
| Article 7 The waterway construction shall comply with waterway plan, and take into account the requirements for flood safety, water transportation safety and environment protection. | | 第七条 航道建设应当符合航道规划，并考虑行洪安全、水上交通安全和环境保护的要求。 |
| The entity undertaking a waterway construction project shall lawfully choose the institutions of survey, design, consultancy and supervision, lawfully procure important equipment and materials relating to the project construction, make the archival filing of the start-up, organize the implementation of the project, organize the hand-over, check and acceptance of the completed project, and make preparations for the completion-based check and acceptance of the project. | | 航道建设项目单位应当依法选择勘察、设计、施工、咨询、监理单位，依法采购与工程建设有关的重要设备和材料，办理开工备案，组织项目实施，组织项目交工验收，准备项目竣工验收工作。 |
| Chapter II Construction Procedural Administration | | 第二章 建设程序管理 |
| Article 8 The waterway construction shall be carried out according to the construction procedures as set down by the state. waterway construction projects invested by the government shall be subject to examination and approval, and waterway construction projects invested by the enterprise shall be subject to ratification and archival filing. | | 第八条 航道建设应当按照国家有关建设程序的规定进行。政府投资航道建设项目实行审批制，企业投资航道建设项目实行核准制和备案制。 |
| Article 9 A waterway construction project invested by the government shall be implemented according to the following procedures: | | 第九条 政府投资的航道建设项目，按照以下建设程序执行： |
| (1) Conducting advance feasibility research according to the plan, and formulating a project proposal; | | （一）根据规划，开展预可行性研究，编制项目建议书； |
| (2) Conducting feasibility research on the project according to the project proposal as approved, and formulating a feasibility study report; | | （二）根据批准的项目建议书，进行工程可行性研究，编制可行性研究报告； |
| (3) Compiling preliminary design documents according to the feasibility study report as approved; | | （三）根据批准的可行性研究报告，编制初步设计文件； |
| (4) Compiling construction drawing design documents according to the preliminary design as approved; | | （四）根据批准的初步设计文件，编制施工图设计文件； |
| (5) Organizing bid invitations for the project supervision and construction according to the design documents as approved; | | （五）根据批准的设计文件，组织项目监理、施工招标； |
| (6) Conducting the preparatory work before construction according to the pertinent provisions of the state, and going through the formalities for the archival filing of start-up at the port administrative department; | | （六）根据国家有关规定，进行施工前准备工作，并向交通主管部门办理开工备案； |
| (7) Organizing the project construction after archival filing; | | （七）开工备案后组织工程实施； |
| (8) Upon the completion of the project, formulating the materials about the completion of project, and making various preparations for the completion-based check and acceptance of the project; and | | （八）工程完工后，编制竣工资料，办理工程竣工前的各项工作； |
| (9) The port administrative department carries out the completion-based check and acceptance, and handles the formalities for transfer of fixed assets. | | （九）交通主管部门组织竣工验收，办理固定资产移交手续。 |
| Article 10 A waterway construction project invested by the enterprise shall be implemented according to the following procedures: | | 第十条 企业投资的航道建设项目，按照以下建设程序执行： |
| (1) Determining the investor for the construction project; | | （一）依法确定建设项目投资人； |
| (2) Working out a feasibility study report on the project according to the plan and the demand; | | （二）根据规划与需要，编制工程可行性研究报告； |
| (3) Working out a project application report, and going through the formalities for ratification or archival filing by the investor; | | （三）投资人组织编制项目申请报告，按照规定履行核准或者备案手续； |
| (4) Working out preliminary design documents according to the project application report as ratified or filed; | | （四）根据核准、备案的项目申请报告，编制初步设计文件； |
| (5) Working out construction drawing design documents according to the preliminary design as approved; | | （五）根据批准的初步设计文件，编制施工图设计文件； |
| (6) Organizing bid invitations for the project supervision and construction according to the design documents as approved; | | （六）根据批准的设计文件，组织项目监理、施工招标； |
| (7) Conducting preparatory work before construction according to the pertinent provisions of the state, and going through the formalities for archival filing of start-up at the port administrative department; | | （七）根据国家有关规定，进行施工前准备工作，并向交通主管部门办理开工备案； |
| (8) Organizing project construction after the archival filing of start-up; | | （八）开工备案后组织工程实施； |
| (9) Upon the completion of the project, formulating the materials about the completion of project, and making various preparations for the completion-based check and acceptance of the project; and | | （九）工程完工后，编制竣工资料，办理工程竣工前的各项工作； |
| (10) The port administrative department carries out the completion-based check and acceptance and handles the formalities for transfer of fixed assets. | | （十）交通主管部门组织竣工验收，办理固定资产移交手续。 |
| Article 11 The communications administrative department at or above the county level shall, according to the limit of power, be responsible for organizing and supervising the implementation of waterway construction projects. No construction procedure may be illegally cut short unless it is otherwise provided for by the state. | | 第十一条 县级以上交通主管部门应当按照职责权限负责组织和监督航道建设项目的实施，除国家另有规定外，不得擅自简化建设程序。 |
| Where the department in charge of communications on the county level or above finds that any of the start-up documents does not satisfy the requirement of any law, administrative regulation or ministerial rule, it shall put forward its opinions of disposal within 7 days as of receipt of the archival filing documents and shall exercise its administration duties in a timely manner. | | 县级以上交通主管部门发现开工备案文件存在不符合法律、行政法规以及规章规定内容的，应当在收到备案文件7日内提出处理意见，及时行使监督管理职责。 |
| Article 12 The proposal for a waterway construction project shall be prepared according to the following basic requirements: | | 第十二条 编制航道建设项目建议书，应当符合以下基本要求： |
| (1) The advance feasibility research for the waterway construction project has been conducted; | | （一）开展航道建设项目工程预可行性研究； |
| (2) The construction scheme conforms to the waterway plan; | | （二）建设方案应符合航道规划； |
| (3) The proposal satisfies the depth requirement as set down in the advance feasibility research and the proposal for the water transportation project; and | | （三）符合有关编制水运工程预可行性研究和项目建议书的深度要求； |
| (4) The proposal satisfies the pertinent national and industrial provisions. | | （四）符合国家和行业的有关规定。 |
| Article 13 To apply for examination and approval of the proposal for a waterway construction project, an applicant shall provide the following materials: | | 第十三条 申请航道建设项目建议书审批，应当提供以下材料： |
| (1) application documents in duplicate; | | （一）行政许可申请书； |
| (2) a project proposal in quintuplicate and a corresponding electronic version; | | （二）项目建议书一式5份及其电子文件； |
| (3) an advance project feasibility report in quintuplicate and a corresponding electronic version; and | | （三）工程预可行性研究报告一式5份及其电子文件； |
| (4) other materials that are required to be provided by the examination department according to the requirements for the project. | | （四）审批部门根据项目需要要求提供的其他材料。 |
| Article 14 The feasibility study report for a waterway construction project shall be prepared according to the following basic requirements: | | 第十四条 编制航道建设项目可行性研究报告，应当符合以下基本要求： |
| (1) Conforming to the waterway plan; | | （一）符合航道规划； |
| (2) Conforming to the project proposal as approved; | | （二）符合经批准的项目建议书； |
| (3) Conforming to the depth requirement as set down in the feasibility study report for a water transportation project; and | | （三）符合有关编制水运工程可行性研究报告的深度要求； |
| (4) Conforming to the relevant national and industrial provisions as well as the technical standards and criteria. | | （四）符合国家和行业的有关规定和技术标准、规范。 |
| Article 15 To apply for examination and approval of the feasibility study report for a waterway construction project, an applicant shall provide the following materials: | | 第十五条 申请航道建设项目可行性研究报告审批，应当提供以下材料： |
| (1) application documents in duplicate; | | （一）行政许可申请书； |
| (2) a feasibility study report on the project in quintuplicate and a corresponding electronic version; | | （二）工程可行性研究报告一式5份及其电子文件； |
| (3) the approval, commitment, proof or appraisal opinions presented by related entities as required by pertinent provisions; and | | （三）有关规定所要求的相关单位的许可、承诺、证明或者评估意见； |
| (4) other materials that are required to be provided according to the requirements for the project. | | （四）根据项目需要要求提供的其他材料。 |
| Article 16 A project application report prepared shall include the following contents: | | 第十六条 编制项目申请报告，应当包括以下内容： |
| (1) conditions about the project applicant; | | （一）项目申报单位情况； |
| (2) conditions about the project to be constructed; | | （二）拟建设项目情况； |
| (3) the land for construction purpose and the relevant plan; | | （三）建设用地与相关规划； |
| (4) the analysis of resources utilization and energy consumption; | | （四）资源利用和能源耗用分析； |
| (5) the analysis of the impact on ecological environment; and | | （五）生态环境影响分析； |
| (6) the analysis of economic and social effects. | | （六）经济和社会效果分析。 |
| Article 17 To apply for ratification of a waterway construction project, an applicant shall provide the following materials: | | 第十七条 申请航道建设项目核准，应当提供以下材料： |
| (1) a project application report in quintuplicate and a corresponding electronic version; | | （一）项目申请报告一式5份及其电子文件； |
| (2) the urban planning opinions issued by the urban planning administrative department; | | （二）城市规划行政主管部门出具的城市规划意见； |
| (3) the advance examination opinions about the purpose of use of land for the project as issued by the administrative department for land and resources; | | （三）国土资源行政主管部门出具的项目用地预审意见； |
| (4) the examination and approval opinions about the documents on the evaluation of environmental impact as issued by the environmental protection administrative department; and | | （四）环境保护行政主管部门出具的环境影响评价文件的审批意见； |
| (5) other documents that should be provided according to pertinent laws and regulations. | | （五）法律法规要求提交的其他材料。 |
