The National Hazardous Waste Inventory has been formulated according to the Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes. It is hereby promulgated and shall be implemented as of August 1, 2008.
The National Hazardous Waste Inventory (No.89 [1998]) promulgated by the former State Environmental Protection Administration, State Economic and Trade Commission, Ministry of Foreign Trade and Economic Cooperation, Ministry of Public Security on January 4, 1998 shall be abolished simultaneously.

根据《中华人民共和国固体废物污染环境防治法》，特制定《国家危险废物名录》。现予公布，自2008年8月1日起施行。
1998年1月4日原国家环境保护局、国家经济贸易委员会、对外贸易经济合作部、公安部发布的《国家危险废物名录》（环发〔1998〕89号）同时废止。

国家危险废物名录

Article 1. This inventory is formulated according to the relevant provisions of the Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes.
| | 第一条 根据《中华人民共和国固体废物污染环境防治法》的有关规定，制定本名录。

Article 2. The solid waste and liquid waste in any one of the following circumstances shall be included in this inventory:
| | 第二条 具有下列情形之一的固体废物和液态废物，列入本名录：
|
1. With one or more hazardous characteristics as corrosiveness, toxicity, inflammability, reactivity or infectiousness, etc.
| | （一）具有腐蚀性、毒性、易燃性、反应性或者感染性等一种或者几种危险特性的；
|
2. Non-elimination of hazardous characteristics and likely to incur adverse effect on the environment or personal health, and shall be subject to the management in term of hazardous wastes.
| | （二）不排除具有危险特性，可能对环境或者人体健康造成有害影响，需要按照危险废物进行管理的。

Article 3. Medical treatment wastes are hazardous wastes. The Classified Catalogue of Medical Treatment Wastes shall be formulated and promulgated separately according to the Regulation on the Administration of Medical Treatment Wastes.
| | 第三条 医疗废物属于危险废物。《医疗废物分类目录》根据《医疗废物管理条例》另行制定和公布。

Article 4. In case any solid or liquid waste not included in this inventory and the Classified Catalogue of Medical Treatment Wastes are determined as a hazardous waste with hazardous characteristics by the experts organized by the competent administrative department for environment protection of the State Council according to the standards and ways of identification for national hazardous wastes, it shall be timely added into this inventory.
| | 第四条 未列入本名录和《医疗废物分类目录》的固体废物和液态废物，由国务院环境保护行政主管部门组织专家，根据国家危险废物鉴别标准和鉴别方法认定具有危险特性的，属于危险废物，适时增补进本名录。

Article 5 The nature determination on the mixture of hazardous wastes and non-hazardous wastes shall be executed according to the identification standards for national hazardous wastes.
| | 第五条 危险废物和非危险废物混合物的性质判定，按照国家危险废物鉴别标准执行。

Article 6 The disposed medicines and its package, disposed pesticide, disinfectant and its package, disposed paint solvent and its package, disposed mineral oil and its package, disposed film and disposed picture paper, disposed fluorescent lamp pipe, disposed thermometer, disposed sphygmomanometer, disposed nickel cadmium cell and mercury oxide cell, as well as electronic hazardous wastes may not be subject to management as hazardous wastes.
After the wastes mentioned in the above article have been collected in different classes from the domestic garbage, the transportation, storage, utility or disposal thereof shall be subject to the management as hazardous waste.
| | 第六条 家庭日常生活中产生的废药品及其包装物、废杀虫剂和消毒剂及其包装物、废油漆和溶剂及其包装物、废矿物油及其包装物、废胶片及废像纸、废荧光灯管、废温度计、废血压计、废镍镉电池和氧化汞电池以及电子类危险废物等，可以不按照危险废物进行管理。
将前款所列废弃物从生活垃圾中分类收集后，其运输、贮存、利用或者处置，按照危险废物进行管理。

Article 7. The competent administrative department for environment protection of the State Council shall, according to the requirement of environmental management on hazardous wastes, amend this inventory and promulgate it in a timely manner.
