Order of the General Administration of Customs
(No. 180)
The Provisions of the People's Republic of China on the Administration of the Work of Customs Legislation, which were deliberated and adopted at the executive meeting of the General Administration of Customs on December 25, 2008, are hereby promulgated and shall come into force on March 1, 2009. The Provisions of the People's Republic of China on the Administration of the Work of Customs Legislation as promulgated by Order No. 131 of the General Administration of Customs on October 24, 2005 shall be simultaneously abolished.

Chapter I General Provisions
 第一章 总则


Article 1 For the purpose of strengthening the administration of the formulation of customs rules and regulatory documents (hereinafter referred to as the work of customs legislation), the present Provisions are formulated according to the Law on Legislation of the People's Republic of China (hereinafter referred to as the “Legislation Law”), the Regulation on Rule-making Procedures and other laws and administrative regulations and by taking the actual situation of the customs work into consideration.
   第一条 为了加强对海关规章和规范性文件制定工作(以下统称海关立法工作)的管理,根据《中华人民共和国立法法》(以下简称《立法法》)、《规章制定程序条例》等法律、行政法规的规定,结合海关工作实际,制定本规定。
Article 2 These Provisions shall be applicable to the approval of proposals, drafting, examination, decision, promulgation, archival filing, interpretation, revision, abolishment, etc. of customs rules and regulatory documents of the GAC.
These Provisions shall be applicable to the rules and regulatory documents jointly formulated or promulgated by the GAC and the relevant departments under the State Council.
The formulation and promulgation of the regulatory documents by the customs houses directly under the GAC within their respective authorities shall be governed by the present Provisions.
   第二条 海关规章、海关总署规范性文件的立项、起草、审查、决定、公布、备案、解释、修订、废止等,适用本规定。
海关总署与国务院有关部门联合制定、公布规章和规范性文件,适用本规定。
直属海关在其职权范围内制定、发布直属海关规范性文件,依照本规定执行。
Article 3 The term “customs rules” as mentioned in the present Provisions refers to the rules formulated and promulgated by the GAC according to the Legislation Law, the Regulation on Rule-making Procedures and the present Provisions.
The term “regulatory documents of the General Administration of Customs” as mentioned in the present Provisions refers to the documents formulated by the GAC and promulgated in the form of public announcements of the GAC that involve the rights and obligations of administrative counterparts and have universal binding force.
The term “regulatory documents of the customs houses directly under the General Administration of Customs” as mentioned in the present Provisions refers to the documents formulated by the customs houses directly under the GAC and promulgated in the form of public announcements of the customs houses directly under the GAC that involve the rights and obligations of administrative counterparts and have universal binding force within their respective jurisdictions.
   第三条 本规定所称海关规章,是指海关总署按照《立法法》、《规章制定程序条例》及本规定制定、公布的规章。
本规定所称海关总署规范性文件,是指海关总署制定并以海关总署公告形式对外发布的涉及行政相对人权利、义务,具有普遍约束力的文件。
本规定所称直属海关规范性文件,是指直属海关制定并以直属海关公告形式发布的涉及行政相对人权利、义务,在本直属海关辖区内具有普遍约束力的文件。
Article 4 Customs legislation shall follow the legislation principles as set forth in the Legislation Law, and adhere to the following principle according to the actual situation of the customs work:
   第四条 海关立法应当遵循《立法法》确立的立法原则,并根据海关工作实际坚持以下原则:
(1) Conforming to the Constitution, laws, administrative regulations and other superordinate laws;
 (一)符合宪法、法律、行政法规和其他上位法的规定;
(2) Adhering to scientific and democratic legislation, and constantly improving the quality of legislation;
 (二)科学立法、民主立法,不断提高立法质量;
(3) Being open and transparent, encouraging and facilitating administrative counterparts and the general public to participate in customs legislation;
 (三)公开透明,鼓励和方便行政相对人和社会公众参与海关立法;
(4) Taking into consideration the actual situation, highlighting the characteristics of the customs work, and not repeating the provisions of the superordinate laws in principle; and
 (四)结合实际,突出海关工作特点,原则上不重复上位法规定;
(5) Stressing both formulation and clean-up, and maintaining the harmony and unity of the basis for the customs law enforcement.
 (五)制定与清理并重,维护海关执法依据和谐、统一。
Article 5 The customs rules and regulatory documents of the GAC and the customs houses directly under the GAC shall be well-structured, complete in contents, standardized in form, well-organized, precise and terse in wording, and meet the requirements of the customs legislation technical specifications.
The customs legislation technical specifications shall be separately formulated by the legal affairs department under the GAC.
   第五条 海关规章、海关总署规范性文件及直属海关规范性文件应当结构严谨、内容完备、形式规范、条理清楚、用词准确、文字简洁,并符合海关立法技术规范要求。
海关立法技术规范由海关总署法制部门另行制定。
Article 6 The legal affairs department under the GAC shall be responsible for guiding and supervising the customs legislation work of the whole country, and undertake specifically the following work:
   第六条 海关总署法制部门负责对全国海关立法工作进行指导、监督,并具体承担以下工作:
(1) Drawing out the medium and long-term legislative blueprint and the annual legislative plans of the GAC, supervising and urging the implementation thereof;
 (一)拟订海关总署中长期立法规划和年度立法计划,并督促实施;
(2) Drafting or organizing the drafting of laws and administrative regulations that the GAC is delegated to draft on behalf of others and the comprehensive customs rules;
 (二)起草或者组织起草海关总署负责代拟的法律、行政法规代拟稿和综合性海关规章;
(3) Examining the examination drafts of professional rules for examination, regulatory documents of the GAC, and the international cooperation treaties in customs drafted by the competent administrative department under the GAC; and
 (三)审查海关总署业务主管部门起草的专业性规章送审稿、海关总署规范性文件和海关国际合作条约文本;
(4) Other legislative work that the legal affairs department under the GAC should assume as prescribed by the laws, administrative regulations and the GAC.
The legal affairs department of the Guangdong branch of the GAC shall be responsible for assisting the legal affairs department under the GAC in guiding and coordinating the legislative work of the customs houses directly under the GAC in Guangdong region, and shall exercise the functions of legislative supervision within the authorization of the GAC.
The legal affairs department of a customs house directly under the GAC shall be responsible for the organizing of drafting, examination, coordination, archival filing, etc. of regulatory documents within its own jurisdiction, shall be responsible for soliciting opinions about the drafts of laws, administrative regulations, rules and other regulatory documents as delivered by the GAC within its own jurisdiction, and feed these opinions back to the GAC, and shall be responsible for collecting the information on the grass-roots law enforcement and present legislative suggestions.

 (四)其他法律、行政法规和海关总署规定由海关总署法制部门承担的立法工作。
广东分署法制部门负责协助海关总署法制部门指导、协调广东地区直属海关的立法工作,根据海关总署的授权行使立法监督职能。
直属海关法制部门负责本关区规范性文件的组织起草、审查、协调、备案等工作,负责组织在本关区内对总署下发的法律、行政法规、规章及规范性文件的草案征求意见,并向总署反馈,负责了解收集基层执法情况,提出立法建议。

Section I General Rules
 第一节 一般规定


Article 7 The customs rules shall be formulated by the GAC where a certain customs administrative relationship is wholly and comprehensively regulated and the rights and obligations of administrative counterparts are concerned.
   第七条 完整、全面规范某一类海关行政管理关系,并涉及行政相对人权利义务的,应当由海关总署制定海关规章。
Article 8 Where the customs rules involve the limits of authorities of other departments under the State Council, joint rules shall be formulated by the GAC together with the relevant departments under the State Council.
   第八条 海关规章内容涉及国务院其他部门职权范围的,应当由海关总署会同国务院有关部门制定联合规章。
Article 9 Where a rule as sponsored by the GAC and jointly formulated with any other department under the State Council is included into the sequence of the orders of the GAC, the draft of such rule shall be sent to the departments that jointly formulate it for countersignature according to the procedures for official documents after it is adopted in principle at the executive meeting of the GAC. If there is no objection upon the countersignature, it shall be promulgated in the form of the order of the GAC after being signed by the head of the GAC.
Where a rule as sponsored by any other department under the State Council and jointly formulated with the GAC is not included into the sequence of the orders of the GAC, it shall, after the legal affairs department under the GAC and the competent administrative department under the GAC have given their opinions, be countersigned after being submitted by the legal affairs department under the GAC to the executive meeting of the GAC for deliberation and adoption. Under any special circumstance, the rule shall be subject to approval of the director of the GAC and be signed by the head in charge of the GAC.

   第九条 由海关总署主办并与国务院其他部门联合制定的规章,列入海关总署令序列的,应当在草案经署务会讨论原则通过后,按照公文办理程序送联合制定的部门进行会签。经会签无意见的,应当报署领导签署后以海关总署令形式公布。
由国务院其他部门主办并与海关总署联合制定的规章,不列入海关总署令序列的,经海关总署法制部门会同海关总署业务主管部门提出意见后,由海关总署法制部门提交署务会审议通过后再予会签。特殊情况下,经署长批准,由主管署领导签发。

Section II Approval of Proposals
 第二节 立项


Article 10 The GAC adopts the system of legislative year, which starts from March 1 every year and ends on the last day of February of the following year. The GAC shall formulate the annual legislative plans and determine the legislative proposals of customs rules that need to be formulated or revised based on the legislative year.
   第十条 海关总署实行立法年度制度,每年的3月1日至次年2月最后一日为一个立法年度,按照立法年度制定年度立法计划,确定需要制定、修订的海关规章立法项目。
Article 11 The legal affairs department under the GAC shall be responsible for the drafting, reporting for examination, supervision and inspection of annual legislative plans.
   第十一条 海关总署法制部门负责年度立法计划的拟定、报审、督促检查工作。
Article 12 Where the competent administrative department under the GAC finds it necessary to formulate or revise any customs rule, it shall, before a new legislative year begins, file an application for approval of proposal, and submit it to the legal affairs department under the GAC.
In case a relevant proposal involves the work of two or more departments of the GAC or any other department of the State Council, the department filing the application for approval of proposal shall, when drafting the application for approval of proposal, solicit the opinions of the relevant departments.
   第十二条 海关总署业务主管部门认为需要制定、修订海关规章的,应当在新的立法年度开始前提出立项申请,报海关总署法制部门。
有关项目涉及海关总署多个部门或者国务院其他部门业务的,立项申请部门在拟订立项申请时应当征求相关部门的意见。
Article 13 An application for approval of proposal for the formulation and revision of customs rules shall have a description of such elements as the necessity, feasibility, key issues to be addressed, major systems to be established, project person-in-charge and drafters of the drafting group, and the time when the draft will be completed.
   第十三条 报送制定、修订海关规章的立项申请,应当包括必要性、可行性、拟解决的主要问题、拟确立的主要制度以及起草单位项目负责人、经办人、拟完成起草的时间等内容的说明。
Article 14 The legal affairs department under the GAC shall solicit legislative proposals from the Guangdong branch of the GAC, other customs houses directly under the GAC, and the administrative counterparts when drafting annual legislative plans.
The Guangdong branch of the GAC or any other customs house directly under the GAC shall solicit legislative proposals from the custom houses and enterprises within its jurisdiction and other administrative counterparts before putting forward the legislative proposals of the current year to the legal affairs department under the GAC; when submitting its legislative proposals of the current year to the legal affairs department under the GAC, it shall send a copy to the competent administrative department under GAC at the same time.
When the Guangdong branch of the GAC or any other customs house directly under the GAC submits its legislative proposals in accordance with Paragraph 2 of this article, it shall make an explanation on such matters as the necessity and feasibility of the proposals, key issues to be addressed and major systems to be established.
   第十四条 海关总署法制部门拟定年度立法计划时应当征求广东分署、直属海关及行政相对人的立法建议。
广东分署和直属海关在向海关总署法制部门提出本年度的立法建议前应当征求所辖海关、关区内企业及其他行政相对人的立法建议;向总署法制部门报送本年度立法建议时,应当同时抄报海关总署业务主管部门。
广东分署和直属海关按照本条第二款规定报送立法建议时,应当就建议内容的必要性、可行性、拟解决的主要问题、拟确立的主要制度等事项进行说明。
Article 15 Where any administrative counterpart believes it necessary to formulate or revise any customs rule, he may, before a new legislative year begins, put forward legislative proposals to the legal affairs department under the GAC or any legal affairs department of the customs house directly under the GAC.
The legal affairs department under the GAC or any legal affairs department of the customs house directly under the GAC shall timely investigate and handle the legislative proposals put forward by the administrative counterpart, and feed back the handling results to him in an appropriate manner.
   第十五条 行政相对人认为需要制定、修订海关规章的,可以在新的立法年度开始前向海关总署法制部门或者直属海关法制部门提出立法建议。
海关总署法制部门和直属海关法制部门对行政相对人提出的立法建议应当及时研究处理,并以适当方式向其反馈处理结果。
Article 16 The legal affairs department under the GAC shall collect and bring into line the applications for approval of proposals and legislative proposals for the formulation and revision of customs rules, and draft the annual legislative plans of the GAC, which shall be implemented after they are deliberated and adopted at the executive meeting of the GAC.
For an application for approval of proposals declined, the legal affairs department under the GAC shall timely make an explanation to the department filing the said application.
   第十六条 海关总署法制部门应当对制定、修订海关规章的立项申请及立法建议进行汇总、协调,并拟定海关总署的年度立法计划,经署务会审议通过后执行。
对未采纳的立项申请,海关总署法制部门应当及时向立项申请部门进行说明。
Article 17 The legal affairs department under the GAC shall, according to the annual legislative plans, coordinate the competent administrative department in formulating schemes for the implementation of legislative plans, which include the names of the proposals, drafting departments, persons-in-charge of the proposals, contact persons, the time when the drafting will be completed and the time schedules for all stages, etc.
   第十七条 海关总署法制部门应当根据年度立法计划,协调业务主管部门,制定立法计划实施方案,内容包括项目名称、起草部门、项目负责人、联系人、拟完成时间和各阶段时间安排等。
Article 18 The annual legislative plans shall be implemented in strict accordance with the schemes for the implementation of legislative plans. The legal affairs department under the GAC shall be responsible for supervising, urging and inspecting the implementation of the annual legislative plans, and shall circulate regular notices on the implementation of the annual legislative plans.
The legal affairs department under the GAC shall, before the executive meeting of the GAC deliberates any new annual legislative plan, report the information on the implementation of the annual legislative plans of the previous year; if the legislative proposals of the current year fail to be completed in accordance with the schemes for the implementation of legislative plans, the drafting department shall explain why it failed to complete, the next plans, etc. at the executive meeting of the GAC.
   第十八条 年度立法计划应当严格按照立法计划实施方案执行。海关总署法制部门负责对年度立法计划执行情况进行督促、检查,并定期通报计划执行的情况。
署务会审议新的年度立法计划以前,海关总署法制部门应当就上一年度立法计划的执行情况进行汇报;未按照立法计划实施方案完成当年立法项目的,起草部门应当在署务会议上就未完成的原因及下一步计划等情况作出说明。
Article 19 If it is under any of the following circumstances, the competent administrative department of the GAC may apply for readjusting legislative proposals:
   第十九条 有以下情形之一的,海关总署业务主管部门可以申请对立法项目进行调整:
(1) A customs rule which shall be immediately formulated and promulgated due to emergencies but which fails to be included in the annual legislative plans; or
 (一)未列入年度立法计划,但由于情况紧急,需要立即制定、公布海关规章的;
(2) A proposal that has been included in the annual legislative plans but cannot be completed according to the annual legislative plans due to any major alteration of objective circumstances.
 (二)客观情况发生重大变化,已列入年度立法计划的项目不能按照原定计划完成的。
Article 20 The adjustment of a legislative proposal shall be handled according to the following procedures:
   第二十条 需要调整立法项目的,按照以下程序办理:
(1) The competent administrative department under the GAC files a written application to the legal affairs department under the GAC for adding a legislative proposal or extending the time limit for completing a legislative proposal;
 (一)海关总署业务主管部门向海关总署法制部门提出需要增加立法项目或者立法项目需要延期完成的书面申请;
(2) The legal affairs department under the GAC reexamines the application for adjustment, and drafts a report on altering the legislative plan and reports it to the head of the GAC for examination and approval if it is under any of the circumstances as mentioned in Article 19 of the present Provisions; and
 (二)海关总署法制部门对调整申请进行复核,认为确属本规定第十九条规定情形的,起草关于变更立法计划的签报,报署领导审批;
(3) The legal affairs department under the GAC re-formulates any scheme for the implementation of any legislative plan where the principal of the GAC has approved the adjustment of the legislative plan.

 (三)署领导批准对立法计划进行调整的,由海关总署法制部门重新编制立法计划实施方案。

Section III Drafting
 第三节 起草


Article 21 Comprehensive rules shall be drafted by the legal affairs department under the GAC or the drafting thereof shall be organized by it, and other professional rules shall be drafted by the competent administrative department under the GAC.
The drafting department may, in light of the circumstances, entrust a relevant customs house directly under the GAC for carrying out the specific drafting, and may, when necessary, invite the relevant entities, social groups, experts and scholars to participate in the drafting.
   第二十一条 综合性规章由海关总署法制部门负责起草或者组织起草,其他专业性规章由海关总署业务主管部门负责起草。
起草部门可以根据情况委托直属海关开展具体的起草工作。必要时,可以邀请有关单位、社会团体、专家学者参与起草工作。
Article 22 The department in charge of the drafting shall appoint an administrative leader as the project leader, and appoint at least one staff member who is familiar with both customs businesses and legal knowledge to be specifically responsible for the drafting work.
Where the rule to be drafted involves several departments, the major drafting department shall take the lead, and an joint drafting group may be formed by the staff members jointly appointed by the relevant departments.
   第二十二条 负责起草的部门应当确定一名行政领导为项目负责人,并至少确定一名既熟悉海关业务,同时又熟悉法律知识的人员具体负责起草工作。
起草的规章涉及多个部门时,由主要起草部门负责牵头组织,有关部门共同派人组成联合起草小组。
Article 23 To draft a customs rule, the drafters shall, in light of the circumstances, make legislative investigations so as to have a good understanding of the current status of law enforcement and the problems that exist, and study the advanced experiences both home and abroad, put forward complete and feasible proposals for drafting and write an investigation report.

   第二十三条 起草海关规章应当根据情况进行立法调研,了解执法现状及存在的问题,研究国内外的先进经验,提出完整、可行的起草建议,并完成调研报告。
