Notice of the State Administration of Foreign Exchange on Issues Concerning the Application of Regulation in the Inspection and Handling of Conducts in Violation of Foreign Exchange Administration after the Regulation of the People's Republic of China on Foreign Exchange Administration was Amended
(No. 41 [2008] of the State Administration of Foreign Exchange)
The branches and foreign exchange administrative departments of the State Administration of Foreign Exchange in all provinces, autonomous regions and municipalities directly under the Central Government and the branches of the State Administration of Foreign Exchange in Shenzhen, Dalian, Qingdao, Xiamen and Ningbo,
The State Council amended and announced the Regulation of the People's Republic of China on Foreign Exchange Administration (hereinafter referred to as the Regulation) by Order No. 532 on August 5, 2008. To implement the Regulation and do well in the application and linkup of the Regulation before and after the amendments, you are hereby notified of the following matters:

国家外汇管理局各省、自治区、直辖市分局、外汇管理部，深圳、大连、青岛、厦门、宁波市分局：
2008年8月5日国务院第532号令修订并发布施行了《中华人民共和国外汇管理条例》（以下简称《条例》）。为贯彻落实《条例》，并做好《条例》修订前后法规适用和衔接工作，现就有关事项通知如下：

I. For conducts committed prior to August 5, 2008, those which do not constitute violations of foreign exchange administration according to the Regulation prior to the amendments but constitute violations of foreign exchange administration according to the Regulation after the amendments shall, under the principle of non-retroactivity as prescribed in Article 84 of the Legislation Law of the People's Republic of China, be determined as conducts which do not violate administrative provisions on foreign exchange and are not subject to an administrative punishment.
．．．．．． | | 一、2008年8月5日前发生的行为，根据修订前的《条例》不构成违反外汇管理行为，而根据修订后的《条例》构成违反外汇管理行为的，应当根据《中华人民共和国立法法》第八十四条规定的“不溯及既往”原则，认定该行为不违反外汇管理规定，并不予行政处罚。
