Opinions of the General Office of the State Council on Some Issues about Implementing the Regulation of the People’s Republic of China on the Disclosure of Government Information

The people’s governments of all provinces, autonomous regions and municipalities directly under the Central Government; all the ministries and commissions of the State Council and all the institutions directly under the State Council:

For the purpose of implementing the Regulation of the People’s Republic of China on the Disclosure of Government Information (hereinafter referred to as the Regulation), actively and stably promoting the work of government information disclosure, and safeguarding the legal access to government information by citizens, legal persons and other organizations, upon approval of the State Council, the opinions on some issues concerning the implementation of the Regulation are hereby put forward as follows:

I. Issue concerning the administrative system for government information disclosure
1. All the departments (institutions) under the people’s government at or above the county level shall conduct the work of government information disclosure under the uniform guidance, coordination and supervision of the department in charge of the work of government information disclosure under the people’s government at the same level.

国务院办公厅关于施行《中华人民共和国政府信息公开条例》若干问题的意见
（国办发〔2008〕36号）

各省、自治区、直辖市人民政府，国务院各部委、各直属机构：
　　为有利于贯彻施行《中华人民共和国政府信息公开条例》（以下简称条例），积极稳妥地推进政府信息公开工作，保障公民、法人和其他组织依法获取政府信息，经国务院同意，现就条例施行中的若干问题提出以下意见：

　　一、关于政府信息公开管理体制问题
　　（一）县级以上人民政府各部门（单位）要在本级人民政府信息公开工作主管部门的统一指导、协调、监督下开展政府信息公开工作。
　　（二）实行垂直领导的部门（单位）要在其上级业务主管部门（单位）的领导下，在所在地地方人民政府统一指导、协调下开展政府信息公开工作。实行双重领导的部门（单位）要在所在地地方人民政府的领导下开展政府信息公开工作，同时接受上级业务主管部门（单位）的指导。

　　二、关于建立政府信息发布协调机制问题
　　（三）各级人民政府信息公开工作主管部门要组织、协调有关行政机关建立健全政府信息发布协调机制，形成畅通高效的信息发布沟通渠道。行政机关拟发布的政府信息涉及其他行政机关的，要与有关行政机关沟通协调，经对方确认后方可发布；沟通协调后不能达成一致意见的，由拟发布该政府信息的行政机关报请本级政府信息公开工作主管部门协调解决。
　　（四）根据法律、行政法规和国家有关规定，发布农产品质量安全状况、重大传染病疫情、重大动物疫情、重要地理信息数据、统计信息等政府信息，要严格按照规定权限和程序执行。

　　三、关于发布政府信息的保密审查问题
　　（五）行政机关在制作政府信息时，要明确该政府信息是否应当公开；对于不能确定是否可以公开的，要报有关业务主管部门（单位）或者同级保密工作部门确定。
　　（六）行政机关要严格依照《中华人民共和国保守国家秘密法》及其实施办法等相关规定，对拟公开的政府信息进行保密审查。凡属国家秘密或者公开后可能危及国家安全、公共安全、经济安全和社会稳定的政府信息，不得公开。
　　（七）对主要内容需要公众广泛知晓或参与，但其中部分内容涉及国家秘密的政府信息，应经法定程序解密并删除涉密内容后，予以公开。
　　（八）已经移交档案馆及档案工作机构的政府信息的管理，依照有关档案管理的法律、行政法规和国家有关规定执行。

　　四、关于主动公开政府信息问题
　　（九）各级行政机关特别是国务院各部门（单位）、各省（区、市）人民政府及其部门（单位）要建立健全政府信息主动公开机制，增强工作的主动性和实效性。要充分利用政府网站、政府公报等各种便于公众知晓的方式，及时公开政府信息，并逐步完善政府信息公开目录及网上查询功能，为公众提供优质服务。
　　（十）因政府机构改革不再保留的部门（单位）的政府信息公开工作，由继续履行其职能的部门（单位）负责。

　　五、关于依申请公开政府信息问题
　　（十一）国务院各部门（单位）和地方各级人民政府及其部门（单位）要切实做好依申请公开政府信息的工作。要采取多种方式，方便公民、法人和其他组织申请公开政府信息。特别是设区的市级人民政府及其部门（单位）、县级人民政府及其部门（单位）、乡（镇）人民政府，直接面向基层群众，要充分利用现有的行政服务大厅、行政服务中心等行政服务场所，或者设立专门的接待窗口和场所，为人民群众提供便利，确保政府信息公开申请得到及时、妥善处理。省（区、市）人民政府、国务院各部门（单位）在做好本行政机关依申请公开政府信息工作的同时，要加强对下级政府和部门（单位）的指导。国务院办公厅不直接受理公民、法人和其他组织提出的政府信息公开申请。
　　（十二）行政机关要按照条例规定的时限及时答复申请公开政府信息的当事人。同时，对于可以公开的政府信息，能够在答复时提供具体内容的，要同时提供；不能同时提供的，要确定并告知申请人提供的期限。在条例正式施行后，如一段时间内出现大量申请公开政府信息的情况，行政机关难以按照条例规定期限答复的，要及时向申请人说明并尽快答复。
　　（十三）对于同一申请人向同一行政机关就同一内容反复提出公开申请的，行政机关可以不重复答复。
　　（十四）行政机关对申请人申请公开与本人生产、生活、科研等特殊需要无关的政府信息，可以不予提供；对申请人申请的政府信息，如公开可能危及国家安全、公共安全、经济安全和社会稳定，按规定不予提供，可告知申请人不属于政府信息公开的范围。

　　六、关于监督保障问题
　　（十五）国务院各部门（单位）和地方各级人民政府要抓紧制订完善政府信息公开工作考核办法，明确考核的原则、内容、标准、程序和方式。要建立社会评议制度，把政府信息公开工作纳入社会评议政风、行风的范围，并根据评议结果完善制度、改进工作。
　　（十六）国务院各部门（单位）和地方各级人民政府及其部门（单位）要建立健全分层级受理举报的制度，及时研究解决政府信息公开工作中反映出来的问题。公民、法人或者其他组织认为行政机关不依法履行政府信息公开义务的，可向本级监察机关、政府信息公开工作主管部门举报；对本级监察机关和政府信息公开工作主管部门的处理不满意的，可向上一级业务主管部门、监察机关或者政府信息公开工作主管部门举报。
　　（十七）国务院各部门（单位）和地方各级人民政府要按照《国务院办公厅关于做好施行〈中华人民共和国政府信息公开条例〉准备工作的通知》（国办发〔2007〕54号）的要求，落实业务经费，加强队伍建设。
　　（十八）国务院各部门（单位）和地方各级人民政府可以根据条例的规定，结合本部门（单位）、本地区的实际情况，制定施行条例的具体办法，保证条例的各项规定得到落实。

　　七、关于公共企事业单位的信息公开工作
　　（十九）国务院有关主管部门（单位）要按照条例的要求，把公共企事业单位的信息公开纳入本部门（单位）信息公开工作的总体部署，在2008年10月底前制定具体的实施办法，积极推动公共企事业单位的信息公开工作。同时，要加强对各省（区、市）人民政府有关部门的工作指导，把公共企事业单位信息公开工作全面推向深入。
　　（二十）公共企事业单位要以涉及人民群众切身利益、社会普遍关心的内容为重点，切实做好信息公开工作。要创新公开形式，拓展公开渠道，完善公开制度，全面提高公开工作水平。
