Recently, Chinese Premier Li Keqiang signed a State Council decree issuing the revised Regulations on the Implementation of the Land Administration Law of the People's Republic of China, effective from September 1, 2021. First, the most stringent system for farmland conservation will be implemented. China will put farmland under special protection, define the responsible parties for farmland conservation and impose stricter punishment on illegal acts such as destruction of farmland and refusal to perform the obligation of land reclamation. Second, land expropriation procedures are improved. A pre-announcement system of land expropriation is brought into effect. According to the Regulations, local people's governments at and above the county level should settle land compensations, relocation subsidies and other relevant expenses in time. Third, the protection of legal rights and interests of rural residents concerning homestead are strengthened. The application, examination and approval procedures of homestead are specified. Local governments are required to arrange construction land quota in accordance with law and properly guarantee the rural residents' demands for homestead in a proper manner. Fourth, marketing of commercial collectively-owned land for construction use is standardized. Land users should be determined by means of bidding, auction, listing or agreement, and the parties concerned should conclude a written contract and complete the recordation as required. Fifth, the approval procedures for land use are optimized. Regulators should streamline the process of approval and simplify approval materials, without the need of approval step by step.
