The Proposal of the State Council on Requesting the Standing Committee of the National People's Congress to Make a Decision on Issues Concerning the Qualifications of Members of the Legislative Council of the Hong Kong Special Administrative Region has been deliberated at the 23rd Session of the Standing Committee of the Thirteenth National People's Congress. The aforesaid proposal is made at the request of the Chief Executive of the Hong Kong Special Administrative Region. It is held at the Session that it must be ensured that relevant public officials of the Hong Kong Special Administrative Region (“HKSAR”) including Legislative Council (“LegCo”) members meet the statutory requirements and conditions for upholding the Basic Law of the HKSAR of the People's Republic of China and bearing allegiance to the HKSAR of the People's Republic of China with a view to fully and accurately implementing the “One Country, Two Systems” principle and the Basic Law of the Hong Kong Special Administrative Region of the People's Republic of China, safeguarding China's sovereignty, security, and development interests, and maintaining the lasting prosperity and stability of Hong Kong. To this end, the Standing Committee of the National People's Congress approved the proposal made by the State Council on November 7, 2020, and makes the following decision in accordance with the provisions of Articles 52 and 54 and subparagraph (1) of Article 67 of the Constitution of the People's Republic of China and relevant provisions of the Basic Law of the Hong Kong Special Administrative Region of the People's Republic of China, the Decision of the National People's Congress on Establishing and Improving the Legal System and Enforcement Mechanisms for Safeguarding National Security in the Hong Kong Special Administrative Region and the Law of the People's Republic of China on Safeguarding National Security in the Hong Kong Special Administrative Region, and the Interpretation of Article 104 of the Basic Law of the Hong Kong Special Administrative Region of the People's Republic of China by the Standing Committee of the National People's Congress and the Decision of the Standing Committee of the National People's Congress on the Continuation of Performance of Duties by the Sixth Legislative Council of the Hong Kong Special Administrative Region: | | 第十三屆全國人民代表大會常務委員會第二十三次會議審議了《國務院關于提請就香港特別行政區立法會議員資格問題作出決定的議案》。上述議案是應香港特別行政區行政長官的請求而提出的。會議認為,為了全面准確貫徹落實“一國兩制”方針和《中華人民共和國香港特別行政區基本法》,維護國家主權、安全和發展利益,維護香港長期繁榮穩定,必須確保香港特別行政區有關公職人員包括立法會議員符合擁護中華人民共和國香港特別行政區基本法、效忠中華人民共和國香港特別行政區的法定要求和條件。為此,全國人民代表大會常務委員會同意國務院2020年11月7日提出的議案,根據《中華人民共和國憲法》第五十二條、第五十四條、第六十七條第一項的規定和《中華人民共和國香港特別行政區基本法》、《全國人民代表大會關于建立健全香港特別行政區維護國家安全的法律制度和執行機制的決定》、《中華人民共和國香港特別行政區維護國家安全法》的有關規定以及《全國人民代表大會常務委員會關于〈中華人民共和國香港特別行政區基本法〉第一百零四條的解釋》、《全國人民代表大會常務委員會關于香港特別行政區第六屆立法會繼續履行職責的決定》,作出如下決定: |
