| For the purposes of conscientiously implementing the various decisions and arrangements made by the CPC Central Committee and the State Council on strengthening intellectual property right protection, fully improving patent quality, ensuring the realization of the legislative purpose of encouraging real innovative activities of the Patent Law, and abiding by the principle of good faith, the China National Intellectual Property Administration (“CNIPA”) has developed the Measures for Regulating Patent Application Activities, which are hereby issued and shall come into force on the date of issuance. | | 為認真貫徹落實黨中央、國務院關于加強知識產權保護的各項決策部署，全面提高專利質量，確保實現專利法鼓勵真實創新活動的立法宗旨，恪守誠實信用原則，國家知識產權局制定《關于規範申請專利行為的辦法》，現予發布，自發布之日起施行。 |

| Measures for Regulating Patent Application Activities | | 關于規範申請專利行為的辦法 |
| Article 1 For the purposes of resolutely cracking down on the various abnormal patent application activities which violate the legislative purpose of the Patent Law and the principle of good faith, these Measures are developed in accordance with the Patent Law and the Detailed Rules for the Implementation thereof, the Regulation on Patent Agency and other relevant laws and regulations. Abnormal patent application activities and abnormal patent applications shall be strictly examined and handled in accordance with these Measures. | | 第一條 為堅決打擊違背專利法立法宗旨、違反誠實信用原則的各類非正常申請專利行為，依據專利法及其實施細則、專利代理條例等有關法律法規，制定本辦法。對于非正常申請專利行為及非正常專利申請，按照本辦法嚴格審查和處理。 |
| Article 2 For the purpose of these Measures, “abnormal patent application activities” means any entities or individuals' acts of submitting, separately or in collusion with others, various patent applications, representing the principals in patent application, or transferring rights to apply for patents or patent rights, among others, not for the purpose of protecting innovations, not based on real innovation and creation activities, and for the purpose of seeking illegitimate interests or fabricating innovation performance and service performance. | | 第二條 本辦法所稱非正常申請專利行為是指任何單位或者個人，不以保護創新為目的，不以真實發明創造活動為基礎，為牟取不正當利益或者虛構創新業績、服務績效，單獨或者勾聯提交各類專利申請、代理專利申請、轉讓專利申請權或者專利權等行為。 |
