| Provisions of the Supreme People's Court on Dealing with Compensation for Damage to the Property Arising from Cases Involving Collision and Contact in Respect of Vessels | | 最高人民法院關于審理船舶碰撞和觸碰案件財產損害賠償的規定 |
| (Deliberated and adopted at the 735th Session of the Judicial Committee of the Supreme People's Court on October 18, 1995, and amended according to the Decision of the Supreme People's Court on Amending 29 Judicial Interpretations Concerning Commercial Issues Including the Official Reply of the Supreme People's Court on Issues Including Whether a Bankrupt Enterprise's Right to Use of Allotted State-Owned Land Shall Be Grouped as Insolvent Property adopted at the 1823rd Session of the Judicial Committee of the Supreme People's Court on December 23, 2020) | | （1995年10月18日最高人民法院審判委員會第735次會議討論通過，根據2020年12月23日最高人民法院審判委員會第1823次會議通過的《最高人民法院關于修改〈最高人民法院關于破產企業國有劃撥土地使用權應否列入破產財產等問題的批複〉等二十九件商事類司法解釋的決定》修正） |
| The provisions on dealing with compensation for damage to the property arising from cases involving collision and contact in respect of vessels are set forth as follows in accordance with the relevant provisions of the Civil Code of the People's Republic of China and the Maritime Law of the People's Republic of China, in light of the maritime trial practice in China, and by reference to the international practice: | | 根據《中華人民共和國民法典》和《中華人民共和國海商法》的有關規定，結合我國海事審判實踐並參照國際慣例，對審理船舶碰撞和觸碰案件的財產損害賠償規定如下： |
| I. A claimant may claim for compensation for losses in relation to the property as a result of a collision or contact at issue, relevant expenses and losses occurred in succession after such collision or contact, reasonable expenses and losses incurred for preventing or mitigating damage, and any losses of expected interests. | | 一、請求人可以請求賠償對船舶碰撞或者觸碰所造成的財產損失，船舶碰撞或者觸碰後相繼發生的有關費用和損失，為避免或者減少損害而產生的合理費用和損失，以及預期可得利益的損失。 |
| However, any losses, or any increase in the existing losses, as a result of the claimant's fault shall not be recoverable. | | 因請求人的過錯造成的損失或者使損失擴大的部分，不予賠償。 |
| II. Compensation shall be intended to restore the property concerned to its original state to the maximum extent, or if not, made by evaluating such property in terms of money based on the fair market price. | | 二、賠償應當盡量達到恢複原狀，不能恢複原狀的折價賠償。 |
| III. The compensation for damage to a vessel can be classified into two categories, i.e., for total loss and for partial loss. | | 三、船舶損害賠償分為全損賠償和部分損害賠償。 |
| 1. Compensation for total loss of a vessel covers: | | （一）船舶全損的賠償包括： |
| The loss in the vessel's value; | | 船舶價值損失； |
| Losses in respect of items that are not covered in the vessel's value, including fuels, materials, spare parts and supplies on the vessel, and, in the case of a fishing vessel, fishing equipment, nets and fishing gear on it; and | | 未包括在船舶價值內的船舶上的燃料、物料、備件、供應品，漁船上的捕撈設備、網具、漁具等損失； |
| Crew members' wages and repatriation expenses, as well as other reasonable expenses. | | 船員工資、遣返費及其他合理費用。 |
| 2. Compensation for partial loss of a vessel covers: reasonable temporary repair costs, permanent repair costs, auxiliary expenses and maintenance expenses regarding the vessel, provided that the following conditions shall be met: | | （二）船舶部分損害的賠償包括：合理的船舶臨時修理費、永久修理費及輔助費用、維持費用，但應滿足下列條件： |
| A vessel shall be repaired nearby, unless the claimant is able to prove that repair elsewhere may reduce more losses and save more expenses, or there are other reasonable reasons. If a vessel can continue to operate after temporary repair, the claimant shall be obligated to conduct temporary repair. | | 船舶應就近修理，除非請求人能證明在其他地方修理更能減少損失和節省費用，或者有其他合理的理由。如果船舶經臨時修理可繼續營運，請求人有責任進行臨時修理； |
| When a vessel's damaged part resulting from a collision is repaired concurrently with the repair conducted by the claimant for guaranteeing the vessel's seaworthiness or due to other accidents, or the routine repair of the vessel, compensation shall be limited to the expenses required for repairing such damaged part and the losses in relation thereto. | | 船舶碰撞部位的修理，同請求人為保證船舶適航，或者因另外事故所進行的修理，或者與船舶例行的檢修一起進行時，賠償僅限于修理本次船舶碰撞的受損部位所需的費用和損失。 |
| 3. Compensation for damage to a vessel also covers: | | （三）船舶損害賠償還包括： |
| reasonable rescue expenses, survey, salvage and removal costs for a sunken vessel, and expenses for setting signs for a sunken vessel; | | 合理的救助費，沉船的勘查、打撈和清除費用，設置沉船標志費用； |
| towage, loss of hire or freight for the current voyage, and general average contribution; | | 拖航費用，本航次的租金或者運費損失，共同海損分攤； |
| reasonable loss for detention; and | | 合理的船期損失； |
| other reasonable expenses. | | 其他合理的費用。 |
| IV. Compensation for damage to the property on a vessel covers: | | 四、船上財產的損害賠償包括： |
| the loss of the property on a vessel or its depreciation as a result of partial damage thereto; | | 船上財產的滅失或者部分損壞引起的貶值損失； |
| reasonable repair or handling expenses; | | 合理的修複或者處理費用； |
| reasonable rescue, salvage and removal expenses concerning the property, and general average contribution; and | | 合理的財產救助、打撈和清除費用，共同海損分攤； |
| other reasonable expenses. | | 其他合理費用。 |
| V. Compensation for damage to facilities caused by a contact of a vessel with such facilities covers: | | 五、船舶觸碰造成設施損害的賠償包括： |
