| Chapter I General Provisions | | 第一章 總 則 |
| Article 1 For the purposes of advancing in an overall manner the renovation, upgrading and decommissioning of wind farms, encouraging technological progress, improving the resource utilization efficiency and level of power generation of wind farms, promoting the high-quality development of the wind power industry, and assisting in the realization of carbon dioxide peaking and carbon neutrality, these Measures are developed in accordance with the Renewable Energy Law of the People's Republic of China, the Catalogue of Investment Projects Subject to Government Confirmation (2016 Version), the Measures for the Supervision and Administration of Electric Power Business Licenses, and the Measures for the Administration of Cancellation of Electric Power Business Licenses. | | 第一條 為統籌推進風電場改造升級和退役管理工作，鼓勵技術進步，提高風電場資源利用效率和發電水平，推進風電產業高質量發展，助力實現碳達峰碳中和，根據《中華人民共和國可再生能源法》、《政府核准的投資項目目錄（2016年本）》、《電力業務許可證監督管理辦法》和《電力業務許可證注銷管理辦法》，制定本辦法。 |
| Article 2 For the purpose of these Measures, “renovation and upgrading of wind farms” means the replacement or technological transformation of on-site wind turbines, supporting step-up substations, on-site collector lines, and other facilities, which is generally divided into two types, namely, renovation for capacity expansion and renovation with capacity unchanged. | | 第二條 本辦法所稱風電場改造升級，是指對場內風電機組、配套升壓變電站、場內集電線路等設施進行更換或技術改造，一般分為增容改造和等容改造兩種。 |
| For the purpose of these Measures, “decommissioning of wind farms” means dismantling all wind farm facilities after wind turbines are disconnected from the power grid once and for all, and cancelling the power generation licenses in question as required and restoring the ecology and environment. | | 本辦法所稱風電場退役，是指一次性解列風電機組後拆除風電場全部設施，並按要求注銷發電許可證，修複生態環境。 |
| Wind farms that have conducted grid-connected operations for 15 years or more, with a single turbine capacity of less than 1.5 megawatts, shall be encouraged to be renovated and upgraded, and the wind farms that have reached the end of the designed service life for grid-connected operations shall be decommissioned, and those meeting the safe operation conditions may continue to operate upon safe operation assessment. | | 鼓勵並網運行超過15年或單台機組容量小于1.5兆瓦的風電場開展改造升級，並網運行達到設計使用年限的風電場應當退役，經安全運行評估，符合安全運行條件可以繼續運營。 |
| Article 3 The administration of wind farm renovation, upgrading and decommissioning shall be organized and implemented under the principles of being fair, voluntary, advanced and efficient, giving priority to the ecology, and ensuring orderly implementation and security. | | 第三條 風電場改造升級和退役管理工作按照公平自願、先進高效、生態優先、有序實施、確保安全的原則組織實施。 |
| Article 4 The NEA shall, in conjunction with relevant departments, be responsible for the overall administration of the renovation, upgrading and decommissioning of wind farms across the country according to their respective functions. All provincial energy departments shall, in conjunction with other relevant departments, be responsible for organizing and implementing the renovation, upgrading and decommissioning of wind farms within their administrative regions according to their respective functions. The local offices of the NEA shall be responsible for regulating the renovation, upgrading and decommissioning of wind farms within their respective jurisdictions. Power grid enterprises shall be responsible for the reconstruction and expansion of supporting transmission projects for the renovation and upgrading of wind farms, the demolishment of the supporting transmission projects for decommissioned wind farms, and ecological restoration. Power generation enterprises shall specifically implement the renovation, upgrading and decommissioning of wind farms and the ecological restoration, strengthen the whole-process security management during the implementation of the work, and be subject to quality supervision as required. | | 第四條 國家能源局會同有關部門按職責負責統籌管理全國風電場改造升級和退役。各省級能源主管部門會同有關部門按職責負責組織實施本行政區域內風電場改造升級和退役。國家能源局派出機構負責監管轄區內風電場改造升級和退役。電網企業負責風電場改造升級配套送出工程的改擴建，拆除退役風電場的配套送出工程以及生態修複。發電企業具體實施風電場改造升級和退役以及生態修複，實施中加強全過程安全管理，並按規定接受質量監督。 |
| Chapter II Organization and Management | | 第二章 組織管理 |
| Article 5 Power generation enterprises shall, based on the operating status of wind farms, conduct demonstration and propose project renovation, upgrading and decommissioning plans, and put forward the requirements to the energy departments at or above the county level at the places where projects are located. | | 第五條 發電企業根據風電場運行情況，論證提出項目改造升級和退役方案，並向項目所在地縣級及以上能源主管部門提出需求。 |
