| For the purposes of protecting resources and the environment and strengthening the export administration of rare metal, the Application Requirements and Procedures for State-Owned Trading Enterprises Exporting Tungsten, Antimony, and Silver from 2024 to 2025 are hereby announced, in accordance with the relevant provisions of the Foreign Trade Law of the People's Republic of China and the Regulation on the Administration of the Import and Export of Goods. | | 为保护资源和环境，加强稀有金属出口管理，根据《中华人民共和国对外贸易法》《中华人民共和国货物进出口管理条例》有关规定，我部制定了《2024—2025年度钨、锑、白银出口国营贸易企业申报条件及申报程序》，现予公布。 |

| Application Requirements and Procedures for State-Owned Trading Enterprises Exporting Tungsten, Antimony, and Silver from 2024 to 2025 | | 2024—2025年度钨、锑、白银出口国营贸易企业申报条件及申报程序 |
| I. Application requirements for a state-owned trading enterprise exporting tungsten | | 一、钨出口国营贸易企业申报条件 |
| 1. Production enterprise | | （一）生产企业。 |
| (1) It has independent legal person status and is offered a credit line of not less than 200 million yuan. | | 1.具有独立法人资格，银行授信额度不低于2亿元人民币。 |
| (2) It has passed ISO 9000 quality system certification. | | 2.通过ISO9000系列质量体系认证。 |
| (3) It abides by the work safety and other relevant laws and regulations of the state and fulfills its work safety responsibilities. It also has purchased various social insurances such as pension, unemployment, medical, work-related injury, and maternity insurance in accordance with the law, fully paid social insurance premiums on time, and passed OHSAS18000/ISO45001 occupational health and safety system certification. | | 3.遵守国家安全生产等有关法律法规，落实安全生产责任。依法参加养老、失业、医疗、工伤、生育等各项社会保险并按期足额缴纳社会保险费，通过OHSAS18000/ISO45001职业健康安全体系认证。 |
| (4) If it is an enterprise that has obtained export qualification, it shall have made actual export of tungsten each year between 2020 and 2022 (if it is an enterprise that is qualified to export as a state-owned trading enterprise after 2020, it shall have made actual export of tungsten each year between the year of qualification and 2022); if it is an enterprise newly applying to export tungsten, its annual average export supply in the past three years shall be not less than 2,000 tons (equivalent to ammonium paratungstate APT). Its actual export shall be included in the customs statistics, while its annual export supply shall form a part of the data reviewed by industry organizations. | | 4.已获得出口资质的企业，2020—2022年每年均有钨出口实绩（2020年以后获得出口国营贸易资格的企业，自获得资格年份至2022年每年均有钨出口实绩）；新申报企业近三年年均出口供货不低于2000吨（相当于仲钨酸铵APT）。出口实绩以海关统计为准，出口供货实绩以经行业组织复核的数据为准。 |
| If its products are listed in the Export Catalogue of High-Tech Products in China issued by the Ministry of Science and Technology, the Ministry of Commerce, the Ministry of Finance, the State Taxation Administration, and the General Administration of Customs, or the Catalogue of Chinese High-Tech Products issued by the Ministry of Science and Technology, or high-tech products determined by the Ministry of Science and Technology, the criteria may be lowered appropriately according to the specific conditions of such products. | | 凡企业所产产品为科技部、商务部、财政部、税务总局、海关总署发布的《中国高新技术产品出口目录》或科技部发布的《中国高新技术产品目录》中所列产品，或经科技部认定的高新技术产品，可视产品具体情况适当降低标准。 |
| (5) It has obtained the ISO14000 environmental management system certification. | | 5.获得ISO14000系列环境管理体系认证。 |
| (6) It conducts business operations in compliance with the laws and regulations, complies with the laws and regulations in terms of work safety, environmental protection, tax, customs, and foreign exchange management, and has no record of violations of laws and regulations that have not been rectified. | | 6.企业合法依规经营，符合安全生产、环保、税务、海关和外汇管理法律法规，无未整改违法违规行为。 |
| 2. Circulation enterprise | | （二）流通企业。 |

| (2) It has made actual export of tungsten each year between 2020 and 2022 (which is included in the customs statistics). | | 2.2020—2022年每年均有钨出口实绩（以海关统计为准）。 |
