| Huang[REDACTED] Chemical & Pharmaceutical Co., Ltd. (hereinafter referred to as the "Huang[REDACTED] Company") and the persons who were not parties to the case Suzhou You[REDACTED] Technology Co., Ltd. (hereinafter referred to as the "You[REDACTED] Company") and Jiangsu Jia[REDACTED] Pharmaceutical Co., Ltd. (hereinafter referred to as the "Jia[REDACTED] Company") (collectively referred to as the "three companies involved in the case") are the only three companies actually manufacturing the API camphor in China at the time when the alleged monopolistic practice occurred. In particular, Huang[REDACTED] Company and You[REDACTED] Company manufacture synthetic camphor and Jia[REDACTED] Company manufactures natural camphor. Upon receipt of clues to tip-offs that the three companies involved in the case were suspected of monopoly, the Administration for Market Regulation of [REDACTED] Province launched an investigation into them and issued an administrative penalty decision on May 31, 2021. It ascertained that the three companies involved in the case reached and implemented a horizontal monopolistic agreement, ordered Huang[REDACTED] Company to cease the unlawful act, confiscated its illegal gains, and imposed a fine amounting to 5% of its sales volume of the previous year on it. Huang[REDACTED] Company refused to accept the aforesaid administrative penalty decision and applied for administrative reconsideration. The SAMR affirmed the administrative penalty decision upon administrative reconsideration. Huang[REDACTED] Company filed an administrative lawsuit, requesting revocation of the administrative penalty decision and the administrative reconsideration decision. The court of first instance ruled to dismiss the claim of Huang[REDACTED] Company. Huang[REDACTED] Company refused to accept the judgment of first instance and appealed. | | 黄某化工药业有限公司（简称黄某公司）与案外人苏州优某科技有限公司（简称优某公司）、江苏嘉某制药有限公司（简称嘉某公司，上述三家公司统称涉案三家公司）系被诉垄断行为发生时我国境内仅有的实际生产原料药樟脑的三家企业，其中黄某公司、优某公司生产合成樟脑，嘉某公司生产天然樟脑。某省市场监督管理局在接到涉嫌垄断的举报线索后，对涉案三家公司及相关企业展开调查，并于2021年5月31日作出行政处罚决定，认定涉案三家公司达成并实施了横向垄断协议，责令黄某公司停止违法行为，没收违法所得，并处上一年度销售额5%的罚款。黄某公司不服，申请行政复议。国家市场监督管理总局复议后予以维持。黄某公司提起行政诉讼，请求撤销行政处罚决定和行政复议决定。一审法院判决驳回黄某公司的诉讼请求。黄某公司不服，提起上诉。 |
