| From 2017 to 2020, by taking advantage of the positions as persons-in-charge of the Nanjing and Suzhou business departments of [REDACTED] State-owned Trust Company and the position as manager of the business department of [REDACTED] State-owned Trust Company, defendants Li [REDACTED] and Xu [REDACTED] entrusted a fund pool trust plan of [REDACTED] State-owned Trust Company to Suzhou [REDACTED] Company for underwriting, and arranged for the trust plan financier to enter into an entrusted sales agreement with Suzhou [REDACTED] Company, thereby obtaining huge profits for the Company. From 2018 to 2022, in collusion with Shen [REDACTED], actual controller of Suzhou [REDACTED] Company, Li [REDACTED] and Xu [REDACTED] illegally accepted the property offered by Shen [REDACTED] by means of running a company in partnership with Shen [REDACTED] and participating in the distribution of the company's profit without actually contributing any capital. In particular, Li [REDACTED] accepted property in the total amount of more than 14.35 million yuan, of which 800,000 yuan had not been actually acquired; and Xu [REDACTED] accepted property in the total amount of over 14.31 million yuan. | | 2017年至2020年，被告人李某利用担任某国有信托公司南京、苏州业务部门负责人等职务上的便利，被告人徐某利用担任某国有信托公司业务部门经理职务上的便利，将某国有信托公司集合资金信托计划交由苏州某公司承销，并安排信托计划融资方与苏州某公司签订委托销售协议，为该公司谋取了巨额利益。2018年至2022年，李某、徐某经与苏州某公司实际控制人沈某共谋，在不实际出资情况下，通过与沈某合伙经营公司分配公司利润的方式，非法收受沈某给予的财物。其中，李某收受财物共计1435万余元，80万元尚未实际取得；徐某收受财物共计1431万余元。 |
