Basic Facts 基本案情
Liu [REDACTED] entered into a labor contract with [REDACTED] Technology Company and participated in the induction training. Later, a labor dispute arose between them and the labor relationship was terminated. Liu [REDACTED] then registered a personal account on the Weibo platform and posted insulting, offensive, and defamatory remarks targeting "Zhang [REDACTED], legal representative of [REDACTED] Technology Company," "[REDACTED] Technology Company," and "Human Resources Department of [REDACTED] Technology Company" for a long time and uploaded screenshots containing the account of "[REDACTED] Technology Company" in the images attached to the relevant Weibo posts. Some content posted in the account on the Weibo contained the location of [REDACTED] Technology Company. [REDACTED] Technology Company filed a lawsuit with the court and claimed that Liu [REDACTED] should immediately cease his infringing acts and issue a public statement on the Weibo platform to extend a formal apology to [REDACTED] Technology Company. 刘某与某科技公司签订劳动合同并参加入职培训,后双方产生劳动纠纷,解除了劳动关系。刘某遂在微博平台注册个人账号,长期发布针对“某科技公司法定代表人张某”“某科技公司”“某科技公司人事部”等主体的侮辱性、攻击性、贬损性言论,并且在相关微博的配图中上传包含“某科技公司”账号的截图,在该账户发布的部分微博内容中包含某科技公司的定位。某科技公司诉至法院,要求刘某立即停止侵权行为,并在微博平台公开发布声明向公司赔礼道歉。
