Chapter I General Provisions
| | 第一章 总则
|
Article 1 These Regulations are formulated for the purposes to standardize the administration of the surveying and mapping fruits, to set up the sharing mechanism for the resources of surveying and mapping fruits and to promote the surveying and mapping work for the services of the national economic and the social development in accordance with the Law of the People's Republic of China on Surveying and Mapping and the relevant laws, rules and regulations and in combination of the actual situations of Shaanxi Province.
| | 第一条 为了规范测绘成果管理行为，建立测绘成果资源共享机制，促进测绘工作为国民经济和社会发展服务，根据《中华人民共和国测绘法》和有关法律、行政法规，结合本省实际，制定本条例。

Article 2 These Regulations shall apply to the collection and submittal, administration and use of the surveying and mapping fruits in the administrative region of Shaanxi Province, except as otherwise provided for in laws and administrative rules and regulations.
| | 第二条 本省行政区域内的测绘成果的汇交、管理和使用，适用本条例。法律、行政法规另有规定的除外。

Article 3 The term “Surveying and Mapping Fruits” as mentioned in these Regulations shall be divided into the Basic Surveying and Mapping Fruits and the Professional Surveying and Mapping Fruits, including the following results achieved on the land, water areas and inter-space within the administrative region of Shaanxi Province:
| | 第三条 本条例所称测绘成果分为基础测绘成果和专业测绘成果，包括在本省行政区域内的陆地、水域和空间测绘完成的下列成果：

(1) Mother earth surveying data and the relevant information;
| | （一）大地测量数据及其相关资料；
|
(2) Film negatives and data obtained from photographic and remote sensing surveying;
| | （二）摄影、遥感测量获取的底片、数据；
|
(3) Topographic maps, cadastral maps, general maps and thematic maps;
| | （三）地形图、地籍图、普通地图和专题地图；
|
(4) Engineering surveying data and their related information; and
| | （四）工程测量数据及其相关资料；
|
(5) Other geographic information and data.
The term “Basic Surveying and Mapping Fruits” as mentioned in these Regulations shall refer to the Surveying and Mapping Fruits such as the control network, the basic maps, the primary geographical information system and so on formed during the geodetic surveying organized and carried out by the administrative superintending department of surveying and mapping for the purposes to provide the basic geographical information for the national economic and social development as well as for various specialized departments and professional surveying and mapping; the term “Professional Surveying and Mapping Fruits” shall refer to the Surveying and Mapping Fruits with specialized contents accomplished by various specialized departments and units in order to meet the business requirements other than the basic Surveying and Mapping Fruits.
| | （五）其他地理信息数据。
本条例所称基础测绘成果，是指为国民经济和社会发展以及各专业部门、专业测绘提供基础地理信息，由测绘行政主管部门组织实施所形成的大地测量控制网、基本地图、基础地理信息系统等测绘成果；专业测绘成果，是指除基础测绘成果以外，各专业部门、单位为业务需要完成的具有专业内容的测绘成果。

Article 4 Surveying and Mapping Fruits shall be put into practice on the principles of free collection and submittal, unified administration, resource sharing, classified supplying and regular updating.
| | 第四条 测绘成果实行无偿汇交、统一管理、资源共享、分类提供、定期更新的原则。
|
Article 5 The people's governments at or above the levels should carry out the updating regularly for the Basic Surveying and Mapping Fruits in accordance with the situations of the needs of the national economic and social development in their own administrative regions and the natural diversifications, and shall list the expenses needed for the basic surveying and mapping and the fruits updating into the fiscal budget.
| | 第五条 县级以上人民政府应当根据本行政区域国民经济和社会发展需要以及自然变化情况，对基础测绘成果定期进行更新，并将基础测绘及其成果更新所需经费列入财政预算。

Article 6 The bureau of surveying and mapping of Shaanxi Province shall be the administrative superintending department of surveying and mapping of the people's government of Shaanxi Province and be responsible to organize the work for the collection and submittal, the storage, the information services and the supervisions and administration of Surveying and Mapping Fruits in whole Shaanxi Province.
The administrative superintending departments of surveying and mapping appointed by the people's governments of the cities (regions) or counties (cities and districts) shall be responsible for the supervision and administration work of Surveying and Mapping Fruits in their respective administrative regions and shall accept the business guidance from the administrative superintending department of surveying and mapping of Shaanxi Province.
| | 第六条 省测绘局是省人民政府测绘行政主管部门，负责组织全省测绘成果的汇交、储存、信息服务和监督管理工作。
市（地区）、县（市、区）人民政府指定的测绘行政主管部门，负责本行政区域内测绘成果的监督管理工作，并接受省测绘行政主管部门的业务指导。

Chapter II Collection and Submittal of the Fruits
| | 第二章 成果汇交
|
Article 7 The ownership of Surveying and Mapping Fruits shall belong to the entrusting party of the surveying and mapping project or be agreed on according to the contract between the entrusting party of the surveying and mapping project and the surveying and mapping unit. Where there are otherwise provisions in laws, administrative rules and regulations, these provisions shall prevail.
Owners of Surveying and Mapping Fruits shall have their rights to possess, to use, to earn profit from and to dispose of the Surveying and Mapping Fruits in accordance with the provisions of law.
| | 第七条 测绘成果的所有权，属于测绘项目委托方或者由测绘项目委托方与测绘单位按照合同约定。法律、行政法规另有规定的，从其规定。
测绘成果所有权人依照法律规定，对测绘成果享有占有、使用、收益、处分的权利。

Article 8 Upon the completion of their surveying and mapping tasks, the surveying and mapping unit undertaking the basic surveying and mapping missions and the owner of the Professional Surveying and Mapping Fruits shall collect and submit the copy or the catalogue of Surveying and Mapping Fruits to the administration organ of Surveying and Mapping Fruits entrusted by the administrative superintending department of surveying and mapping of Shaanxi Province, as specified in these Regulations,.
．．．．．． | | 第八条 承担基础测绘任务的测绘单位和专业测绘成果所有权人应当在测绘作业完成后，依照本条例规定，向省测绘行政主管部门委托的测绘成果管理机构汇交测绘成果副本或者目录。
