| Announcement on the Redistribution of Import Tariff Quotas of Agricultural Products in 2012 | | 2012年农产品进口关税配额再分配公告 |
| In accordance with the relevant provisions of the Interim Measures for the Administration of Import Tariff Quotas of Agricultural Products (Order No. 4 [2003], the Ministry of Commerce and the National Development and Reform Commission, hereinafter referred to as the “Interim Measures”), the Quantity, Application Conditions and Distribution Principles of Import Tariff Quotas of Grain and Cotton in 2012 (Announcement No. 24 [2011], the National Development and Reform Commission, hereinafter referred to as the “Distribution Principles”), and the Detailed Rules for the Application for and Distribution of Import Tariff Quotas of Sugar in 2012 (Announcement No. 62 [2011], the Ministry of Commerce, hereinafter referred to as the “Detailed Rules for Distribution”), the following matters concerning the redistribution of import tariff quotas of agricultural products in 2012 are hereby announced: | | 根据《农产品进口关税配额管理暂行办法》（商务部、国家发展和改革委员会令2003年第4号，以下简称《暂行办法》）、《2012年粮食、棉花进口关税配额数量、申请条 件和分配原则》（国家发展和改革委员会公告2011年第24 号，以下简称《分配原则》）、《2012年食糖进口关税配额 申请和分配细则》（商务部公告2011年第62号，以下简称 《分配细则》）中的有关规定，现将2012年农产品进口关 税配额再分配的有关事项公告如下： |
| I. Where an end user holding a 2012 import tariff quota of wheat, corn, paddy and rice, sugar, or cotton fails to enter into import contracts in the year for the quantity of the entire quota or has entered into import contracts but expects that goods cannot be shipped from the port of departure before the end of the year, the end user shall, without exception, return, before September 15, the part of quota for which import is not completed or is impossible to the development and reform commission and commerce department (foreign trade and economic cooperation department) of the province (autonomous region, municipality directly under the Central Government, or city under separate state planning) where it is located. The National Development and Reform Commission and the Ministry of Commerce shall redistribute the returned quotas. For the parts not returned before September 15 and not fully used before the end of the year by the end users, the National Development and Reform Commission and the Ministry of Commerce shall deduct them proportionately when distributing import tariff quotas of agricultural products for the following year. | | 一、持有2012年小麦、玉米、稻谷及大米、食糖、棉 花进口关税配额的最终用户，当年未就全部配额数量签订进 口合同，或已签订进口合同但预计年底前无法从始发港出运 的，均应将其持有的关税配额量中未完成或不能完成的部分 于9月15曰前交还所在地的省（自治区、直辖市、计划单 列市）发展改革委、商务厅（外经贸厅）。国家发展改革委、 商务部将对交还的配额进行再分配。对最终用户9月15日前没有交还且年底前未充分使用的配额，国家发展改革委、商务部在分配下一年农产品进口关税配额时按比例相应扣 减。 |
