| For the purposes of profoundly implementing the major decisions and decisions of the CPC Central Committee with Comrade Xi Jinping at its core on strengthening the rule of law from an international perspective, implementing the Opinions of the CPC Central Committee on Strengthening Adjudication Work in the New Era, and providing high-quality foreign-related judicial services and safeguards for the joint pursuit of the Belt and Road Initiative and a high level of opening up, the following opinions are hereby offered regarding strengthening the development of international commercial courts of the people's courts. | | 为深入贯彻以习近平同志为核心的党中央关于加强涉外法治建设的重大决策部署，落实《中共中央关于加强新时代审判工作的意见》，以高质量涉外司法审判服务保障共建“一带一路”和高水平对外开放，现就加强人民法院国际商事法庭建设提出如下意见。 |
| I. Upholding the Correct Political Orientation and Fully Understanding the Overall Requirements for the High-Quality Development of International Commercial Courts | | 一、坚持正确政治方向，深刻把握国际商事法庭高质量发展的总体要求 |
| 1. Guiding ideology and development objectives. Guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, Xi Jinping Thought on the Rule of Law shall be thoroughly implemented. In accordance with the requirement for the coordinated advancement of the rule of law from both the domestic and the international perspectives, international commercial dispute resolution mechanisms commensurate with high-quality development and a high level of opening up shall be developed, to foster a world-class business environment that is stable, fair, transparent, and predictable and that is market-oriented, based on the rule of law, and internationalized and gradually build China into a preferred destination for international commercial dispute resolution. | | 1.指导思想和发展目标。坚持以习近平新时代中国特色社会主义思想为指导，深入贯彻落实习近平法治思想，按照统筹推进国内法治和涉外法治的要求，建设同高质量发展、高水平开放相适应的国际商事纠纷解决机制，助力营造稳定公平透明可预期的市场化、法治化、国际化一流营商环境，逐步把我国建设成为国际商事争端解决优选地。 |
| 2. Coordinated guidance and collaborative development. The Supreme People's Court shall strengthen supervision and guidance of foreign-related commercial adjudication to continuously improve the quality and efficiency of foreign-related commercial adjudication and promote high-quality development of international commercial courts. Systematic planning shall be conducted regarding measures and implementation approaches for the coordinated development of the China International Commercial Court and the international commercial courts of local courts, with a view to establishing an international commercial dispute resolution framework that is rationally structured, impartial, efficient, distinctly featured, and accessible in services, to enhance the international influence of China's international commercial courts. | | 2.统筹指导和协同发展。加大最高人民法院对涉外商事审判工作的监督指导力度，不断提升涉外商事审判质效，促推国际商事法庭高质量发展。系统谋划最高人民法院国际商事法庭和地方法院国际商事法庭协同发展的举措和路径，形成布局合理、公正高效、特色鲜明、服务便捷的国际商事纠纷解决格局，扩大我国国际商事法庭的国际影响力。 |
| II. Innovating and Improving Adjudication Mechanisms to Sustainably Enhance the Quality and Efficiency of International Commercial Adjudication | | 二、创新完善审判机制，持续推进国际商事审判提质增效 |
| 3. Optimizing the case jurisdiction mechanism. The exemplary and leading role of international commercial courts shall be leveraged. The judicial adjudication system whereby parties to foreign-related civil relations lawfully agree on jurisdiction shall be improved. Model clauses for foreign-related jurisdiction agreements shall be formulated. Procedural rules governing the elevation of jurisdiction by the China International Commercial Court over cases that are highly complex, difficult, or of significant impact shall be refined. The Judicial Interpretation of the Civil Procedure Law shall be amended and improved to further optimize mechanisms for foreign-related jurisdiction and properly address parallel litigation and jurisdictional conflicts, to provide stable and predictable rule-of-law safeguards for cross-border transactional disputes. | | 3.优化案件管辖机制。发挥国际商事法庭的示范引领作用，完善涉外民事关系当事人依法约定管辖的司法审判制度，制定涉外协议管辖示范条款，完善最高人民法院国际商事法庭提级管辖疑难复杂、有重大影响案件的程序规范。修改完善民事诉讼法司法解释，进一步优化涉外管辖机制，妥善处理平行诉讼和管辖冲突，为跨境交易纠纷提供稳定可预期的法治保障。 |
| 4. Improving the case management mechanism. The mechanism for pre-trial conferences, the consultation mechanism for trial operations of international commercial courts, and the long-term mechanisms for discovering, nurturing, submitting, and archiving exemplary cases shall be improved. Unified case process management standards and court hearing operation standards shall be formulated, to establish a comprehensive case management system of international commercial courts which features refined procedures, professional operations, and standardized practices throughout the entire process. The implementation of quality-focused strategies shall be deepened to further enhance the reasoning quality and transparency of judgments rendered by international commercial courts, with a view to producing a number of guiding representative cases that propel the development of rule of law from an international perspective and provide guidance on legal rules. | | 4.完善案件管理机制。完善案件审前会议机制、国际商事法庭审判业务会商机制以及优秀案例发掘、培育、报送和入库长效机制。制定统一的案件流程管理规范、庭审工作规范等，形成国际商事法庭全流程精细化、专业化、标准化的案件管理体系。深化实施精品战略，进一步提升国际商事法庭裁判文书说理质量和透明度，形成一批推动涉外法治建设、有规则指导意义的典型案例。 |
| 5. Improving the litigation facilitation mechanism. The Convention Abolishing the Requirement of Legalization for Foreign Public Documents shall be duly applied to streamline the certification procedures for foreign public documents used as evidence. Efficiency in cross-border evidentiary material exchange and authentication of powers of attorney shall be improved, including through video-conference witnessing or similar means. Uniform templates shall be adopted for English translations of frequently used foreign-related judicial instruments and litigation procedural guidelines. The digital transformation of international commercial courts shall be boosted to meet the judicial needs of domestic and foreign parties across multiple scenarios, languages, and jurisdictions, through cooperation with relevant countries. | | 5.健全诉讼便利机制。准确适用《取消外国公文书认证要求的公约》，简化域外公文书证据证明手续。通过视频见证等方式，提高办理证据材料跨境流转、当事人授权委托等工作效率。统一常用涉外司法文书、诉讼程序指引等英文译本的样式。推进国际商事法庭信息化建设，在与有关国家合作的基础上，满足中外当事人多场景、多语种、多法域的司法需求。 |
