| Article 1 For the purposes of strengthening the protection of water sources of the Miyun Reservoir, advancing the green development of the Miyun Reservoir Basin, coordinating surface water and groundwater, local water and externally transferred water, and guaranteeing the water security of the capital with multiple water sources, this Regulation is developed. | | 第一条 为了加强密云水库水源保护，促进密云水库流域绿色发展，统筹地表水与地下水、当地水与外调水，多水源保障首都水安全，制定本条例。 |
| Article 2 This Regulation shall apply to the water source protection and related activities of the Miyun Reservoir and its upstream rivers, including the main streams and significant tributaries of the Chaohe River and the Baihe River. | | 第二条 本条例适用于密云水库及其上游潮河、白河干流和重要支流的水源保护及相关活动。 |
| The Miyun Reservoir Basin referred to in this Regulation refers to the relevant administrative regions at the township level in Miyun District, Huairou District and Yanqing District of Beijing, and in Chicheng County, Guyuan County, Luanping County, Xinglong County, and Fengning Manchu Autonomous County of Hebei Province, which are involved in the Miyun Reservoir and its upstream rivers, including the main streams and significant tributaries of the Chaohe River and the Baihe River. The aforesaid important tributaries and the relevant township-level administrative regions are determined by the People's Government of Beijing Municipality and the People's Government of Hebei Province. | | 本条例所称密云水库流域，是指密云水库及其上游潮河、白河干流和重要支流涉及的北京市密云区、怀柔区、延庆区和河北省赤城县、沽源县、滦平县、兴隆县、丰宁满族自治县的相关乡级行政区域。前述重要支流和相关乡级行政区域由北京市人民政府、河北省人民政府确定。 |
| Article 3 The protection of water sources of the Miyun Reservoir shall follow the principles and policies, decisions and deployments of the Party and the state, be based on the main functional positioning of the Miyun Reservoir Basin, adhere to prioritizing protection and coordinating protection and development, adhering to source control and systematic governance, strengthening regional collaboration and interaction, and achieve the unity of water source protection, green development, and improvement of people's livelihood. | | 第三条 密云水库水源保护应当贯彻党和国家路线方针政策、决策部署，立足密云水库流域主体功能定位，坚持保护优先、统筹保护与发展，坚持源头控制、系统治理，强化区域协同联动，实现水源保护、绿色发展、民生改善相统一。 |
| The protection of water sources of the Miyun Reservoir shall be combined with the comprehensive improvement of the flood control and other disaster prevention and mitigation capabilities in the Miyun Reservoir Basin. | | 密云水库水源保护应当与全面提升密云水库流域防洪等防灾减灾救灾能力相结合。 |
| Article 4 the People's Government of Beijing Municipality and the People's Government of Hebei Province shall closely cooperate each other, strengthen the coordination of the protection of water sources of the Miyun Reservoir, resolve major problems in the work, and supervise and inspect the implementation of the work. | | 第四条 北京市人民政府、河北省人民政府应当密切协作，加强对密云水库水源保护工作的统筹，协调解决工作中的重大问题，督促检查工作落实情况。 |
| The local People's Government of the Miyun Reservoir Basin shall be responsible for the work of the protection of water sources of the Miyun Reservoir within its administrative region. The relevant departments at or above the county-level of the local People's Government of the Miyun Reservoir Basin shall be responsible for the related work of the protection of water sources of the Miyun Reservoir within their administrative regions. | | 密云水库流域地方人民政府负责本行政区域内密云水库水源保护工作。密云水库流域县级以上地方人民政府有关部门按照职责分工负责本行政区域内密云水库水源保护相关工作。 |
| The competent departments of ecology and environment, water administration, natural resources, and agriculture and rural affairs of the State Council shall strengthen work coordination, increase support for the work of the protection of water sources of the Miyun Reservoir, and strengthen guidance and supervision over the work of the protection of water sources of the Miyun Reservoir in accordance with the provisions of the laws and administrative regulations, and the division of responsibilities. | | 国务院生态环境、水行政、自然资源、农业农村等主管部门应当加强工作协同，加大对密云水库水源保护工作的支持力度，并依照法律、行政法规规定和职责分工，加强对密云水库水源保护工作的指导监督。 |
| Article 5 The People's Government of Beijing Municipality and the People's Government of Hebei Province shall jointly develop the overall plan for the protection of water sources of the Miyun Reservoir, and specify the work goals, key tasks, guarantee measures, implementation mechanisms and other matters. | | 第五条 北京市人民政府、河北省人民政府应当共同制定密云水库水源保护总体方案，明确工作目标、重点任务、保障措施、落实机制等事项。 |
| Article 6 The people's governments at or above the county level in the Miyun Reservoir Basin shall prepare the territorial spatial plans of their administrative regions, fully consider the needs of the protection of water sources of the Miyun Reservoir and implement the requirements for the protection of water sources of the Miyun Reservoir. | | 第六条 密云水库流域县级以上地方人民政府编制本行政区域国土空间规划，应当充分考虑密云水库水源保护需要，落实密云水库水源保护要求。 |
| Article 7 The industrial structure and layout of the Miyun Reservoir Basin shall be adapted to the requirements for the ecosystem of the basin, the resource and environmental carrying capacity, and the protection of water sources of the Miyun Reservoir. | | 第七条 密云水库流域产业结构和布局应当与流域生态系统、资源环境承载能力以及密云水库水源保护要求相适应。 |
| The people's governments at or above the county level of the Miyun Reservoir Basin shall accelerate the adjustment to the industrial structure and the optimization of the layout of the Miyun Reservoir Basin, strengthen the management of various development and construction activities according to the law in accordance with the main functional positioning of the Miyun Reservoir Basin, and strictly prohibit all kinds of development and construction activities that do not conform to the main functional positioning. | | 密云水库流域县级以上地方人民政府应当加快密云水库流域产业结构调整和布局优化，按照密云水库流域主体功能定位，依法加强对各类开发建设活动的管理，严禁不符合主体功能定位的各类开发建设活动。 |
| Article 8 The people's governments at or above the county level of the Miyun Reservoir Basin shall, in accordance with the requirements for the protection of water sources of the Miyun Reservoir, strictly control the total water consumption and intensity, and implement water resource control indicators. | | 第八条 密云水库流域县级以上地方人民政府应当结合密云水库水源保护要求，严格用水总量和强度控制，落实水资源管控指标。 |
| Article 9 The People's Government of Beijing Municipality and the People's Government of Hebei Province shall conduct investigations, traceability analysis, and research on the migration and transformation rules of the sources of major water pollutants in the Miyun Reservoir Basin, jointly determine the key areas, regions, and main measures for controlling major water pollutants, and incorporate them into the relevant local plans of the Miyun Reservoir Basin. | | 第九条 北京市人民政府、河北省人民政府应当组织开展密云水库流域总氮等主要水污染物来源调查、溯源解析以及迁移转化规律研究，共同确定主要水污染物控制的重点领域、区域和主要措施，并纳入密云水库流域有关地方规划。 |
| According to the needs of the protection of water sources of the Miyun Reservoir, the People's Government of Beijing Municipality and the People's Government of Hebei Province may develop local water pollutant discharge standards that are stricter than the national water pollutant discharge standards for the Miyun Reservoir Basin and report them to the competent department of ecology and environment of the State Council for recordation. | | 根据密云水库水源保护需要，北京市人民政府、河北省人民政府可以对密云水库流域制定严于国家水污染物排放标准的地方水污染物排放标准，报国务院生态环境主管部门备案。 |
| Article 10 The people's governments at or above the county level of the Miyun Reservoir Basin shall, in accordance with the law, demarcate the livestock and poultry breeding prohibition zones within the Miyun Reservoir Basin. | | 第十条 密云水库流域县级以上地方人民政府应当在密云水库流域依法划定畜禽禁养区。 |
