| Chapter I General Provisions | | 第一章 总 则 |
| Article 1 These Measures are formulated in accordance with the Regulation of the People's Republic of China on Road Transport and relevant laws, regulations and rules, as well as the decisions and plans of the State Council concerning promoting the standardized and sound development of the platform economy for the purposes of promoting the integrated development of the road freight transport sector and the Internet, regulating the operational activities of online road freight contracting carrier platforms, maintaining the order of the road freight transport market, and protecting the lawful rights and interests of all parties concerned. | | 第一条 为促进道路货物运输业与互联网融合发展，规范网络货运承运平台经营活动，维护道路货物运输市场秩序，保护各方当事人合法权益，根据《中华人民共和国道路运输条例》及有关法律法规规章的规定和国务院关于促进平台经济规范健康发展的决策部署，制定本办法。 |
| Article 2 The administration of online road freight contracting carrier platform operations shall comply with these Measures. For the purposes of these Measures, “online road freight contracting carrier platform operations” mean road freight transportation operations in which an operator, acting through an internet-based platform, integrates and allocates transport resources, enters into contracts of carriage with consignors in its capacity as a carrier, entrusts actual carriers with the performance of road freight transportation, and assumes carrier liability. | | 第二条 网络货运承运平台经营管理，应当遵守本办法。本办法所称网络货运承运平台经营，是指经营者依托互联网平台整合配置运输资源，以承运人身份与托运人签订运输合同，委托实际承运人完成道路货物运输，承担承运人责任的道路货物运输经营活动。 |
| The term “actual carrier” means an operator that, upon being entrusted by an online road freight contracting carrier platform, uses qualified freight vehicles and drivers to actually carry out road freight transportation. | | 实际承运人，是指接受网络货运承运平台委托，使用符合条件的载货汽车和驾驶员，实际从事道路货物运输的经营者。 |
| Article 3 An online road freight contracting carrier platform that conducts business operations shall adhere to the principles of voluntariness, equality, fairness, and good faith, comply with laws and business ethics, participate in market competition on a fair basis, assume responsibility for the quality of transportation services, and be subject to supervision by transport regulatory authorities and the public. | | 第三条 网络货运承运平台从事经营活动，应当遵循自愿、平等、公平、诚信的原则，遵守法律和商业道德，公平参与市场竞争，承担运输服务质量责任，接受行业管理部门和社会的监督。 |
| The administration of an online road freight contracting carrier platform shall be impartial, fair, and convenient to the public. | | 网络货运承运平台经营管理应当公正、公平、便民。 |
| Article 4 The transport department of the State Council shall be responsible for the nationwide administration of online road freight contracting carrier platform operations. | | 第四条 国务院交通运输主管部门主管全国网络货运承运平台经营管理工作。 |
| The transport departments of local people's governments at or above the county level shall be responsible for the administration of online road freight contracting carrier platform operations within their respective administrative regions. | | 县级以上地方人民政府交通运输主管部门负责本行政区域的网络货运承运平台经营管理工作。 |
| Article 5 Online road freight contracting carrier platforms are encouraged to integrate transport resources through the use of technologies such as big data, cloud computing, satellite positioning, and artificial intelligence, and to apply transport organization models including multimodal transport, drop-and-pull transport, and joint distribution, thus achieving large-scale and intensive transportation operations. Such platforms are also encouraged to organize standardized vehicle transportation, including the use of new-energy vehicles and modular vehicle combinations. | | 第五条 鼓励网络货运承运平台利用大数据、云计算、卫星定位、人工智能等技术整合资源，应用多式联运、甩挂运输和共同配送等运输组织模式，实现规模化、集约化运输生产。鼓励组织新能源车辆、模块化汽车列车等标准化车辆运输。 |
| Chapter II Operation Management | | 第二章 经营管理 |
| Article 6 Where a Road Transport Business License is required, an applicant may apply to the transport department at the county level at the place where it is located. The transport department at the county level shall, in accordance with the provisions of the Regulation of the People's Republic of China on Road Transport and the Provisions on the Administration of Road Freight Transport and Stations (Sites), issue a Road Transport Business License to an applicant that satisfies the prescribed requirements, which specifies that the business scope is online road freight contracting carrier platform operations. | | 第六条 需要申领道路运输经营许可证的，可向所在地县级交通运输主管部门提出申请，县级交通运输主管部门应当按照《中华人民共和国道路运输条例》《道路货物运输及站场管理规定》的规定，向符合条件的申请人颁发《道路运输经营许可证》，经营范围为网络货运承运平台经营。 |
| Article 7 An entity engaging in online road freight contracting carrier platform operations shall comply with the requirements applicable to commercial internet information services under the Administrative Measures for Internet Information Services and other relevant laws, regulations, and rules, and shall possess online service capabilities commensurate with its business operations, including information interaction and processing and full-process tracking and recording. | | 第七条 从事网络货运承运平台经营的，应当符合《互联网信息服务管理办法》等相关法律法规规章关于经营性互联网信息服务的要求，并具备与开展业务相适应的信息交互处理及全程跟踪记录等线上服务能力。 |
| Article 8 An online road freight contracting carrier platform shall, in accordance with the Work Safety Law of the People's Republic of China, establish and improve a work safety management system commensurate with its online service capabilities, strengthen work safety education and training for personnel engaged in its operations, and assume primary responsibility for work safety. | | 第八条 网络货运承运平台应当按照《中华人民共和国安全生产法》的规定，建立健全与线上服务能力相适应的安全生产管理制度，加强从业人员安全生产教育和培训，落实安全生产主体责任。 |
| Article 9 An online road freight contracting carrier platform shall conduct its business activities within the scope of its licensed business operations. | | 第九条 网络货运承运平台应当在许可的经营范围内从事经营活动。 |
| An online road freight contracting carrier platform may not transport goods that are prohibited from transportation under laws, regulations, or rules. | | 网络货运承运平台不得运输法律法规规章禁止运输的货物。 |
| Article 10 An online road freight contracting carrier platform shall review the qualifications of vehicles and drivers engaged by actual carriers to ensure that vehicles providing transportation services hold valid and effective road transport certificates (excluding general freight vehicles with a gross vehicle mass of 4.5 metric tons or less engaged in ordinary freight transportation) and that drivers hold valid and effective professional qualification certificates (excluding drivers operating general freight vehicles with a gross vehicle mass of 4.5 metric tons or less). | | 第十条 网络货运承运平台应当对实际承运车辆及驾驶员资质进行审查，保证提供运输服务的车辆具备合法有效的道路运输证（从事普通货物运输经营的总质量4.5吨及以下普通货运车辆除外）、驾驶员具有合法有效的从业资格证（使用总质量4.5吨及以下普通货运车辆的驾驶人员除外）。 |
| An online road freight contracting carrier platform and an actual carrier shall ensure that the vehicles and drivers providing services online are identical to those actually providing services offline. | | 网络货运承运平台和实际承运人应当保证线上提供服务的车辆、驾驶员与线下实际提供服务的车辆、驾驶员一致。 |
| An online road freight contracting carrier platform may not entrust transportation services beyond the business scope of the actual carrier. | | 网络货运承运平台委托运输不得超越实际承运人的经营范围。 |
| Article 11 An online road freight contracting carrier platform may not fabricate transportation transactions or engage in reciprocal entrustment of transportation services. | | 第十一条 网络货运承运平台不得虚构运输交易相互委托运输服务。 |
| Article 12 Where an online road freight contracting carrier platform entrusts an actual carrier with the responsibility to provide road freight transportation services, its business activities shall comply with the contractual terms and relevant operational service standards issued by the state, and it shall settle freight charges with the actual carrier in a timely manner in accordance with the contract. | | 第十二条 网络货运承运平台委托实际承运人从事道路货物运输服务，经营行为应当符合合同约定条款及国家相关运营服务规范，按照合同约定及时向实际承运人结算运费。 |
