The Provisions on the Administration of Certified Constructors, which were discussed and adopted at the 112th executive meeting of the Ministry of Construction on December 11, 2006, are hereby promulgated and shall come into force as of March 1, 2007.

Chapter I General Provisions
| | 第一章 总则
|
Article 1 These Provisions are formulated according to the Construction Law, the Administrative License Law, the Regulation on the Quality Management of Construction Projects and other laws and administrative regulations for the purpose of strengthening the administration of certified constructors, regulating the practice of certified constructors, enhancing the management level of engineering projects, and ensuring the quality and safety of projects.
| | 第一条 为了加强对注册建造师的管理，规范注册建造师的执业行为，提高工程项目管理水平，保证工程质量和安全，依据《建筑法》、《行政许可法》、《建设工程质量管理条例》等法律、行政法规，制定本规定。

Article 2 The registration, practice, continuing education, supervision and administration of certified constructors within the territory of the People's Republic of China shall be governed by these Provisions.
| | 第二条 中华人民共和国境内注册建造师的注册、执业、继续教育和监督管理，适用本规定。

Article 3 The “certified constructors” mentioned in these Provisions refers to the professional technicians who have obtained the qualification of certified constructor of the People's Republic of China (hereinafter referred to as qualification certificate) after passing assessment or examination, have obtained a registration certificate of certified constructor of the People's Republic of China (hereinafter referred to as registration certificates) and a practicing seal after making registration according to these Provisions, and are acting as the project managers of construction entities and engaging in relevant activities.
Anyone who has not obtained a registration certificate or practicing seal may not act as the project manager of the construction entity for a large or medium-sized construction project or engage in relevant activities in the name of a certified constructor.
| | 第三条 本规定所称注册建造师，是指通过考核认定或考试合格取得中华人民共和国建造师资格证书（以下简称资格证书），并按照本规定注册，取得中华人民共和国建造师注册证书（以下简称注册证书）和执业印章，担任施工单位项目负责人及从事相关活动的专业技术人员。
未取得注册证书和执业印章的，不得担任大中型建设工程项目的施工单位项目负责人，不得以注册建造师的名义从事相关活动。

Article 4 The construction administrative department of the State Council shall be responsible for uniformly supervising and administrating the registration and practice of certified constructors across the country. The administrative departments of railway, communications, water conservancy, information industry and civil aviation, etc. under the State Council shall be responsible for supervising and administrating the practice of certified constructors in relevant professional projects across the country.
The construction administrative department of the people's government at or above the county level shall be responsible for supervising and administrating the registration and practice of certified constructors within its own jurisdiction; and the administrative departments of communications, and telecommunications, etc. of the people's government at or above the county level shall be responsible for supervising and administrating the practice of certified constructors in relevant professional projects within their respective jurisdictions.
| | 第四条 国务院建设主管部门对全国注册建造师的注册、执业活动实施统一监督管理；国务院铁路、交通、水利、信息产业、民航等有关部门按照国务院规定的职责分工，对全国有关专业工程注册建造师的执业活动实施监督管理。
县级以上地方人民政府建设主管部门对本行政区域内的注册建造师的注册、执业活动实施监督管理；县级以上地方人民政府交通、水利、通信等有关部门在各自职责范围内，对本行政区域内有关专业工程注册建造师的执业活动实施监督管理。

Chapter II Registration
| | 第二章 注册
|
Article 5 The certified practice management system shall be adopted for certified constructors. Certified constructors are classified into Grade I certified constructors and Grade II certified constructors.
Anyone who has obtained a qualification certificate shall not practice in the name of a certified constructor until he has completed the registration formalities.
| | 第五条 注册建造师实行注册执业管理制度，注册建造师分为一级注册建造师和二级注册建造师。
取得资格证书的人员，经过注册方能以注册建造师的名义执业。

Article 6 Anyone who applies for the initial registration shall meet the following conditions:
| | 第六条 申请初始注册时应当具备以下条件：
|
(1) having passed the assessment or examination and obtained a qualification certificate;
| | （一）经考核认定或考试合格取得资格证书；
|
(2) being employed by a relevant entity;
| | （二）受聘于一个相关单位；
|
(3) having reached the requirements for continuing education; and
| | （三）达到继续教育要求；
|
(4) not being under any of the circumstances mentioned in Article 15 of these Provisions.
| | （四）没有本规定第十五条所列情形。
|
Article 7 Where a person has obtained a qualification certificate and is employed by an entity of construction project survey, design, building, supervision, public tender on a commissioned basis or cost consultation, he shall, via his employer, file a registration application to the construction administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government where the industrial and commercial registration place of his employer is located.
The construction administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government shall put forward preliminary examination opinions after accepting the application, and submit the preliminary examination opinions and the complete set of application materials to the construction administrative department of the State Council for examination and approval. Where railway, highway, port, sea routes, water conservancy, water and electricity, telecommunications, radio, television and film, or civil aviation, etc. is involved, the construction administrative department of the State Council shall submit all the application materials to the relevant department at the same level for examination and approval. If the applicant meets the relevant conditions, the construction administrative department of the State Council shall issue to him a Registration Certificate of the People's Republic of China for Grade I Constructors, and verify the serial number of the practicing seal.
| | 第七条 取得一级建造师资格证书并受聘于一个建设工程勘察、设计、施工、监理、招标代理、造价咨询等单位的人员，应当通过聘用单位向单位工商注册所在地的省、自治区、直辖市人民政府建设主管部门提出注册申请。
省、自治区、直辖市人民政府建设主管部门受理后提出初审意见，并将初审意见和全部申报材料报国务院建设主管部门审批；涉及铁路、公路、港口与航道、水利水电、通信与广电、民航专业的，国务院建设主管部门应当将全部申报材料送同级有关部门审核。符合条件的，由国务院建设主管部门核发《中华人民共和国一级建造师注册证书》，并核定执业印章编号。

Article 8 In the case of an application for initial registration, the construction administrative department of the people's government of a province, autonomous region, or municipality directly under the Central Government shall, within 20 days upon receipt of the application, complete the examination and submit the application materials and preliminary examination opinions to the construction administrative department of the State Council. The construction administrative department of the State Council shall, within 20 days upon receipt of the materials as submitted by the construction administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government, complete the examination and approval and make a written decision. The relevant department shall, within 10 days upon receipt of the application materials transferred by the construction administrative department of the State Council, complete the examination and approval, and submit the examination and approval opinions to the construction administrative department of the State Council.
In the case of an application for registration modification or renewal, the construction administrative department of the people's government of a province, autonomous region, or municipality directly under the Central Government shall, within 5 days upon receipt of the application, complete the examination. The construction administrative department of the State Council shall, within 10 days upon receipt of the materials as submitted by the construction administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government, complete the examination and approval and make a written decision. The relevant department shall, within 5 days upon receipt of the application materials transferred by the construction administrative department of the State Council, complete the examination and approval and submit the examination and approval opinions to the construction administrative department of the State Council.
| | 第八条 对申请初始注册的，省、自治区、直辖市人民政府建设主管部门应当自受理申请之日起，20日内审查完毕，并将申请材料和初审意见报国务院建设主管部门。国务院建设主管部门应当自收到省、自治区、直辖市人民政府建设主管部门上报材料之日起，20日内审批完毕并作出书面决定。有关部门应当在收到国务院建设主管部门移送的申请材料之日起，10日内审核完毕，并将审核意见送国务院建设主管部门。
对申请变更注册、延续注册的，省、自治区、直辖市人民政府建设主管部门应当自受理申请之日起5日内审查完毕。国务院建设主管部门应当自收到省、自治区、直辖市人民政府建设主管部门上报材料之日起，10日内审批完毕并作出书面决定。有关部门在收到国务院建设主管部门移送的申请材料后，应当在5日内审核完毕，并将审核意见送国务院建设主管部门。

Article 9 The construction administrative department of the people's government of a province, autonomous region, or municipality directly under the Central Government shall be responsible for accepting, examining and approving the registration applications filed by the persons who have obtained the qualification certificates for Grade II constructors, and the specific examination and approval procedures shall be determined by the construction administrative department of the people's government of a province, autonomous region, or municipality directly under the Central Government. In case the registration is approved, a Registration Certificate of the People's Republic of China for Grade II Constructors uniformly designed by the construction administrative department of the State Council and a practicing seal shall be issued upon verification, and the provincial construction administrative department shall, within 30 days after issuance of the certificates, submit them to the construction administrative department of the State Council for archival filing.
| | 第九条 取得二级建造师资格证书的人员申请注册，由省、自治区、直辖市人民政府建设主管部门负责受理和审批，具体审批程序由省、自治区、直辖市人民政府建设主管部门依法确定。对批准注册的，核发由国务院建设主管部门统一样式的《中华人民共和国二级建造师注册证书》和执业印章，并在核发证书后30日内送国务院建设主管部门备案。

Article 10 The registration certificates and practicing seals are the practicing certification of certified constructors. They shall be kept and used by the certified constructors themselves.
The registration certificates and practicing seals shall be valid for a period of 3 years.
The registration certificates for Grade I certified constructors shall be uniformly printed by the construction administrative department of the State Council, and the practicing seals shall be uniformly designed by the construction administrative department of the State Council and be printed by the construction administrative department of the people's government of a province, autonomous region, or municipality directly under the Central Government.
| | 第十条 注册证书和执业印章是注册建造师的执业凭证，由注册建造师本人保管、使用。
注册证书与执业印章有效期为3年。
一级注册建造师的注册证书由国务院建设主管部门统一印制，执业印章由国务院建设主管部门统一样式，省、自治区、直辖市人民政府建设主管部门组织制作。

Article 11 An applicant for initial registration may file a registration application within 3 years from the date of issuance of the qualification certificate. If he fails to do so within the time limit, he shall not apply for initial registration unless he meets the requirements for professional continuing education.
An applicant shall submit the following materials for the initial registration:
| | 第十一条 初始注册者，可自资格证书签发之日起3年内提出申请。逾期未申请者，须符合本专业继续教育的要求后方可申请初始注册。
申请初始注册需要提交下列材料：
|
(1) an application form for the initial registration of the certified constructor;
| | （一）注册建造师初始注册申请表；
|
(2) a photocopy of his qualification certificate, diploma and identity certificate;
| | （二）资格证书、学历证书和身份证明复印件；
|
(3) a photocopy of the employment labor contract concluded between him and his employer or any other valid certificate; and
| | （三）申请人与聘用单位签订的聘用劳动合同复印件或其他有效证明文件；
|
(4) the certification materials proving that he conforms to the continuing education requirements if the time limit for the initial registration expires.
| | （四）逾期申请初始注册的，应当提供达到继续教育要求的证明材料。

Article 12 In case a certified constructor needs to continue practice after the valid registration term expires, he shall, not later than 30 days prior to the expiration of the valid registration cycle, apply for renewal of registration under Articles 7 and 8 of these Provisions. The valid period of a renewal of registration shall be 3 years.
An applicant shall submit the following materials for the renewal of registration:
| | 第十二条 注册有效期满需继续执业的，应当在注册有效期届满30日前，按照第七条、第八条的规定申请延续注册。延续注册的，有效期为3年。
申请延续注册的，应当提交下列材料：
|
(1) an application form for the renewal of registration of the certified constructor;
| | （一）注册建造师延续注册申请表；
|
(2) his original registration certificate;
| | （二）原注册证书；
|
(3) a photocopy of the employment labor contract concluded between him and his employer or any other valid certificate; and
| | （三）申请人与聘用单位签订的聘用劳动合同复印件或其他有效证明文件；
|
(4) the certification materials, which prove that he conforms to the continuing education requirements within the valid registration cycle.
